Common use of Establishment of Service Clause in Contracts

Establishment of Service. 6.1 After receiving certification as a local exchange carrier from the applicable regulatory agency, MTI will provide the appropriate BellSouth account manager the necessary documentation to enable BellSouth to establish accounts for resold services ("master account"). MTI is required to provide the following before a master account is established: proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a tax exemption certificate, if applicable. 6.1.1 If MTI needs to change its OCN(s) under which it operates when MTI has already bee conducting business utilizing those OCN(s), MTI shall bear all costs incurred by BellSouth to convert MTI MTI to the new OCN(s). OCN conversion charges include all time required to make system updates to all of MTI's end user customer records. Appropriate charges will appear in the OC&C section of MTI's xxxx. 6.2 MTI shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTI’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI to such other CLEC. Upon completion of the conversion BellSouth will notify MTI that such conversion has been completed.

MTI Express Connection is required to provide the following before a master account is established: blanket letter of authorization, misdirected number form, proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a deposit and tax exemption certificate, if applicable. 6.1.1 If MTI Express Connection needs to change change, add to, eliminate or convert its OCN(s) under which it operates when MTI Express Connection has already bee been conducting business utilizing those OCN(s), MTI Express Connection shall bear pay all costs incurred by BellSouth to convert MTI MTI charges as a result of such change, addition, elimination or conversion to the new OCN(s). OCN conversion charges include include, but are not limited to, all time required to make system updates to all of MTIExpress Connection's end user customer recordsEnd User records and any other changes to BellSouth systems or Express Connection records and will be handled in a separately negotiated agreement or as otherwise required by BellSouth. Appropriate charges will appear in the OC&C section of MTIExpress Connection's xxxx. 6.2 MTI Express Connection shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Express Connection will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIExpress Connection’s End User customerUser. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Express Connection to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Express Connection to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Express Connection that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTI's EPICUS’ end user customer records. Appropriate charges will appear in the OC&C section of MTI's xxxxEPICUS’ bill. 6.2 MTI EPICUS shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI EPICUS will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTI’s EPICUS’ End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI EPICUS to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI EPICUS to such other CLEC. Upon completion of the conversion BellSouth will notify MTI EPICUS that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTIParamount's end user customer records. Appropriate charges will appear in the OC&C section of MTIParamount's xxxx. 6.2 MTI Paramount shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Paramount will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIParamount’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Paramount to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Paramount to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Paramount that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTITelSouth's end user customer records. Appropriate charges will appear in the OC&C section of MTITelSouth's xxxx. 6.2 MTI TelSouth shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI TelSouth will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTITelSouth’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI TelSouth to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI TelSouth to such other CLEC. Upon completion of the conversion BellSouth will notify MTI TelSouth that such conversion has been completed.

Appropriate charges will appear in the OC&C section of MTI's xXxxXxx'x xxxx. 6.2 MTI eXpeTel shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI eXpeTel will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIeXpeTel’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI eXpeTel to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI eXpeTel to such other CLEC. OCN conversion charges include all time required to make system updates to all of MTISpectrotel's end user customer records. Appropriate charges will appear in the OC&C section of MTISpectrotel's xxxx. 6.2 MTI Spectrotel shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Spectrotel will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. OCN conversion charges include all time required to make system updates to all of MTIFPB's end user customer records. Appropriate charges will appear in the OC&C section of MTIFPB's xxxx. 6.2 MTI FPB shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI FPB will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIFPB’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI FPB to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI FPB to such other CLEC. Upon completion of the conversion BellSouth will notify MTI FPB that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTIALTICOMM's end user customer records. Appropriate charges will appear in the OC&C section of MTIALTICOMM's xxxx. 6.2 MTI ALTICOMM shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI ALTICOMM will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIALTICOMM’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI ALTICOMM to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI ALTICOMM to such other CLEC. Upon completion of the conversion BellSouth will notify MTI ALTICOMM that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTIAccess Point's end user customer records. Appropriate charges will appear in the OC&C section of MTIAccess Point's xxxx. 6.2 MTI Access Point shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Access Point will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIAccess Point’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Access Point to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Access Point to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Access Point that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTINuStar's end user customer records. Appropriate charges will appear in the OC&C section of MTINuStar's xxxx. 6.2 MTI NuStar shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI NuStar will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTINuStar’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI NuStar to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI NuStar to such other CLEC. Upon completion of the conversion BellSouth will notify MTI NuStar that such conversion has been completed.

OCN conversion charges include all time required to make system updates to all of MTISPARDI's end user customer records. Appropriate charges will appear in the OC&C section of MTIXXXXXX's xxxxbill. 6.2 MTI SPARDI shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI SPARDI will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTISPARDI’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI SPARDI to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI SPARDI to such other CLEC. MTI Direct Telephone is required to provide the following before a master account is established: proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a tax exemption certificate, if applicable. 6.1.1 If MTI Direct Telephone needs to change its OCN(s) under which it operates when MTI Direct Telephone has already bee conducting business utilizing those OCN(s), MTI Direct Telephone shall bear all costs incurred by BellSouth to convert MTI MTI Direct Telephone Direct Telephone to the new OCN(s). OCN conversion charges include all time required to make system updates to all of MTIDirect Telephone's end user customer records. Appropriate charges will appear in the OC&C section of MTIDirect Telephone's xxxxbill. 6.2 MTI Direct Telephone shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Direct Telephone will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIDirect Telephone’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Direct Telephone to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Direct Telephone to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Direct Telephone that such conversion has been completed.

MTI VMT is required to provide the following before a master account is established: proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a tax exemption certificate, if applicable. 6.1.1 If MTI VMT needs to change its OCN(s) under which it operates when MTI VMT has already bee conducting business utilizing those OCN(s), MTI VMT shall bear all costs incurred by BellSouth to convert MTI MTI VMT VMT to the new OCN(s). OCN conversion charges include all time required to make system updates to all of MTIVMT's end user customer records. Appropriate charges will appear in the OC&C section of MTIVMT's xxxx. 6.2 MTI VMT shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI VMT will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIVMT’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI VMT to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI VMT to such other CLEC. Upon completion of the conversion BellSouth will notify MTI VMT that such conversion has been completed.

Establishment of Service. 6.1 After receiving certification as a local exchange carrier from the applicable regulatory agency, MTI JCM will provide the appropriate BellSouth account Advisory team manager the necessary documentation to enable BellSouth to establish accounts for resold services ("master account"). MTI JCM is required to provide the following before a master account is established: blanket letter of authorization, misdirected number form, proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a deposit and tax exemption certificate, if applicable. 6.1.1 If MTI JCM needs to change its OCN(s) under which it operates when MTI JCM has already bee conducting business utilizing those OCN(s), MTI JCM shall bear all costs incurred by BellSouth to convert MTI MTI JCM JCM to the new OCN(s). Appropriate charges will appear in the OC&C section of MTIGateway's xxxx. 6.2 MTI Gateway shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI Gateway will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTIGateway’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Gateway to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Gateway to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Gateway that such conversion has been completed.
