Common use of Establishment of Service Clause in Contracts

Establishment of Service. 6.1 After receiving certification as a local exchange carrier from the applicable regulatory agency, MTI will provide the appropriate BellSouth account manager the necessary documentation to enable BellSouth to establish accounts for resold services ("master account"). MTI is required to provide the following before a master account is established: proof of PSC/PUC certification, the Application for Master Account, an Operating Company Number ("OCN") assigned by the National Exchange Carriers Association ("NECA") and a tax exemption certificate, if applicable. 6.1.1 If MTI needs to change its OCN(s) under which it operates when MTI has already bee conducting business utilizing those OCN(s), MTI shall bear all costs incurred by BellSouth to convert MTI MTI to the new OCN(s). OCN conversion charges include all time required to make system updates to all of MTI's end user customer records. Appropriate charges will appear in the OC&C section of MTI's xxxx. 6.2 MTI shall provide to BellSouth a blanket letter of authorization ("LOA") certifying that MTI will have End User authorization prior to viewing the End User's customer service record or switching the End User's service. BellSouth will not require End User confirmation prior to establishing service for MTI’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI to such other CLEC. Upon completion of the conversion BellSouth will notify MTI that such conversion has been completed.

BellSouth will not require End User confirmation prior to establishing service for MTIDirect Telephone’s End User customer. 6.3 BellSouth will accept a request directly from the End User for conversion of the End User's service from MTI Direct Telephone to BellSouth or will accept a request from another CLEC for conversion of the End User's service from MTI Direct Telephone to such other CLEC. Upon completion of the conversion BellSouth will notify MTI Direct Telephone that such conversion has been completed.
