Common use of Evaluations Grievance Procedure Clause in Contracts

Evaluations Grievance Procedure. Because of the technical nature of many aspects of classified employee evaluations, the District and Association agree that only the procedural aspects of the evaluation process are subject to the grievance procedure of this Agreement. Issues that may arise regarding the content of an evaluation shall be resolved by the following review procedure: 7.3.1 The content of the evaluation may be reviewed on the basis that either the standards or criteria utilized by the evaluator were unfair and/or arbitrary or that the evaluator's judgments related to those criteria were unfair and/or arbitrary. 7.3.2 Within five (5) school days of receipt of the evaluation, the employee may request a meeting with the Superintendent or designee. The Superintendent or designee shall schedule a meeting with the employee and the evaluator to discuss the evaluation and attempt to resolve any disagreements concerning the evaluation. 7.3.3 The decision of the Superintendent or designee shall be final, subject to the right of the employee to attach a written statement to the evaluation pursuant to Section 7.2.4.
