Evidence Supporting Claim. 1.1.1 When taking leave for personal illness or injury, the employee must, if required by the Company, establish by production of a medical certificate or statutory declaration, that the employee was unable to work because of injury or personal illness. 1.1.2 When taking leave to care for members of their immediate family or household who are sick and require care and support, the employee must, if required by the Company, establish by production of a medical certificate or statutory declaration, the illness of the person concerned and that such illness requires care by the employee.

Evidence Supporting Claim. The employee is only entitled to compassionate leave if the employee gives his or her employer any evidence that the employer reasonably required of the illness, injury or death.
Evidence Supporting Claim. (a) In the event of an employee becoming sick and: (i) certified as such by a registered health practitioner; or (ii) on the production of a Statutory Declaration signed by the Employee on not more than three separate occasions in any one calendar year, for up to three days on each occasion; he or she shall be entitled to personal leave on full pay. (b) Provided that any Employee may be absent through sickness for one day without furnishing evidence of such sickness as provided in paragraph (a), on not more than three occasions in any one year of service. However, a certificate from a registered health practitioner must be provided where the Employee was • sick or injured during annual leave; • absent on the day immediately before or after a public holiday (c) The provisions above regarding evidence also apply to carer’s leave When taking leave to provide care or support for a member of their immediate family or household who requires care or support due to an unexpected emergency. However, the Employee must, if required by the Employer, establish by production of documentation acceptable to the employer or a statutory declaration, the nature of the emergency and that such emergency resulted in the person concerned requiring care or support by the Employee. (d) Where an Employee is absent on the grounds of personal leave, the employee must give his or her employer notice of such absence in accordance with this section. (i) The notice must be given to the Employer as soon as reasonably practicable (which may be at a time that is before or after the period of personal leave has started). (ii) The notice must be to the effect that the Employee requires (or required) leave during the period: (A) Because of a personal illness, or injury, of the Employee; or (B) To provide care or support to a member of the Employee’s immediate family, or a member of the employee’s household who requires (or required) care or support because of an illness or injury affecting that member, or an unexpected emergency affecting the member. (iii) This section does not apply to an employee who could not comply with it because of circumstances beyond the employee’s control.
Evidence Supporting Claim. (a) The Employer will require the Employee to provide evidence that would satisfy a reasonable person to support the taking of personal/carer’s leave, provided that: (i) Employees other than Dental Assistants employed by DHSV or Ballarat Health Service may be absent through personal illness or injury for one day without furnishing evidence on not more then three (3) occasions in any one year of service. (ii) Dental Assistants employed by DHSV or Ballarat Health Service may be absent through personal injury or illness for one day without furnishing evidence on not more than five (5) occasions in any one year of service. (b) When taking leave to care for members of their immediate family or household who are ill or injured and require care and support, the Employee will, if required by the Employer, establish by production of a medical certificate or statutory declaration, the illness or injury of the person who requires care and support. (c) When taking leave to care for members of their immediate family or household who require care due to an unexpected emergency, the Employee must, if required by the Employer, establish by production of documentation acceptable to the Employer or a statutory declaration, the nature of the emergency and that such emergency resulted in the person concerned requiring care by the Employee. (d) In normal circumstances, an Employee must not take leave to care for an immediate family or household member under this clause where another person has taken leave to care for the same person. (e) An Employee is not entitled to personal/carer’s leave under this clause unless they have complied with the foregoing notice and evidence requirements.
Evidence Supporting Claim. 21.7.1 An application for sick leave must be supported by the certificate of a duly qualified medical practitioner or other evidence approved by Australia Post. 21.7.2 In relation to the provision of evidence for carer’s leave: (a) for xxxxx’s leave of a single day duration, where it is not feasible to obtain a medical certificate for that single day’s absence, the employee may instead provide a statutory declaration establishing the illness of the person to whom the carer’s leave relates and indicating that the employee is responsible for the care of the person concerned; and (b) for xxxxx’s leave of more than a single day duration, the employee must provide a medical certificate establishing the illness of the person to whom the carer’s leave relates and indicating that the employee is responsible for the care of the person concerned. 21.7.3 When taking leave to care for members of their immediate family or household who require care due to an unexpected emergency, the employee must, if required by Australia Post, establish by production of documentation acceptable to Australia Post or a statutory declaration of the nature of the emergency and that such emergency resulted in the person concerned requiring care by the employee.

In the event of a dispute, management at its expense shall have the employee referred to a medical practitioner.
