Exacerbation. If Tenant exacerbates a Pre-Existing Condition (as a result of Tenant's investigative or remedial activities or otherwise) during the Lease Term, the provisions of this Article XXX shall apply to such exacerbation of the Pre-Existing Condition as if it were an Environmental Condition, and Tenant shall perform Environmental Remediation as to such exacerbation. Tenant shall be responsible for all fines and penalties caused by Tenant or to the extent exacerbated by Tenant at any time during the Lease Term.
Exacerbation. Tenant shall not be responsible to remediate a Pre-Existing Condition. Notwithstanding the foregoing, if Tenant exacerbates a Pre-Existing Condition of which it had knowledge (as a result of Tenant’s investigative or remedial activities or otherwise) during the Term, the provisions of this Article XXX shall apply solely to such exacerbation of the Pre-Existing Condition as if it were an Environmental Condition, and Tenant shall perform Environmental Remediation as to such exacerbation.
Exacerbation to the extent caused by the operations or activities of any member of the Agilent Group or their agents, employees, consultants, contractors or Authorized Tenants occurring at any Agilent Schedule 2 Facility; or (ii) the negligence or willful misconduct of any member of the Agilent Group, or their agents, employees, consultants, contractors or Authorized Tenants at any Agilent Schedule 2 Facility in connection with the Remedial Activities or any obligations of Agilent under this Agreement.
Exacerbation. Exacerbation" means any exacerbation, aggravation or worsening of any Environmental Conditions on, under or about any of the Agilent Schedule 2 Facilities that is caused by any member of the Agilent Group or an Authorized Tenant to such an extent that: (i) Remedial Activities that were not previously required as part of HP's Remediation Obligation become necessary to fulfill HP's Remediation Obligation, or (ii) HP otherwise incurs additional costs with respect to HP's Remediation Obligation.
Exacerbation deterioration in functional status leading to hospital admission (ICT- LTCare only) 18
Exacerbation. If Tenant exacerbates a Pre-Existing Condition of which Landlord notifies Tenant (including as a result of Tenant’s investigative or remediation activities) during the Lease term, that the provisions of this Article XXX shall apply to such exacerbation of the Pre-Existing Condition, and Tenant shall perform Environmental Remediation as to such exacerbation. Tenant shall be responsible for all fines and penalties caused by Tenant or to the extent exacerbated by Tenant (including Tenant’s environmental investigation or remediation activities) at any time during the Lease Term.
Exacerbation deterioration in functional status managed at home (ICT-LTCare only)
Exacerbation. The Vendor shall not be liable in relation to any claim under paragraph 3 or any claim for breach of the Environmental Warranties to the extent that the loss in respect of which the breach of Environmental Warranties is alleged or the Environmental Loss which is the subject of the claim arises by virtue of or is exacerbated by:
(i) any act or omission of the Purchaser or any member of the Purchaser's Group following Completion except to the extent that such act or omission was 251 reasonable in the circumstances and the Purchaser or any member of the Purchaser's Group did not know or could not be expected to know that such act or omission would exacerbate the loss; or
(ii) any Property being closed, redeveloped (other than redevelopment or construction works for the purposes of the Operations) or put or to be put to a more sensitive use than the use to which it was put immediately prior to Completion.
Exacerbation. Notwithstanding the foregoing terms of Section 30.1, under no circumstances shall Tenant be responsible for the remediation of a Pre-Existing Condition, or any Environmental Condition not caused by Tenant, whether or not Tenant discovers such Pre-Existing Condition. Notwithstanding the foregoing, Tenant shall not exacerbate a Pre-Existing Condition or any Environmental Condition not caused by Tenant. If Tenant or any member of Tenant Group exacerbates a Pre-Existing Condition, or any Environmental Condition not caused by Tenant, during the Term, the provisions of this Article XXX shall apply to such exacerbation of the Pre-Existing Condition or any Environmental Condition as if it were an Environmental Condition caused by Tenant, but solely to the extent Tenant has exacerbated such condition.
Exacerbation. The time to first moderate or severe COPD exacerbation will be analysed using the log rank test, stratified by smoking status, with Xxxxxx Xxxxx plot. Xxx'x model will also be used adjusting for region of recruitment, age, sex, baseline smoking status and baseline disease severity. For this analysis, data will not be imputed beyond end of study drug treatment. The time to first severe exacerbation will be analysed using the same methodology described above. The time to first requiring systemic corticosteroids will be analysed using the same methodology described above.
