Excess Material. At the conclusion of a Plan or upon expiry or termination of this Agreement, SIEGFRIED shall provide notice to METABOLEX of any excess Raw Material and/or Compound (the “Excess Material”) requiring disposal. METABOLEX shall instruct SIEGFRIED within [*] calendar days of receipt of such notice, whether SIEGFRIED shall deliver such Excess Material to METABOLEX (or to a METABOLEX designated Affiliate or Third Party) or otherwise dispose of such Excess Material. In the event that METABOLEX does not instruct SIEGFRIED within the above mentioned [*]-day period, SIEGFRIED may dispose of the Excess Material in its sole and absolute discretion without any further liability or obligation to METABOLEX. In any event, METABOLEX shall [*] (i) the delivery of Excess Material to METABOLEX (or to a METABOLEX designated Affiliate or Third Party) and/or any other disposal of Excess Material by SIEGFRIED. METABOLEX shall [*] (i) [*] excess Raw Material, and (ii) [*] excess Compound.
Excess Material. Provided that Material has been purchased by RSP strictly in accordance with SGI’s forecast under Section 3.3, if Material becomes unneeded for Repair Service due to termination of this Agreement, change in SGI’s requirements or the like, and RSP has no other reasonable use for such Material, RSP shall provide such Material to SGI, and SGI shall reimburse RSP for the cost thereof. RSP is to provide SGI quarterly with a list of the excess Material and justification for such excess.
Excess Material. All excess material shall become the property of the Owner.
Excess Material. A. Excess excavated material and unsuitable excavated material shall be disposed of on Owner’s property at his direction.
Excess Material. Stratus shall purchase any Excess Material within thirty (30) days of it becoming Excess Material. Stratus agrees to pay NEC for its normal actual out-of- pocket acquisition costs of those materials plus normal handling charges. In addition Stratus will pay Carrying Charges for the Excess Material but only for inventory on hand and not for material on order, but not yet delivered to NEC.
Excess Material. 4.2.1 Solectron owned raw material that is in excess of Tellium demand as a result of Purchase Order Cancellation, forecast changes, Engineering Change Orders (ECO's), and Minimum Order Quantity (MOQ) buys, will be the responsibility of Tellium and managed as provided below. Any material in excess due to a lifetime buy agreed to by Tellium will be treated as excess, unless otherwise agreed in writing.
Excess Material. Excess material means any part which is ordered by Solectron based on MRP demand, in the performance of this Agreement, that is not shipped on the date recorded on DMC's Purchase Order due to engineering changes, changed delivery schedules (push-outs), and/or end of life. Solectron shall use reasonable efforts to return such excess materials for credit or allocate such excess materials for alternate programs, as outlined in 4.3 of this Agreement. In the event Solectron is unable to return or allocate such excess materials, DMC agrees to purchase from Solectron any excess material aged beyond [*] ([*]) days at raw cost plus burden. Excess Material. Every week USR shall provide Customer the MRP results for approval, Customer shall response within one business day and approve/disapprove the purchasing requisition. Once a quarter and no later than two month from last delivery date Customer shell buy the approved excess material from USR + Xxxx up unless the customer issue an additional purchase order that consume this Excess Material.

Excess Material. Any excess material due to minimum buys, package quantity, order reductions, or order cancellations will be the sole responsibility of the Customer. Kato Cable will make every effort to use any excess material for other builds if requirements exist or to try to return material to the supplier. All applicable re-stocking fees will also be the responsibility of the customer. Customer agrees to pay for excess material upon receiving a list of said material along with its associated costs at net 10 days from invoice date.
