Excess Material. At the conclusion of a Plan or upon expiry or termination of this Agreement, SIEGFRIED shall provide notice to METABOLEX of any excess Raw Material and/or Compound (the “Excess Material”) requiring disposal. METABOLEX shall instruct SIEGFRIED within [*] calendar days of receipt of such notice, whether SIEGFRIED shall deliver such Excess Material to METABOLEX (or to a METABOLEX designated Affiliate or Third Party) or otherwise dispose of such Excess Material. In the event that METABOLEX does not instruct SIEGFRIED within the above mentioned [*]-day period, SIEGFRIED may dispose of the Excess Material in its sole and absolute discretion without any further liability or obligation to METABOLEX. In any event, METABOLEX shall [*] (i) the delivery of Excess Material to METABOLEX (or to a METABOLEX designated Affiliate or Third Party) and/or any other disposal of Excess Material by SIEGFRIED. METABOLEX shall [*] (i) [*] excess Raw Material, and (ii) [*] excess Compound.
Excess Material. All excess material shall become the property of the Owner.
Excess Material. Provided that Material has been purchased by RSP strictly in accordance with SGI’s forecast under Section 3.3, if Material becomes unneeded for Repair Service due to termination of this Agreement, change in SGI’s requirements or the like, and RSP has no other reasonable use for such Material, RSP shall provide such Material to SGI, and SGI shall reimburse RSP for the cost thereof. RSP is to provide SGI quarterly with a list of the excess Material and justification for such excess.
Excess Material. At the conclusion of the term of this Agreement, MANNKIND may provide notice to PULMATRIX of any excess Material (the “Excess Material”) requiring disposal. If PXXXXXXXX does not respond to MANNKIND stating that it agrees to accept receipt of or otherwise dispose of the Excess Material within sixty (60) days of receipt of such notice, then MANNKIND shall again provide notice to PULMATRIX providing an additional thirty (30) days’ notice. If PXXXXXXXX does not respond to MANNKIND stating that it agrees to accept receipt of or otherwise dispose of the Excess Material within such thirty (30) day notice period MANNKIND may dispose of the Excess Material without any further liability or obligation to PULMATRIX. The Party ultimately responsible for the disposal of the Excess Materials shall handle, store and dispose of such Excess Materials in compliance with all Applicable Laws. Excess Material. Material from the roadway in excess to that needed for maintenance of roadway.
Excess Material. Some materials are purchased on reels or minimum lot sizes and as a result there may be excess unused material at the end of an order. Buyer will have the option of using excess material on a follow on order immediately following the original order or to be billed for all excess material at the end of the original order. In any event, if excess material exists at the end of the original order and cannot be utilized on future orders, Buyer will be billed for all excess materials. Excess material will vary by quantity ordered. An estimate of excess material will be provided to Buyer upon request or at time of order based on order quantity. Nortech Systems will make every attempt to minimize excess materials and charges to Buyer.
Excess Material. 4.2.1 Solectron owned raw material that is in excess of Tellium demand as a result of Purchase Order Cancellation, forecast changes, Engineering Change Orders (ECO's), and Minimum Order Quantity (MOQ) buys, will be the responsibility of Tellium and managed as provided below. Any material in excess due to a lifetime buy agreed to by Tellium will be treated as excess, unless otherwise agreed in writing.
4.2.2 Excess Material is defined as the quantity of material On Hand (Raw, Work in Process, and Finished Goods Inventory) owned by Solectron which is greater than the quantity required to meet the next (***) Tellium forecast, or has had no consumption for the past (***).

Excess Material. In order to ensure there is enough material to do the work, Contractor may order more material than may be necessary to complete said work. Any excess materials will not result in a change of the agreed upon contract price. All materials remaining after completion of the work shall belong to Xxxxxx Construction
Excess Material. 1. 2. If the length of excess cable exceeds 3000 feet, the cable shall be tagged as specified above and left on the reel until further directed.
3. If the length of the excess cable is less than or equal to 3000 feet, the excess cable shall be removed from the reels, and disposed of by the Builder.
4. The Builder shall record the excess cable data information and supply it to the TOUCH AMERICA Representative or as required per the Contract.
5. Costs associated with transporting, handling, and loading excess TOUCH AMERICA furnished material shall be considered incidental to other work performed and will not be paid as a separate item, unless otherwise stated in the Contract 202.05. 1. Empty steel cable reels for cable provided by Lucent Technologies shall be transported to a designated storage yard to be returned to Lucent Technologies. Empty steel cable reels for cable provided by Siecor shall be transported to a designated storage yard to be returned to Siecor. Cable reels to be returned shall not contain cable, rope, or other material. The Builder shall be responsible for bent or damaged reels due to its negligence.
2. To return empty reels to Lucent Technologies, call 0-000-000-0000, notify them of the following: - The number of reels - The size of the reels - The address and phone number of the yard
3. To return empty reels to Siecor, call 0-000-000-0000, notify them of the following: - The number of reels - The size of the reels - The address and phone number of the yard
4. The Builder shall handle and load all returnable cable reels and shall prepare shipping papers therefor. Costs associated with transporting, handling, and loading returnable cable reels shall be considered incidental to other work performed and will not be paid as a separate item.
5. Cable reel returns shall be scheduled as soon as possible.
Excess Material. A. Excess excavated material and unsuitable excavated material shall be disposed of on Owner’s property at his direction.
