Excessive Activity. Your presentation to Processor of Excessive Activity will be a breach of this Agreement and cause for immediate termination. “Excessive Activity” means, during any monthly period, and for any one of Merchant’s terminal identification numbers or Merchant Identification Numbers, chargebacks and/or retrieval requests in excess of 1% of the average monthly dollar amount of your Card transactions or returns in excess of 3% of the average monthly dollar amount of Sales Drafts. You authorize, upon the occurrence of Excessive Activity, Member Bank and Processor to take additional actions as either of them may deem necessary, including but not limited to suspension of processing privileges or creation or maintenance of a Reserve Account in accordance with this Agreement.

Excessive Activity. Merchant’s presentation to Bank of Excessive Activity will be a breach of this Agreement and cause for immediate termination of this Agreement. “Excessive Activity” means, during any monthly period for any one of Merchant’s terminal identification numbers or merchant identification numbers: (i) the dollar amount and/or number of chargebacks and/or retrieval requests in excess of 1% of the average monthly dollar amount and or number of Card transactions; (ii) sales activity that exceeds by 25% of the dollar volume indicated on the Application; or (iii) the dollar amount of returns equals 3% of the average monthly dollar amount of your Card transactions. Merchant authorizes, upon the occurrence of Excessive Activity, Bank and NMS to take any action deemed necessary including but not limited to, suspension or termination of processing privileges or creation or maintenance of a Reserve Account in accordance with this Agreement.
Excessive Activity. Excessive Activity by You shall constitute a breach of this Agreement and cause for immediate termination of this Agreement with cause and without prior notice or an opportunity to cure. “Excessive Activity” means, during any monthly period and for any one of your terminal identification numbers or merchant identification numbers in the aggregate, Chargebacks and/or retrieval requests in excess of one percent (1%) of your average monthly Card transactions or returns in excess of three percent (3%) of the average monthly dollar amount of Sales Drafts. You authorize, upon the occurrence of Excessive Activity, Processor and Bank to take additional actions, as either of them may deem warranted in their sole and absolute discretion, to address or remedy Chargebacks, to prevent future Chargebacks, and/or to minimize the harm arising out of or relating to the Chargebacks, including, without limitation, suspension of processing privileges, creation or maintenance of a Reserve Account in accordance with this Agreement, or increase of funds or percentage of funds required in a Reserve Account.

Merchant authorize, upon the occurrence of Excessive Activity, Service Provider to take any action deemed necessary including but not limited to, suspension or termination of processing privileges or creation or maintenance of a Reserve Account in accordance with this Agreement.
Excessive Activity. Your presentation to EVO and Bank of Excessive Activity will be a breach of this Agreement and cause for immediate termination of this agreement. “Excessive Activity” means, during any monthly period: (i) the dollar amount of chargebacks and/or retrieval requests in excess of 1% of the average monthly dollar amount of your Card transactions; (ii) sales activity that exceeds by 10% of the dollar volume indicated on the Application; or (iii) the dollar amount of returns equals 20% of the average monthly dollar amount of your Card transactions. You authorize, upon the occurrence of Excessive Activity, EVO and Bank to take any action they deem necessary including but not limited to, suspension of processing privileges and establishment or increase in the amount allocated to the Reserve Account and a reduction in the amount of provisional credit remitted to you in accordance with this Agreement.

Merchant authorize, upon the occurrence of Excessive Activity, Service Provider to take any action deemed necessary including, but not limited to, suspension or termination of processing privileges or creation or maintenance of a Reserve Account in accordance with this Agreement.

You authorize, upon the occurrence of Excessive Activity, NPC to take additional actions as it may deem necessary, including but not limited to suspension of processing privileges.
