Common use of Excessive Assignments Clause in Contracts

Excessive Assignments. (a) If an employee has worked in excess of ten (10) consecutive days without having received at least one (1) day off, for all such days worked in excess of ten (10) and until such time as the employee has received a day off, the employee shall receive additional compensation at his or her straight-time rate of pay; provided, however, that if the employee is otherwise receiving at least time and one-half (1 ½) his or her straight-time rate of pay for any hours thereof by virtue of another provision of this Agreement, the employee's additional compensation therefore under this Section shall be at one-half (½) the employee's straight-time rate of pay. It is not the intention of the Company to schedule an employee to work in excess of twelve (12) consecutive days unless such assignment is necessitated by unusual operating requirements.
