Common use of Exempt Bargaining Unit Employees Clause in Contracts

Exempt Bargaining Unit Employees. The parties recognize that certain job classifications are salaried and are exempt from overtime coverage of the Fair Labor Standards Act (FLSA). Such exempt bargaining unit employees receive a salary for all hours worked during a seven (7) day work period. They may be required to work hours in excess of forty (40) hours (without additional compensation) in a seven (7) day work period if the nature of their duties and/or BSO management so requires. The determination of a job classification’s exempt status, in compliance with the FLSA, is the responsibility of the Bureau of Human Resources.
