HOURS OF WORK & OVERTIME. Section 15.1 This Article is intended to define the normal hours of work per day or per week in effect at the time of execution of this Agreement. Nothing contained herein shall be construed as preventing the Employer from restructuring the normal workday or workweek as necessary to promote efficiency or improve services, or from establishing the work schedules of employees. However, nothing in this Section shall relieve the Employer of its duty to bargain the affects of such decisions on employee wages, hours, terms and other conditions of employment. This Article shall be used as the basis for computing overtime for employees who are not exempt from the overtime provisions of the Fair Labor Standards Act and shall not be construed as a guarantee of hours of work per day or per week.
Section 15.2 Employees may take one paid fifteen (15) minute break for every four (4) hour block worked. Employees may combine breaks to take up to one (1) sixty (60) minute paid break. Employees may not leave campus on their paid breaks.
Section 15.3 Bargaining unit employees who are not exempt from the provisions of the Fair Labor Standards Act will be paid one and one-half times their normal hourly rate for all hours actually worked in excess of forty (40) hours per work week. All overtime shall have prior supervisory approval, except when it is necessary for a nurse to remain on duty to protect patient safety. Only hours actually worked are counted for the purpose of computing an employee's eligibility for overtime pay. There shall be no pyramiding of hours or pay.
Section 15.4 The Board serves individuals 24 hours per day, 7 days per week. To meet this need for service to our individuals evening and weekend hours may be required of any bargaining unit employee. The Employer will establish the standard work day as beginning at 6:00 a.m. and ending at 5:59 a.m. and starting and ending times for each shift in each department. Supervisors will establish daily workschedules.
Section 15.5 Absent an emergency situation, management will notify the Union in the event management intends to institute a long-term change in the present shift times for nurses. Following notification and upon request by the Union, management will meet with the Union to discuss the reason for the change and possible alternatives.

HOURS OF WORK & OVERTIME. Section 8.01 The regular working day for General Foreman, Foreman, Journeyman and Apprentices shall consist of eight (8) hours reckoned between 7:00 A.M. and 4:30 P.M., Monday through Friday, except when a designated holiday intervenes. The Employer may change the starting time of any job or shift by one hour earlier.
Section 8.02 When so elected by the Company multiple shifts of at least five (5) days duration may be worked. When two (2) or three (3) shifts are worked: The first shift (day shift) shall be worked between the hours of 7:00/8:00 a.m. and 3:30/4:30 p.m. Employees on the day shift shall receive eight (8) hours pay at the regular hourly rate for eight (8) hours work.
Section 8.03 Employees shall have the responsibility to work a reasonable amount of overtime. The Company has the right to assign and equitably distribute overtime. Employees shall be paid time and one- half (1-1/2) for all authorized work performed:
(a) In excess of eight (8) hours in any one (1) day or forty (40) hours in any one (1) week.
(b) For all “call out” prior to the employee's regularly scheduled starting time.
(c) For all installation work performed on Saturday. All overtime worked must be with the authority of the Company. Unauthorized work shall not be paid for.
Section 8.04 Double the employees regular straight time rate shall be paid for all work performed on Sundays and the following designated legal holidays. New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day, or days celebrated as such.
Section 8.05 To facilitate meeting customer requirements, the Company may establish and schedule second and third shifts. An employee must be notified of a change in shift hours at least twenty-four (24) hours prior to the shift change.
Section 8.06 An employee reporting for work during a scheduled work day, without previous notice to the contrary, and who is not permitted to commence work or only works a portion of the first section of the shift, shall be guaranteed four (4) hours work or four (4) hours pay. When the work extends into any portion of the second section of the shift the employee shall be guaranteed eight (8) hours work or eight (8) hours pay.

HOURS OF WORK & OVERTIME. Supplier shall comply with legally mandated work hours and will use overtime only when each employee is fully compensated according to local law while informing each employee at the time of hiring if mandatory overtime is a condition of employment. As a minimum the following recommendation applies: ILO R116: Hours of work.
HOURS OF WORK & OVERTIME. Section 1. This Article is intended only to provide a basis for the calculation of overtime and none of its provisions shall be construed as a guarantee of any minimum or maximum hours of work or weeks of work to any employee or to any group of employees.
Section 2. Time worked for the purpose of this Agreement is all hours actually worked and paid leave, excluding paid time used for sick leave purposes and unscheduled comp time leave.
Section 3. Eligible employees, as defined by FLSA, shall be compensated at the rate of time and one-half (1-1/2) in the form of pay or compensatory time off for authorized overtime worked in excess of eight (8) and/or alternate scheduled hours in a day or forty (40) hours in any one (1) workweek. Election of pay or compensatory time off must be declared by the employee when notified of having to work overtime. No application of this Article shall be interpreted to provide for compensation for overtime at a rate exceeding time and one-half (1-1/2). When called back to work on a regularly scheduled day off, an eligible employee will be paid a minimum of the equivalent of two (2) hours at the overtime rate of pay (cash or compensatory time at the employee’s option) computed from when the employee actually begins work. After two (2) hours of work in each such call back instance, the employee shall be compensated at the appropriate rate of pay for time worked. Employees will be given the opportunity to provide input to management when notified that management is adjusting their work schedules within the same workweek for the purpose of leveling the workweek not to exceed forty (40) hours and avoid overtime liability. Such input does not abridge management’s right to adjust work schedules.
Section 4. The OSFM shall give reasonable notice of any overtime to be worked. Overtime worked will be subject to prior authorization. Prior authorization shall be granted on a case-by-case basis.
Section 5. An employee may accrue up to one hundred (100) hours of compensatory time off. At the discretion of the OSFM, accrual above one hundred (100) hours may be paid to the employee or, subject to operating requirements of the OSFM, scheduled off with mutual agreement of the supervisor and the employee, within thirty (30) days of the excess accrual or permitted to remain on the OSFM's official payroll records for a longer period of time and subject to immediate payoff.

HOURS OF WORK & OVERTIME. (Subject to implementation instructions, the following clauses will appear in all collective agreements replacing any provision related to the Work Week and Work Day, Rest Periods, Overtime Definitions, Missed Meal Breaks, Meal Allowance, Time Off Between Shifts, and Change of Schedule that existed in the Hospital’s expiring collective agreement:) The normal or standard work day shall be seven and one-half (7%) hours per day and the normal or standard full-time work week shall be an average of thirty-seven and one-half (37%) hours per week except in those hospitals where agreements already provide a normal or standard work day of less than seven and one-half hours and a normal or standard full-time work week of less than thirty-seven and one-half (37%) hours. (Those Hospitals with the lesser required hours shall reflect in the salary rates a pro-rata lesser amount compared with salaries for other Hospitals based on the ratio that the standard or normal hours work at the Hospital concerned are to thirty-seven and one-half (37%) hours and shall appropriately reflect such hours in this article.) Part-time employees shall be entitled to overtime pay at the rate of time and one-half their regular straight time hourly rate for all hours worked in excess of the normal or standard work day or in excess of the normal or standard full-time work week. The length of time over which the hours of work per week are to be averaged shall be determined locally and shall be set out in the Local Provisions Appendix. Where the Hospital and the Union agree, subject to the approval of the Ministry of Labour, other arrangements regarding hours of work may be entered into between parties on a local level with respect to tours beyond the normal or standard work day in accordancewith the provisions set out in Article of the collective agreement.
HOURS OF WORK & OVERTIME. 9.01 A regular work week shall consist of forty (40) hours worked between Monday and Saturday.
9.02 Employees shall be paid at the rate of one and one-half times (1 ½x) the regular rate for all hours worked beyond ten (10) hours per day or beyond forty (40) hours per week.
9.03 Employees shall not be required to work on Sundays. The Employer shall make every effort to accommodate the needs on any employee who notifies the Employer at the time of hire of the desire to observe an alternate regular day of rest.
9.04 There shall be two (2) paid coffee breaks of ten (10) minutes on each shift, one in the first half of the shift and one in the second half of the shift. Employees will be given a meal period of one half (½) hour per shift but such period shall not be considered as time worked. Employees shall be entitled to an additional paid coffee break for every four (4) hours worked beyond the second half of the shift.
9.05 The Employer will attempt to distribute overtime work as evenly as possible among employees who normally perform the work and who indicate they wish to work overtime.
9.06 When employees and their supervisor agree to modify the work schedule or to implement rotating shifts on a project, the Employer shall notify the Union Representative of the agreed upon project schedule. Any such project schedule shall include the provision to pay overtime rates of one and one-half times (1½x) an employee’s regular rate after forty (40) hours worked per week, regardless of the days of the week being worked.
9.07 The Employer will attempt to distribute night shift work as evenly as possible among employees who normally perform the work and who indicate they wish to work the night shift.

HOURS OF WORK & OVERTIME. 10.01 The regular work week for full-time employees shall normally consist of forty (40) hours consisting of five (5) days of eight (8) hours or four (4) days of ten (10) hours, from Sunday to Saturday. It is understood that the Company retains the right to establish various shift configurations not specifically provided for herein, provided that such shifts are in accordance with applicable legislation. It is understood that the implementation of such shifts shall not occur without prior discussion with the Union. Further, nothing herein shall be construed as a guarantee of daily or weekly hours to be worked or paid, unless specifically provided for.
(a) Starting and quitting times and the arrangements of shifts shall be determined by the Company.
(b) The Company shall provide an employee with a minimum of two (2) weeks notice, prior to moving such employee from one shift to another
(i. e. days to nights; days to afternoons etc.) or when an employee is moving to another location on a permanent basis.
(c) An employee’s scheduled starting time shall not be changed during the week in which he is working. For clarity a change in start time within the shift as defined in Article 20.01 (a) shall not trigger a job posting.
10.03 An employee who is scheduled to work, and who reports for work as scheduled and who completes his scheduled shift, shall be guaranteed his scheduled hours of work for that day or pay, at his regular rate of pay, in lieu of work. This provision shall not apply in the event of an act of God in which case the employee shall be guaranteed four (4) hours work or pay in lieu of work.
10.04 For the purpose of calculating the pay of an employee who works overtime and the pay of an employee who is late reporting for work, the hour shall be deemed to be divided into twelve (12) units of five (5) minutes each and the following shall apply: - no overtime shall be paid where less than five (5) minutes of overtime is worked and thereafter overtime shall be calculated and paid to the nearest full five (5) minutes of overtime worked; - when an employee is late reporting for work, he will be paid commencing with the fifth minute of the unit of five (5) minutes in which he reports.
