Existing Stores. All vacant positions in existing ▇▇▇▇▇▇▇▇▇=s conventional stores (except Clerk=s Helper, Janitor, Assistant Store Director and Store Director) will be posted in all Max Foods/Lucky stores within all Union geographical jurisdictions at least five (5) days prior to filling such position. Max Foods/Lucky employees hired prior to January 3, 1994 and Conversion Employees may apply for available job openings in an ▇▇▇▇▇▇▇▇▇=s store based upon attrition of ▇▇▇▇▇▇▇▇▇=s store employees. Such Max Foods/Lucky employees will be given a preference over non- ▇▇▇▇▇▇▇▇▇=s applicants for available jobs in the conventional stores based upon their attendance and disciplinary records, provided they have the skill and ability to perform the work required.
Existing Stores. For each Existing Store, a license fee in the amount designated on Exhibit “B” attached hereto and incorporated herein by reference or, for any Existing Store opened after RCT, a license fee determined pursuant to subsection ii below (“License Fees”).
Existing Stores. Seller and its Affiliates may continue to, and may authorize others to continue to, own and operate after the Effective Date all stores owned and operated by them on the Effective Date. Subject to the next sentence, after the Effective Date Seller and its Affiliates may open new stores, and authorize Authorized Stores, using store names used by Seller and its Affiliates on the Effective Date without restriction. After the Effective Date Seller and its Affiliates may not do any of the following: (A) in any MicroSA open, own, or operate any new store, or authorize in any MicroSA any new Authorized Store, that is (1) branded with any ▇▇▇▇ that includes “Kenmore,” “Craftsman,” or “DieHard,” or (2) a Sears Store; (B) open, own, or operate any new store, or authorize any new Authorized Store, that is substantially similar to one or more of the Sears Hometown Stores, Sears Home Appliance Showrooms, or Sears Outlet Stores formats existing on the Effective Date; or (C) open, own, or operate any new store, or authorize any new Authorized Store, that markets or sells, or authorizes (via a license agreement, operating agreement, or otherwise) any natural person, business entity, or non-entity business enterprise to market or sell, any item of Exclusive Merchandise at a store physically located in any Zip Code area with respect to which, and to the extent, Buyer or any Affiliate of Seller has agreed with the owner of an HTS Store to refrain from selling Exclusive Merchandise in the Zip Code area.
Existing Stores all Popeyes Famous Fried Chicken and Biscuit --------------- restaurants in existence and operated or managed by Investments or any subsidiary of Investments at any time prior to March 21, 1989.

  • Transporting Students 1. Employees shall not transport students except in accordance with School Board rules. The Board shall adopt a school board policy outlining the teacher’s and the Board’s responsibilities and liabilities. Said policy shall be included in all school handbooks beginning with the 2004-05 school year. 2.   • Television Equipment Recycling Program If this Contract is for the purchase or lease of covered television equipment, then Contractor certifies that it is compliance with Subchapter Z, Chapter 361 of the Texas Health and Safety Code related to the Television Equipment Recycling Program.

  • Existing Facilities Each of the Existing Facilities shall be repaid in full and terminated and all collateral security therefor shall be released, and the Administrative Agent shall have received pay-off letters in form and substance satisfactory to it evidencing such repayment, termination and release.
