EXTENDED LEAVES OF ABSENCE. A. Extended Leaves of Absence: As applicable, staff members employed during the 2015-16 school year will be “grandfathered” under the terms of the previous language. Provision has been made by the Board of Education for absence from duty of Professional Employees as follows: Health Leave Association Business Leave Parental Leave Military Leave Foreign Travel or Teaching - Academic Study Personal All requests for extended leaves of absence will be applied for and those approved shall be granted in writing. Professional Employees requesting reassignment upon completion of an extended leave of absence will be assigned to the first available position based upon their professional preparation, experience, and certification. Except for Association Business Leave and Military Leave, if a vacancy is not available by the beginning of the second year following the completion of the leave, the leave status ends and the Professional Employee is terminated from the district. Part-time Professional Employees who go on Extended Leave of Absence should not expect to return to a position which would increase their contract time. A part-time Professional Employee returning from Extended Leave of Absence may be offered a position of greater contract time. B. The NEA SM will reimburse the district for all salary and benefits costs associated with the president's compensation. The Association agrees that the NEA SM president does not serve as an agent of the district while performing duties of the NEA SM president. Accordingly, the Association agrees to indemnify and hold the district harmless for any action of the NEA SM president while performing duties of the NEA SM president. Upon return from such leave, the NEA SM president will be assigned to the same position, if available, or, if not, to a substantially equivalent position. During the president's leave of absence, the president may agree to accept an additional assignment from the district. In that case, the district and the president shall agree (a) to the president's duties and responsibilities, (b) the terms and conditions of that assignment, and (c) an appropriate credit toward the NEA SM reimbursement for the president's salary and benefits. This leave does not include or guarantee any assignment in addition to, or independent of, the standard assignment or any extra-standard salary allotment therefor. 4. Every possible consideration and preference in assignment shall be accorded to persons returning to the schools from the Armed Services. 5. This leave applies only to persons who enter military service, and does not apply to persons who voluntarily seek employment in war industries or other governmental positions. 6. Professional Employees who are members of units of the National Guard or reserve forces of the United States and who are called to serve a mandated tour of duty for training or other service by proper authority pursuant to the laws of the United States or of the State of Kansas, shall be granted a leave of absence not to exceed fifteen (15) days during a contract period. Professional Employees called to serve will select those duty options which least interfere with the educational program of the District. Any tenured employee who experiences a disability arising out of but not limited to surgery, hospital confinement, medical treatment, pregnancy, childbirth, miscarriage, and/or recovery shall notify the Superintendent and receive disability leave upon presentation of documentation from a medical doctor.
1. The Board shall grant a disability leave for ninety (90) days immediately following the honorable discharge or separation certified period of the disability and this leave shall be charged to accumulated sick leave of said employee.

The Professional Employee will be reimbursed by time spent on said leaves, however, shall not count toward the District fulfillment of the time requirements for acquiring tenure. An employee shall not receive increment credit for time spent on unpaid leave granted pursuant to make up any difference between Section D, E, or F, of this ARTICLE, nor shall such time count toward the Professional Employee's base contract daily rate and fulfillment of the Professional Employee's military pay during this leave of absencetime requirements for acquiring tenure.

12-4 An administrator, while on approved leave, may continue to participate in the group health insurance plan at the administrator’s expense. Procedures set forth in the administrative regulations of the second year following the completion School District regarding subpoena must be followed in order to receive time off without loss of the leave, the leave status ends and the Professional Employee is terminated pay.
12-7 Return from the district. EXTENDED LEAVES OF ABSENCE. A. Extended Leaves Due to a medical disability which is substantiated by a certified medical or osteopathic doctor, an employee shall be granted an extended leave of Absence: As absence. However, during the leave the employee’s accumulated sick leave benefits shall be paid until such benefits are exhausted or the personal medical disability has terminated. Upon termination of medical benefits when applicable, staff members employed during the 2015-16 school year will be “grandfathered” under the terms of the previous language. Provision has been made employee may elect to retain said benefits by reimbursing the Board of Education for absence from duty of Professional Employees on a monthly basis, so as follows: Health Leave Association Business Leave Parental Leave Military Leave Foreign Travel to continue group rate premiums. B. The Board need not grant or Teaching - Academic Study Personal All requests for extended leaves extend the leave of absence will of any non- tenured employee beyond the end of the contract year in which the leave is obtained. An employee returning from a medical disability leave shall be applied entitled to all benefits to which said employee was entitled at the time leave commenced.
C. No employee shall be barred from returning to work after a medical disability leave on the grounds that not enough time has elapsed during the recovery time, unless competent medical evidence indicates otherwise.
D. Nothing herein contained shall be construed to require the Board to grant tenure to any non-tenured employee who would not have been granted tenure in the absence of this provision or to offer a new contract for and those approved a new school year to any non-tenured employee who would not have been offered such a contract in the absence of this provision.
E. An employee may make application to the Board for an infant child rearing leave of absence for a period of up to one year. Said application shall be made to the Superintendent at least ninety calendar days prior to the commencement of the child rearing leave. The date of requested return may be adjusted by the Board to commence in January or September or any other natural break in time which the Board deems in keeping with the educational needs cited above. Said child rearing leave shall be without pay. The Board of Education secretary shall, upon request, provide the employee with the necessary information in order that the employee can take over the payments of insurance premiums.
F. A leave of absence shall be granted in writing. Professional Employees requesting reassignment upon completion for the purpose of an extended leave of absence will be assigned to the first available position based upon their professional preparation, experience, and certification. a. In the event of pregnancy, the Professional Employee shall file a request for extended parental leave with the Human Resources Office at the beginning of the third trimester of pregnancy.
b. In the event of an adoption, the Professional Employee shall file written notice with Human Resources at the time the Professional Employee received notice from the adoption agency.
c. Such leave may commence at any time and will extend through the end of the current semester.
d. Upon written application, such leave may be extended for one semester. Exceptions to this policy will be governed by the requirements of the Family and Medical Leave Act.
E. Military Leave (extended)
1. Leave for military or alternate civilian service, as provided by law or in the regulations of the Selective Service System, will be granted, without pay or increment, to any Professional Employee who is inducted or enlists in active military or civilian services. This leave shall continue for the duration of the period of actual service and for ninety (90) days immediately following the honorable discharge or separation of the employee.
2. Within ninety (90) days following the honorable discharge, each person desiring reinstatement shall so notify the Board and shall furnish evidence of physical fitness and mental competence to do the kind of work the Professional Employee was doing at the time leave was granted, or such work as may be available.
3. This leave does not include or guarantee any assignment in addition to, or independent of, the standard assignment or any extra-standard salary allotment therefor.
4. Every possible consideration and preference in assignment shall be accorded to persons returning to the schools from the Armed Services.
5. This leave applies only to persons who enter military service, and does not apply to persons who voluntarily seek employment in war industries or other governmental positions.
6. Professional Employees who are members of units of the National Guard or reserve forces of the United States and who are called to serve a mandated tour of duty for training or other service by proper authority pursuant to the laws of the United States or of the State of Kansas, teachers shall be granted a leave of absence not without pay for up to exceed fifteen one (151) days during year to teach in an accredited college, university, or other private school while obtaining a contract period. Professional Employees called Master’s or a Doctor’s degree.
K. Military leave without pay shall be granted to serve will select those duty options which least interfere with the educational program any teacher who is inducted or enlists in any branch of the District. The Professional Employee will armed forces of the United States for a period of said service and three (3) months thereafter, or three (3) months after recovery of any wound or sickness at time of discharge.
L. Upon return from leave granted according to Section A above, an employee shall be reimbursed considered as if he/she were actively employed by the District to make up any difference between Board during the Professional Employee's base contract daily rate leave and shall be placed on the Professional Employee's military pay salary schedule at the level as he/she would have achieved if he/she had not been absent, provided, however, that time spent on such leaves shall not count toward fulfillment of time requirements for acquiring tenure. An employee shall not receive increment credit for time spent on leave granted under Sections E, F, G, and H above, nor shall such time count toward the fulfillment of time requirements for acquiring tenure. Leave granted under A, shall count toward increment if the employee worked during this that school year.
M. Advancement on the salary guide or raises the following year of the extended leaves of absence shall be based upon the date of commencement of the leave of absence. The employee will be granted a full salary guide step or raise if he/she works more than 90 days in that school year and is a ten (10) month employee. Working 90 days or less shall result in no advancement on the salary guide or raise the following year. Twelve (12) month employees shall be granted advancement on the guide if he/she works one hundred twenty days.
F. Foreign Travel N. All extensions or Teaching; Academic Study (extended)

3. An employee may request an unpaid leave of absence to prepare for an anticipated disabling event, which request must be submitted as soon as possible. Such unpaid leaves are subject to the provisions on unpaid personal leave as set forth below:
a) In the case of pregnancy, the employee, if she so desires, will be granted an unpaid leave to prepare for the birth of her child.
b) Employees whose expected date of onset of disability occurs during periods which would be disruptive to the continuity of the current semester. In cases where such notice is educational process and who do not availabletake unpaid personal leave prior to the disability, consideration will shall be made at the discretion subject to being transferred to alternative duty without loss of the Superintendent and/or their designee. At pay or benefits while so assigned until such time as the disability occurs.
4. The employee who anticipates a specific disabling event and who does not request unpaid leave of absence prior to the anticipated disabling event shall become entitled to applicable sick leave benefits. The Board may require certification of such disability.
5. Requests by employees for extension of sick leave benefits shall be governed by law under N.J.S.A. l8A: 30-6.
6. If the anticipated disabling event is childbirth, the Board shall presume that the pregnant employee becomes disabled for work four (4) weeks before the anticipated date of childbirth at which time the pregnant employee shall become eligible for sick leave benefits if she does not present a certificate attesting to her ability to work during said four (4) week period of time. This option is granted only to employees actively employed and not to those employees on unpaid personal leave. If, as a result of the pregnancy, the employee becomes disabled prior to this four (4) week period, said employee may use any sick leave benefits to which she is entitled, providing that the employee’s physician provides the Board with a certificate attesting to her inability to continue working, and the Board reserves the right to verify the employee’s inability to continue working.
7. The Board may require that an employee anticipating a disabling event may be placed on sick leave if the employee’s physical condition leads to unsatisfactory performance of assigned duties, and/or the continued performance of those duties impairs the employee’s health. Such incapacity must be established by the following:
a) The Board’s physician and the employee’s physician agree that the employee cannot continue working.
b) If there is a difference of medical opinion between the Board’s physician and the employee’s physician, then the two physicians shall agree in good faith on a third impartial physician, who shall examine the employee and whose medical opinion shall be conclusive and binding on the issue of physical capacity to continue working.
8. If the employee’s disability is caused by childbirth and such employee is diagnosed receiving disability/sick leave benefits, the employee is presumed to be disabled for a recuperative period of four (4) weeks following childbirth, during which time such employee shall continue to receive sick leave pay to which she is entitled under the sick leave policy. This applies only to those employed prior to childbirth and not to those employees who have been out on unpaid personal leave.
a) If as a result of pregnancy an employee continues to be disabled after this four (4) week period, said employee may use any sick leave benefits to which she is entitled providing that (1) the employee’s physician provides the Board with a certificate attesting to her inability to resume working, and (2) the Board reserves the right to verify the employee’s disability.
b) If the employee whose disability is caused by their medical advisor as able childbirth wishes to return to workher duties prior to the expiration of the recuperative period, she must present medical certification of fitness to the Board. The Board reserves the right to verify her medical certification.
c) If the Board’s physician and the employee’s physician disagree as to the employee’s fitness, then the two physicians shall agree in good faith on a third impartial physician who shall examine the employee may and whose medical opinion shall be returned to a position for which they are licensed, provided one is available, at conclusive and binding on the beginning issue of the subsequent semester or school year. Under no circumstances will an employee be entitled employee’s fitness to return to a positionher duties prior to the expiration of the recuperative period.
C. Association Business Leave 9. Upon termination of disability, an employee is no longer entitled to receive sick leave benefits for that particular disability. Unpaid personal leave for the purposes of recovery following disability may be requested and shall be subject to the provisions on unpaid personal leave, as set forth therein under Section B. below.
a) Requests by tenured employees for personal leave prior to childbirth, following childbirth and/or adoption shall be granted for the duration of the school year in which these events occur, plus one (extended)

b) Employees returning from disability/sick leaves of absence shall be governed by Sections D. 1 and D. 2 of this Article.
10. In no event shall the Board be obligated to extend a non-tenured employee’s unpaid leave of absence beyond the contract year for which the employee is employed.
11. If an employee on personal leave shall become pregnant before the expiration of her leave of absence, upon request, she shall be able to apply for a personal leave of absence for pregnancy. The same rules which apply to personal leaves for pregnancy shall apply to the new request for leave of absence for pregnancy.
12. If any employee who has been granted a leave of absence for up to two years without paypregnancy loses her baby by reason of miscarriage, for the purpose of engaging in activities of local, state, and national affiliates stillbirth or death of the Association. Upon return from such a leave, a Professional Employee will be assigned to infant before the same position, if available; or, if not, to a substantially equivalent position.

EXTENDED LEAVES OF ABSENCE. A. Extended Leaves ess otherwise indicated, the following conditions shall apply to extended leaves of Absenceabsence: As applicableRequests for leave shall be in writing. Part-time Professional Employees who go on Extended Leave of Absence should not expect to return to a position which would increase their contract time. A part-time Professional Employee returning from Extended Leave of Absence may be offered a position of greater contract timeaccordance with all applicable statutory requirements.
B. Health Leave (extended) Any Professional Employee, having served the district for a minimum of three years, or with approval from the Superintendent and/or their designee, whose personal illness or physical incapacity extends beyond accumulated Xxxx Leave will be granted leave of absence without pay or increment for the remainder of the current semester. Health leave may be extended for one additional semester with application, as appropriate and available, made no less than 30 days prior to the conclusion of the current semester. At such time as the employee is diagnosed by their medical advisor as able to return to work, the employee may be returned to a position for which they are licensed, provided one is available, at the beginning of the subsequent semester or school year. C. Association Business Leave (extended)
1. Professional Employees designated by the recognized employees' organization may, upon request, be granted a leave of absence for up to two years without pay, for the purpose of engaging in activities of local, state, and national affiliates of the Association. Upon return from such a leave, a Professional Employee will be assigned to the same position, if available; or, if not, to a substantially equivalent position.
2. The president of the NEA SM may, upon request, be granted a leave of absence for up to six years for the purposes of performing those duties. The district will annually issue an employment contract to the NEA SM president during the term of the president's service. Such president shall receive Experience Credit as outlined in Article XI (Contracts and Salaries) C. (Experience Credit), 2. (Present Employees), hereof. During the tenure of the NEA SM president, the provisions of Article VIII (Temporary Leaves of Absence) hereof shall not apply to said president, including the accumulation of temporary leave and the reporting of absences to the district. The NEA SM will reimburse the district for all salary and benefits costs associated with the president's compensation. The Association agrees that the NEA SM president does not serve as an agent of the district while performing duties of the NEA SM president. Accordingly, the Association agrees to indemnify and hold the district harmless for any action of the NEA SM president while performing duties of the NEA SM president. Upon return from such leave, the NEA SM president will be assigned to the same position, if available, or, if not, to a substantially equivalent position. During the president's leave of absence, the president may agree to accept an additional assignment from the district. In that case, the district and the president shall agree (a) to the president's duties and responsibilities, (b) the terms and conditions of that assignment, and (c) an appropriate credit toward the NEA SM reimbursement for the president's salary and benefits.
D. Parental Leave (extended)
1. A Professional Employee may be granted a leave of absence, without pay or increment, for the purpose of prenatal care, or for the purpose of childcare, upon the birth of or adoption of a child. Under special/appropriate circumstances, approved Parental Leave (extended) may be adjusted/discontinued with the approval of the Superintendent and/or their designee.
a. In the event of pregnancy, the Professional Employee shall file a request for extended parental leave with the Human Resources Office at the beginning of the third trimester of pregnancy.
b. In the event of an adoption, the Professional Employee shall file written notice with Human Resources at the time the Professional Employee received notice from the adoption agency.
c. Such leave may commence at any time and will extend through the end of the current semester.
d. Upon written application, such leave may be extended for one semester. Exceptions to this policy will be governed by the requirements of the Family and Medical Leave Act.
E. Military Leave (extended)
1. Leave for military or alternate civilian service, as provided by law or in the regulations of the Selective Service System, will be granted, without pay or increment, to any Professional Employee who is inducted or enlists in active military or civilian services. This leave shall continue for the duration of the period of actual service and for ninety (90) days immediately following the honorable discharge or separation of the employee.
2. Within ninety (90) days following the honorable discharge, each person desiring reinstatement shall so notify the Board and shall furnish evidence of physical fitness and mental competence to do the kind of work the Professional Employee was doing at the time leave was granted, or such work as may be available.
3. This leave does not include or guarantee any assignment in addition to, or independent of, the standard assignment or any extra-standard salary allotment therefor.
4. Every possible consideration and preference in assignment shall be accorded to persons returning to the schools from the Armed Services.
5. This leave applies only to persons who enter military service, and does not apply to persons who voluntarily seek employment in war industries or other governmental positions.
6. Professional Employees who are members of units of the National Guard or reserve forces of the United States and who are called to serve a mandated tour of duty for training or other service by proper authority pursuant to the laws of the United States or of the State of Kansas, shall be granted a leave of absence not to exceed fifteen (15) days during a contract period. Professional Employees called to serve will select those duty options which least interfere with the educational program of the District. The Professional Employee will be reimbursed by the District to make up any difference between the Professional Employee's base contract daily rate and the Professional Employee's military pay during this leave of absence.

Application for the additional leave should be submitted as soon as possible, and certification. Except for Association Business Leave and Military Leave, if a vacancy is not available by but no later than thirty (30) calendar days prior to the beginning of the second year following semester. The semester and the completion school term effective dates will be determined by the local calendar where the member is assigned.
E. Members shall return from an extended leave of absence at either the beginning of the first semester or the beginning of the second semester.
F. Extended leaves of absence will be without pay, and salary increments shall not accrue during a leave of absence, except in the case of sabbatical leave and involuntary military leave.
G. Accrued benefits earned at the time the leave begins shall be retained, but no additional benefits shall accrue during the period of the leave. Accrued benefits shall be defined to mean; tenure status, seniority as defined by Article 20.1, and placement on the salary schedule. Any tenured staff employed less than full-time shall accrue seniority on a pro-rata basis. Any member granted leave status ends who has completed one (1) semester or more of the school term shall receive a full year credit for purposes of advancement on the salary schedule. The semester and the Professional Employee school term effective dates will be determined by the calendar where the member is terminated from the district. Part-time Professional Employees who go on Extended Leave of Absence should not expect to return to a position which would increase their contract time. A part-time Professional Employee returning from Extended Leave of Absence may be offered a position of greater contract timeassigned.
B. Health Leave H. Members on extended leave shall, upon written request, be permitted to continue in the District's group insurance program, providing the member pays the premium, with the insurance company's approval, unless otherwise required by law.

EXTENDED LEAVES OF ABSENCE. A. Extended Military Leaves pursuant to applicable law.
B. Leaves of Absence: As applicable, staff members employed during the 2015-16 school year will absence without pay may be “grandfathered” under the terms of the previous language. The Board shall be the sole determiner of Education “good reason” on a case by case basis, as dictated by the educational needs of the district. C. H. Any employee who is granted a leave of absence without pay under this article shall not, by taking such leave, reduce or otherwise prejudice any vacation leave accrued and earned by said employee, unless said employee specifically requests a vacation with pay during said leave of absence.

If the Association member's former position is filled, the member will then be placed in an equivalent position. The parties understand and agree that during the period of any approved leave of absence, a member shall not accrue any benefits including but not limited to vacation, sick leave and personal days and that any accumulations will remain as they are licensed, provided one is available, were at the beginning of the subsequent semester or school year. Under no circumstances will an employee be entitled to return to a positionleave.
C. Association Business Leave (extended)
1. Professional Employees designated by the recognized employees' organization may, upon request, be granted a leave of absence for up to two years without pay, for the purpose of engaging in activities of local, state, and national affiliates of the Association. Upon return from such a leave, a Professional Employee will be assigned to the same position, if available; or, if not, to a substantially equivalent position.
2. The president of the NEA SM may, upon request, be granted a leave of absence for up to six years for the purposes of performing those duties. The district will annually issue an employment contract to the NEA SM president during the term of the president's service. Such president shall receive Experience Credit as outlined in Article XI (Contracts and Salaries) C. (Experience Credit), 2. (Present Employees), hereof. During the tenure of the NEA SM president, the provisions of Article VIII (Temporary Leaves of Absence) hereof shall not apply to said president, including the accumulation of temporary leave and the reporting of absences to the district. The NEA SM will reimburse the district for all salary and benefits costs associated with the president's compensation. The Association agrees that the NEA SM president does not serve as an agent of the district while performing duties of the NEA SM president. Accordingly, the Association agrees to indemnify and hold the district harmless for any action of the NEA SM president while performing duties of the NEA SM president. Upon return from such leave, the NEA SM president will be assigned to the same position, if available, or, if not, to a substantially equivalent position. During the president's leave of absence, the president may agree to accept an additional assignment from the district. In that case, the district and the president shall agree (a) to the president's duties and responsibilities, (b) the terms and conditions of that assignment, and (c) an appropriate credit toward the NEA SM reimbursement for the president's salary and benefits.
D. Parental Leave (extended)
1. A Professional Employee may be granted a leave of absence, without pay or increment, for the purpose of prenatal care, or for the purpose of childcare, upon the birth of or adoption of a child. Under special/appropriate circumstances, approved Parental Leave (extended) may be adjusted/discontinued with the approval of the Superintendent and/or their designee.
a. In the event of pregnancy, the Professional Employee shall file a request for extended parental leave with the Human Resources Office at the beginning of the third trimester of pregnancy.
b. In the event of an adoption, the Professional Employee shall file written notice with Human Resources at the time the Professional Employee received notice from the adoption agency.
c. Such leave may commence at any time and will extend through the end of the current semester.
d. Upon written application, such leave may be extended for one semester. Exceptions to this policy will be governed by the requirements of the Family and Medical Leave Act.
E. Military Leave (extended)
1. Leave for military or alternate civilian service, as provided by law or in the regulations of the Selective Service System, will be granted, without pay or increment, to any Professional Employee who is inducted or enlists in active military or civilian services. This leave shall continue for the duration of the period of actual service and for ninety (90) days immediately following the honorable discharge or separation of the employee.
2. Within ninety (90) days following the honorable discharge, each person desiring reinstatement shall so notify the Board and shall furnish evidence of physical fitness and mental competence to do the kind of work the Professional Employee was doing at the time leave was granted, or such work as may be available.
3. This leave does not include or guarantee any assignment in addition to, or independent of, the standard assignment or any extra-standard salary allotment therefor.
4. Every possible consideration and preference in assignment shall be accorded to persons returning to the schools from the Armed Services.
5. This leave applies only to persons who enter military service, and does not apply to persons who voluntarily seek employment in war industries or other governmental positions.
6. Professional Employees who are members of units of the National Guard or reserve forces of the United States and who are called to serve a mandated tour of duty for training or other service by proper authority pursuant to the laws of the United States or of the State of Kansas, shall be granted a leave of absence not to exceed fifteen (15) days during a contract period. Professional Employees called to serve will select those duty options which least interfere with the educational program of the District. The Professional Employee will be reimbursed by the District to make up any difference between the Professional Employee's base contract daily rate and the Professional Employee's military pay during this leave of absence.
