L16.06 Following the expiry of the agreed leave period, if that leave period is two (2) consecutive school years or less, the Teacher will less shall be returned to the same school and position occupied at the time the leave commenced, assuming such a position with still exists, unless the Board in the same school, subject teacher agrees to waive this right. 12-6 An administrator shall be provided time off without loss of pay when appearing in a court proceeding which requires the administrator to testify regarding a matter related to the administrator's duties. Procedures set forth in the administrative regulations of Page 15 of 75 between the Xxxxx County School District and the Xxxxx County Association of School Administrators and Professional Technical Employees the School District regarding subpoena must be followed in order to receive time off without loss of pay.
12-7 Return from Leave of Absence Procedure: Non School-Based Administrator The following procedure shall be adhered to with respect to the assignment of a non school-based administrator returning from a leave of absence not including Family Medical Leave or Military Leave. In Article 12-7, the term “administrator” refers to a non school-based administrator.
12-7-1 An administrator returning from leave of absence shall notify the School District prior to April of the agreed leave period, if that leave period is two (2) consecutive school years or less, year which precedes the Teacher will be returned school year in which he/she intends to a position with the Board in the same school, subject to the procedures of the Transfer and Surplus Policy. L16.06 Following the expiry of the agreed mailing address. If a leave period, if that leave period is two extends for more than one (21) consecutive school years or lessyear, the Teacher teacher will be returned to another position for which the teacher is qualified.
3. Benefits available to teachers on leaves of absence will vary based upon the nature of the leave being granted.
4. The teacher’s rights and status under the Teacher Employment Act will be continued during the extended leave period.
5. During any approved extended leave of absence, teacher status will not be affected, but if such leave is granted to exceed ninety (90) working days, the teacher will not be eligible for an evaluation level increase for that year.
6. A teacher on extended leave shall send written notification to the Office of Human Resources regarding their return to active service no later than February 1st or no less than thirty (30) days prior to the end of the leave if the leave dates do not correspond to the end of the school year. Due to special or unusual circumstances, a position teacher may file a "request for delay." A request for delay, if approved, allows a teacher an additional thirty (30) calendar days in which to make a decision. The request for delay will be judged on its own merit and must be filed with the Board in the same schoolOffice of Human Resources no later than February 1st, subject or thirty (30) days prior to the procedures end of the Transfer and Surplus Policy. EXTENDED LEAVES OF ABSENCE. L16.01 An Extended 10.01 Leave of Absence absence without pay for a period of a full School Year may be granted by The Hastings and Xxxxxx Xxxxxx District the School Board to a permanent Teacher upon written request by a Teacher, with the approval of the School.
L16.02 Seniority will accrue on 10.02 A Teacher who wishes to take a full-time basis leave of absence without pay shall apply in writing to all Teachers during the period School for leave of any absence giving reasons and details regarding the purpose of the proposed leave. L16.03 Leaves 10.04 Following the granting of a leave of absence, a Teacher must notify his School in writing of his intention to return to his position for the following School Year by no later than April lst. In the event that the School is not notified by April lst of the Teacher's plan to return, the School shall have no obligation to reinstate the Teacher at any time.
10.05 A Teacher on any leave of absence mandated by the Employment Standards Act 2000 shall receive credit for the period of such leave as if it was actual teaching time for purposes of advancement on the salary scale and allocation of Sick Leave Credits. A Teacher on any other kind of leave of absence will not have such time counted as actual teaching time for the purposes of advancement on the salary scale or for allocation of Sick Leave Credits. All Teachers returning from leave of absence shall be rescinded treated as if they had been actually teaching during such period of leave for the purpose of any other rights they have under this Agreement on their return.
10.06 The School shall grant a Teacher elected President of the Association a leave of absence without pay for up to three (3) years, if the Teacher's employment is terminated prior Teacher so requests. If requested by the Association, the School shall continue to the commencement pay Health and Welfare and Pension benefits on behalf of the Teacher during this leave due to Transfer & Surplus procedures.
L16.04 Applications for extended leaves of absence must be made in writing to provided that the Superintendent Association reimburses the School for such payments. The Teacher may request a further additional leave of Human Resources.
L16.05 Every effort should be made to apply absence by April 30 or November 1, and, if the School is not prepared to extend the leave of absence, the School shall advise the Association and Teacher no later than April 30 prior to the leaveexpiry of the leave of absence.
L16.05.01 The Superintendent 10.07 A Teacher who is on a medical leave of Human Resources absence during the School Year will consider approving two (2) year leaves when there keep the School apprised of their ongoing absence and/or ability to return to work on a regular basis, but not less than once every 2 weeks unless a longer period is documentation agreed upon by the school. Following the approval of a medical leave of absence, a Teacher, to support the extent possible, will provide the School with information from a treating physician with respect to the Teacher’s estimated return to teaching duties with or without the need for such a leave.
L16.06 Following the expiry of the agreed leave period, if that leave period is two (2) consecutive school years or less, the Teacher accommodation. This information will be returned to a position with the Board in the same school, subject provided to the procedures of the Transfer person designated to maintain and Surplus Policy. Following the expiry of the agreed leave period of beyond two (2) consecutive school years, the Teacher safeguard medical information and will be returned to a similar position with the Board within a secondary schoolkept confidential, subject except to the procedures of the Transfer and Surplus Policy. In no case will a leave under this Article be greater than three (3) consecutive school years.
L16.07 No salary will be paid by the Hastings and Xxxxxx Xxxxxx District School Board except where otherwise stated in the leave extent necessary to implement any accommodation plan.

Provided a substitute is required by the Hastings and Xxxxxx Xxxxxx District, such teacher agrees to reimburse the District School Board except where otherwise stated in the leave plandaily casual substitute rate for each day of such additional leave.
L16.08 All Board administered benefits become the responsibility of the Teacher except where otherwise stated in the leave plan.
08.01 Teachers may continue benefit coverage through the Board at their own cost. Payment for benefits is to be as mutually agreed by the Teacher and the Board.
