EXTENDED LEAVES OF ABSENCE. A. The employer agrees that one (1) teacher designated by the Association will, upon request, be granted a leave of absence, without pay, for the purpose of engaging in Association (local, state, or national) activities. In the event a teacher is on leave of absence for the purpose of serving as President of the Education Association of Plymouth and Xxxxxx, the following additional provisions shall apply: 1. The employer will issue the President's regular paycheck on a bi-weekly basis consistent with all other employees. 2. The EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of the President's salary according to Appendix A of the Collective Bargaining Agreement. 3. If the President is enrolled, the EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of ten (10) months premium payments (excluding August and September following President's term) in the existing health and life insurance plan. 4. Upon return from such leave, an employee will be considered as if he/she were actively employed by the Committee during the leave and will be placed on the salary schedule at the level he/she would have achieved if he/she had not been absent. B. Military leave and other statutorily provided leaves shall be in an unpaid status, limited to the period provided in the law, and subject to the same benefits as all other unit members who are in an unpaid leave status: except those benefits provided specifically by the law. Requests for such leaves are to be provided the School Department by written notice. In the case of military leave, employees are to submit copies of military orders before the beginning of the leave which verify, if possible, the return date. Leaves granted under this section are to meet notification requirements listed in section I of this Article. C. A leave of absence, without pay, of up to two (2) school years will be granted to any teacher with professional teacher status who joins the Peace Corps or serves as an exchange teacher, and is a full-time participant in either of such programs. Upon return from such leave, a teacher will be considered as if he were actively employed by the Committee during the leave and will be placed on the salary schedule at the level he would have achieved if he had not been absent. D. A leave of absence without pay or increment of up to one (1) year may be granted for the purpose of caring for a sick member of the teacher's immediate family. Such immediate family shall include the teacher's spouse, son, daughter, xxxx, brother, sister, parent, or legal guardian. Additional leave may be granted at the discretion of the employer. E. Any eligible member of the Bargaining Unit whose personal illness extends beyond the period of compensation may be granted sick leave without pay for personal health reasons. Requests for such leave will be supported by appropriate medical evidence. As a condition of continuing approval, the member granted such leave will submit periodic medical reports. In no case will such time, both paid and unpaid, extend beyond a total of two (2) school years. F. If approved, unpaid Family and Medical Leave Act leave requested for personal illness or family health care under Federal Law shall be concurrent and coterminous with other extended leaves provided herein, and shall not be granted as added time.

A leave of absence, absence without pay, pay of up to two (2) school years will be granted to any teacher with professional teacher status who joins the Peace Action Corps as a teacher or serves as an exchange teacher, or VISTA (Volunteers in Service to America), and is a full-time participant in either any of such these programs. Upon return from such leave, a teacher will be considered as if he were actively employed by the Committee during the leave and will be placed on the salary schedule at the level he would have achieved if he had not been absent. C. Military leave will be granted to any teacher who is inducted or enlists in any branch of the armed forces of the United States to fulfill a military obligation. Upon return from such leave, a teacher will be placed on the salary schedule at the level which he would have achieved had he remained actively employed in the system during the period of his compulsory absence as a result of such induction or enlistment. D. A leave of absence without pay or increment of up to one (1) year may will be granted for the purpose of caring for a sick member of the teacher's immediate family. Leaves under this section shall be requested in writing, and the applicant shall notify the school system at least 60 calendar days before the leave commences. These leaves shall run from September to June. Except in cases of medical reason for the leave, childrearing or unforeseen circumstances, applicants for leave under this section shall give at least 60 calendar days' notice before the leave commences. Teachers are encouraged to make the one year leave run from September through June, thus minimizing disruption in the classroom. These leaves shall not be covered in the limits stated in Article 21:02. 21.02.01 A bargaining unit member who becomes a parent by birth or adoption shall be eligible for a child-rearing leave in accordance with the following provisions: 1. The leave must commence upon receipt of the child or recovery from child-bearing disability. A unit member may access their accrued sick time for up to eight (8) weeks. 2. If the child is received or born before December 31 of the work year, the unit member may have an unpaid leave until the first work day of the next school year. 3. If the child is received or born after December 31 of the work year, the unit member may have an unpaid leave until the first work day of the next school year or the first work day of the next subsequent work year as requested by the unit member. 21.03 All benefits to which a unit member was entitled at the time a leave of absence commenced, including unused accumulated sick leave, will be restored upon return from leave. Teachers returning from leave shall be entitled to a position in the unit in accordance with the following provisions. 21.03.01 If a unit member returns from a leave of one year or less in duration, the member will be restored to the position left, if that position still exists. 21.03.01.01 If the position last held by the unit member is eliminated, the member will be treated as a member immediately displaced due to job elimination. 21.03.01.02 To be eligible for placement in accordance with 21.03.01, a member must serve at least one year's service between leaves of absence. 21.03.02 If a unit member returns from a leave at the commencement of the school year following the first anniversary of the commencement of leave, the member will be restored to the position left, if that position still exists. 21.03.02.01 If the position last held by the unit member is eliminated, the member will be treated as a member immediately displaced due to job elimination. 21.03.02.02 To be eligible for placement in accordance with 21.03.02, a member must serve at least one year's service between leaves of absence. 21.03.03 If a unit member returns from a leave at a time not covered in 21.03.01 or 21.03.02, the member will be assigned to a unit position which the member is qualified to hold. Every effort will be made to assign the member to a position substantially equivalent to the position held when the leave commenced. 21.04 All requests for extensions or renewals of leaves will be applied for and granted in writing. 21.05 Any time a teacher is recalled under the provisions of Article 10, that teacher shall not be granted an unpaid leave of absence for one year from date of the teacher's immediate family. Such immediate family shall include the teacher's spouse, son, daughter, xxxx, brother, sister, parent, or legal guardian. Additional leave may be granted at the discretion first day of the employer. Teachers taking leaves between the 1989 school year through and including the 1994 school year shall not have these leaves count in the two one-year leave limit. 21.07 The parties agree that for purposes of the Federal Family and Medical Leave Act (FMLA), the twelve work weeks of leave requested for personal illness or family health care under Federal Law shall during any twelve month period will be concurrent and coterminous with other measured by using a “rolling” twelve month period, measured backward from the date an employee uses any FMLA leave. 21.08 Any teacher on an extended leaves provided herein, and shall not be granted as added timeleave of absence must notify the Superintendent of his/her intent to return in writing by April 15.

EXTENDED LEAVES OF ABSENCE. A. The employer 1. All seniority rights and accumulated paid and sick leave accrued by the teacher prior to going on extended leave shall be restored upon that teacher’s return. 2. Only non-probationary teachers with four (4) years or more of service to District 11 are eligible for extended leaves of absence. Leaves for purposes of obtaining alternative gainful employment will not be approved. 3. Applicants for extended leaves of absence must provide a reason for the leave request for District approval no later than July 15, except for emergency leave requests. If a leave request is denied, the teacher may appeal the decision to the Executive Director of Human Resources. 4. A teacher returning from an extended leave of one (1) year or less shall be returned to the same school and position occupied at the time the leave commenced, assuming such a position still exists, unless the teacher agrees that to waive this right. A teacher returning from an extended leave lasting more than one (1) year shall be returned to an equivalent contractual position pursuant to the provisions of Article VIll. 5. Except as provided for in Paragraph 8.f below, extended leaves of absence are granted for a period not to exceed one (1) school year. No credit toward experience increments will occur during the leave and will be placed on period of the salary schedule at the level he would have achieved if he had not been absent. D. A leave of absence without pay or increment of leave. Duration is for up to one (1) year year, and it may be granted for the purpose of caring for renewed once. All eligible teachers may elect alternatively or as a sick member part of the teacher's immediate familyleave provided for herein to take leave as provided under FMLA and the District’s policies implementing FMLA. The leave described in this paragraph shall specifically be available to a teacher who gives birth or whose spouse gives birth. C. Except as provided in Article XVII, B with respect to the application of sick leave days to periods of pregnancy-related disability, maternity leave without pay or increment will be granted to a teacher upon request. The leave shall be for the remainder of the school year in which she commences said leave unless the teacher elects to return in eight (8) weeks or less. In the event that the maternity leave commences on or after March 1st in a school year, then the leave shall be either for eight (8) weeks or less if he had the teacher so elects, or for the remainder of that school year or, if so requested, for the following school year as well. Teachers who do not been absentreturn to work upon the expiration of their maternity leave shall be terminated. Requests to return to work prior to the expiration of said leave by teachers shall be subject to the discretion of the Committee except in the case of teachers electing to return in eight (8) weeks or less. A teacher whose maternity leave commences on or after March 1st in a school year and who does not elect to return to work within the eight (8) weeks shall notify the Superintendent by March 15 whether she intends to return to work at the start of the next school year or at the start of the second school year thereafter. All teachers on maternity leave shall notify the Superintendent in writing on or before March 15 prior to their return of their intent to return to work at the start of the next school year. Should any teacher on maternity leave fail to provide such notification, the Superintendent shall inquire of her in writing, with a copy of the letter being sent to the Association, whether she intends to return to work at the expiration of her maternity leave; if she fails to respond affirmatively to any such request within two (2) weeks after her receipt of the said letter from the Superintendent, she shall be deemed to have terminated her employment. In the event that a pregnant teacher gives birth to a child prior to the requested date of the maternity leave, it is agreed that, barring complications as certified by medical record, the maternity leave will commence as of the date of the birth. It is further agreed that all provisions of Section C which pertain to maternity leave will also apply to adoption proceedings. D. A leave of absence without pay or increment of up to one (1) year may will be granted for the purpose of caring for a sick member of the teacher's ’s immediate family. Such immediate family shall include the teacher's spouse, son, daughter, xxxx, brother, sister, parent, or legal guardian. Additional leave may be granted at the discretion of the employerCommittee. Regularly appointed teachers who are elected or appointed to full-time positions with BEA, MTA or NEA shall be granted leaves of absence without pay for the purpose of accepting these positions. Any teacher with Professional Teacher Status who requests a leave of absence for either one (1) or two (2) years for the purpose of exploring an alternative career or field of employment shall be granted as added timea leave of absence for that purpose. Any such leave shall be requested under normal conditions prior to May 15th and shall be subject to the following conditions: 1. Alternative employment leave cannot be used for teaching in another public school system in Massachusetts. 2. The teacher must notify the Superintendent in writing on or before March 15 immediately prior to the expiration of the leave whether or not he/she intends to return to work at the start of the next school year. Should any teacher on alternative employment leave fail to provide such notification, the Superintendent shall inquire of him/her in writing, with a copy of the letter being sent to the Association, whether he/she intends to return to work at the expiration of the leave; if he/she fails to respond affirmatively to any such request within two (2) weeks after his/her receipt of the said letter from the Superintendent, he/she shall be deemed to have terminated his/her employment. 3. All rights and benefits, including accrued seniority, acquired by a teacher prior to the leave will be restored to the teacher upon return from said leave. 4. The fact that a teacher has applied for or is already on an alternative employment leave will not be a factor in determining whether that teacher should be laid off in a reduction in force pursuant to Article XLI. However, any such teacher who is laid off will be eligible for all of the recall and other rights granted to laid off teachers under that Article. J. Other leaves of absence without pay may be granted by the Committee. 1. All benefits to which a teacher was entitled at the time his/her leave of absence commenced, including unused accumulated sick leave, will be restored to him/her upon his/ her return. 2. Upon his/her return from a leave of absence taken pursuant to Section B, D, F, and/or H above, a teacher will be assigned to the same position which he/she held at the time said leave commenced, if available, or if not, to a substantially equivalent position. Upon his/her return from a leave of absence taken pursuant to Sections A, C, E, G and/or I above, a teacher will be assigned to the most nearly equivalent position which is available at the time of his/her return and for which he/she is qualified. In regard to a leave taken pursuant to Sections A, C, E, G and/or I, it is recognized that the Committee may fill the position in question at the time said leave commences. K. All requests for extensions or renewals of leaves will be applied for and granted in writing.

The employer agrees that one (1) teacher designated by the Association will, upon request, be granted a leave of absence, without pay, for the purpose of engaging in Association (local, state, or national) activities. In the event All benefits to which a teacher is on was entitled at the time the teacher's leave of absence for the purpose of serving as President of the Education Association of Plymouth and Xxxxxxcommenced, the following additional provisions shall apply: 1. The employer will issue the President's regular paycheck on a bi-weekly basis consistent with all other employees. 2. The EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of the President's salary according to Appendix A of the Collective Bargaining Agreement. 3. If the President is enrolled, the EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of ten (10) months premium payments (excluding August and September following President's term) in the existing health and life insurance plan. 4. Upon return from such including unused accumulated sick leave, an employee will be considered as if he/she were actively employed by the Committee during the leave and restored to that teacher. Further, that teacher will be placed on assigned to the salary schedule same position held at the time said leave commenced, if available, or if not, to a substantially equivalent position; i.e., primary (K-3); intermediate (4-6); junior high (7 & 8); or senior high (9-12) and to teach the curriculum of that level he/she would have achieved and/or designated subject(s) within a department. In any event, teachers who qualify to teach outside their previous position by virtue of their teaching credentials may teach in another level or department if he/she had not been absentit is mutually agreeable to the individual teacher and the Board. B. Military leave and other statutorily provided leaves shall be in an unpaid status, limited to the period provided in the law, and subject to the same benefits as all other unit members who are in an unpaid leave status: except those benefits provided specifically by the law. Requests for such leaves are to be provided the School Department by written notice. In the case of military leave, employees are to submit copies of military orders before the beginning of the leave which verify, if possible, the return date. Leaves granted under this section are to meet notification requirements listed in section I of this Article. C. A leave of absence, without paypay or any other benefits, of up to two (2) school years will be granted to any teacher with professional teacher status who joins the Peace Corps Corps, VISTA, or serves as an exchange teacher, and is a full-time participant in either of such programsNational Teacher Corps. In the event the anticipated delivery date falls within the first month of a new school year, leave requested pursuant to this Section shall commence at the beginning of that new school year. Notwithstanding the provisions of the first sentence of this Section E.1., a teacher in her second year of employment with the Manchester School District may apply for a leave pursuant to this Section, but only if such leave is to commence during the third year of employment with said District. F. E. 2. Subject to the provisions of the first paragraph of this Section E.1. a teacher who is actually working during the school year and takes maternity leave for part of that year shall, if the leave commences no more than three (3) weeks before the anticipated delivery date, be eligible, pursuant to the provisions of Article Twenty, for unused accumulated sick leave, but (1) only to the extent that such teacher has any unused accumulated sick leave, and (2) only for the period of actual personal medical disability resulting from the pregnancy which prevents the teacher from performing teaching duties. To be eligible for sick leave under Article Twenty, a teacher must furnish to the Superintendent a certificate from a physician certifying to the dates of the period of such actual disability of the teacher and the specific nature of the medical disability resulting from the pregnancy. In the event that the maternity leave commences on or after March 1st in a school year, then the leave shall be either for eight (8) weeks or less if he had the teacher so elects, or for the remainder of that school year or, if so requested, for the following school year as well. Teachers who do not been absentreturn to work upon the expiration of their maternity leave shall be terminated. Requests to return to work prior to the expiration of said leave by teachers shall be subject to the discretion of the Committee except in the case of teachers electing to return in eight (8) weeks or less. A teacher whose maternity leave commences on or after March 1st in a school year and who does not elect to return to work within the eight (8) weeks shall notify the Superintendent by March 15 whether she intends to return to work at the start of the next school year or at the start of the second school year thereafter. All teachers on maternity leave shall notify the Superintendent in writing on or before March 15 prior to their return of their intent to return to work at the start of the next school year. Should any teacher on maternity leave fail to provide such notification, the Superintendent shall inquire of her in writing, with a copy of the letter being sent to the Association, whether she intends to return to work at the expiration of her maternity leave; if she fails to respond affirmatively to any such request within two (2) weeks after her receipt of the said letter from the Superintendent, she shall be deemed to have terminated her employment. In the event that a pregnant teacher gives birth to a child prior to the requested date of the maternity leave, it is agreed that, barring complications as certified by medical record, the maternity leave will commence as of the date of the birth. It is further agreed that all provisions of Section C which pertain to maternity leave will also apply to adoption proceedings. D. A leave of absence without pay or increment of up to one (1) year may will be granted for the purpose of caring for a sick member of the teacher's ’s immediate family. Any teacher with Professional Teacher Status who requests a leave of absence for either one (1) or two (2) years for the purpose of exploring an alternative career or field of employment shall be granted as added timea leave of absence for that purpose. Any such leave shall be requested under normal conditions prior to May 15th and shall be subject to the following conditions: 1. Alternative employment leave cannot be used for teaching in another public school system in Massachusetts. 2. The teacher must notify the Superintendent in writing on or before March 15 immediately prior to the expiration of the leave whether or not he/she intends to return to work at the start of the next school year. Should any teacher on alternative employment leave fail to provide such notification, the Superintendent shall inquire of him/her in writing, with a copy of the letter being sent to the Association, whether he/she intends to return to work at the expiration of the leave; if he/she fails to respond affirmatively to any such request within two (2) weeks after his/her receipt of the said letter from the Superintendent, he/she shall be deemed to have terminated his/her employment. 3. All rights and benefits, including accrued seniority, acquired by a teacher prior to the leave will be restored to the teacher upon return from said leave. 4. The fact that a teacher has applied for or is already on an alternative employment leave will not be a factor in determining whether that teacher should be laid off in a reduction in force pursuant to Article XLI. However, any such teacher who is laid off will be eligible for all of the recall and other rights granted to laid off teachers under that Article. J. Other leaves of absence without pay may be granted by the Committee. 1. E. A military leave of absence shall be granted to any teacher who shall be inducted or shall enlist in lieu of induction for military duty in any branch of the Armed Forces of the United States. Upon return from such leave for the duration of his or her induction or first enlistment, a teacher shall be placed at the same position on the salary schedule as he or she would have been had he or she taught in the District during such period. F. Paid sick leave shall apply to a disability incurred as a result of pregnancy or childbirth. Unless the teacher returns promptly upon termination of her disabling conditions, she may return from such leave only at such time as accords with the educational needs of the District as determined by the Superintendent, or upon any other mutually agreed date. 1. An unpaid leave of up to three years for child care purposes as described below shall be granted at the discretion request of the employerteacher following the birth or adoption of a child, providing that teacher has been employed by the District in a regular teaching capacity for at least two years. In the event the anticipated delivery date falls within the first month of a new school year, leave requested pursuant to this Section shall commence at the beginning of that new school year. Notwithstanding the provisions of the first sentence of this Section E.1., a teacher in her second year of employment with the Manchester School District may apply for a leave pursuant to this Section, but only if such leave is to commence during the third year of employment with said District. Subject to the provisions of the first paragraph of this Section E.1., a teacher who is actually working during the school year and takes maternity leave for part of that year shall, if the leave commences no more than three (3) weeks before the anticipated delivery date, be eligible, pursuant to the provisions of Article Twenty, for unused accumulated sick leave, but (1) only to the extent that such teacher has any unused accumulated sick leave, and (2) only for the period of actual personal illness medical disability resulting from the pregnancy which prevents the teacher from performing teaching duties. To be eligible for sick leave under Article Twenty, a teacher must furnish to the Superintendent a certificate from a physician certifying to the dates of the period of such actual disability of the teacher and the specific nature of the medical disability resulting from the pregnancy. If the Superintendent or the Superintendent's designated representative questions a physician's certificate or proof of a teacher's disability and/or inability to perform normal duties submitted pursuant to this Section, then, after the teacher has been absent from school for three (3) days or more on any one occasion, the teacher (or, at the option of the Superintendent, the teacher's documentation or medical record pertaining to the period of time and the specific medical disability resulting from the pregnancy) may be required to be examined by a physician other than the teacher's treating physician, which examination shall be paid for by the School District. Also, the Superintendent may, in his discretion, require certificates from the teacher's physician certifying to either (1) the pregnant teacher's ability to continue to work, or (2) the teacher's ability to return to work after such leave. If the Superintendent, after consultation with the teacher's Principal, questions either the period of actual disability, or the specific nature of the disability, the Superintendent may require the teacher to be examined by a physician other than the teacher's treating physician who is mutually acceptable to the teacher and the Superintendent. In the event the Superintendent determines, after obtaining such certificates and after consultation with the teacher's Principal, that the teacher is either not able to continue to work or is not able to return to work, said teacher shall commence a leave of absence or continue same. E. 3. A leave of absence taken pursuant to this Section E. shall not extend longer than twenty-four (24) months from the time said leave commences. Requests for disability as certified to by a physician, said teacher shall not return to work until the beginning of the marking period immediately following the end of such disability, provided, however, that if the teacher desires such leave to extend beyond said marking period, said teacher shall not return to work until the beginning of the next school year. Upon return, a teacher shall be assigned to the same position which she held at the time the leave commenced, if available, or if not, to a substantially equivalent position, as defined in Section A. of this Article, provided, however, that upon return from such leave, a teacher will be supported by appropriate medical evidence. Absent such timely reimbursements from either the MTA or NEA, the teacher’s leave shall be concurrent and coterminous nevertheless be allowed but shall be without pay. (b) In the event of death of the object child of leave, the leave of absence may be terminated upon mutual agreement between the teacher and the Board. (c) The granting of such leave will in no way interrupt seniority.
