EXTENDED LEAVES OF ABSENCE. A. The Committee agrees that up to two (2) teachers designated by the Association may, upon individual request to the Committee, be granted a leave of absence for up to four (4) years without pay for the purpose of serving as an elected officer in a local, state, or the National Education Association. The exercise of this discretion will be reasonable. Upon return from such leave, a teacher will be considered as if they were actively employed by the Committee during the leave and will be placed on the salary schedule at the level they would have achieved if they had not been absent. An employee may be granted only one such leave during their lifetime. B. A leave of absence without pay of up to two (2) years will be granted to any teacher who serves as full time exchange teacher, and is a full-time participant in either of such programs. Upon return from such leave, a teacher will be considered as if they were actively employed by the Committee during the leave and will be placed on the salary schedule at the level they would have achieved if they had not been absent. C. Military leave will be granted to any teacher who is inducted or enlists in any branch of the armed forces of the United States. Upon return from such leave a teacher will be placed on the salary schedule at the level which they would have achieved had they remained actively employed in the system during the period of their absence up to a maximum of two (2) years. D. A leave of absence without pay or increment of up to one (1) year may be granted at the discretion of the Superintendent of Schools or their designee for the purpose of caring for a sick member of the teacher's immediate family. The exercise of such discretion will be reasonable. Additional leave may be granted at the sole discretion of the Superintendent of Schools or their designee. E. The Superintendent of Schools or their designee may grant a leave of absence without pay or increment to any teacher to campaign for or serve in a public office. The exercise of this discretion will be reasonable. F. After five (5) years continuous employment in the Framingham Public Schools a teacher may be granted a leave of absence without pay for up to one (1) year for health reasons. G. Any teacher whose personal illness extends beyond the period compensated will be granted a leave of absence without pay for such time as is necessary for complete recovery from such illness up to a maximum of two (2) calendar years from the last day for which pay was received. Should the teacher be re-employed at a future date, all benefits related to seniority and service will be restored after a year of satisfactory service. It is understood by the parties that re-employment will be as a teacher without professional status. H. Other leaves of absence without pay may be granted by the Superintendent of Schools or their designee. I. Seniority will be maintained but will not accrue during any leave granted by the Superintendent of Schools or their designee for the purpose of permitting a teacher to explore or pursue an alternate career. Requests for leaves for this purpose must be made by the March 1, preceding the school year for which the request is made. J. Seniority will be maintained and accrued during any leave granted in accordance with paragraphs X, X, X, X, X, X, X and H. K. All benefits to which a teacher was entitled at the time their leave of absence commenced, including unused accumulated sick leave, will be restored to them upon their return, and they will be assigned to the same position, or one substantially equivalent to the one held at the time the said leave commenced. L. All requests for extensions or renewals of leaves must be applied for in writing on or before March 1 of the year in which the leave expires. Decisions on these requests will be confirmed in writing.

EXTENDED LEAVES OF ABSENCE. A. The Committee agrees that up to two one (21) teachers teacher who has served for at least three (3) years in the Burrillville School Department and who is designated by the Association may, upon individual request to the Committeerequest, be granted a leave of absence for up to four one (41) years year without pay or increment for the purpose of serving as an elected officer engaging in a localassociation (Local, state, state or the National Education Associationnational) activities. The exercise leave may be initiated only within the period of this discretion agreement, and must normally be requested in writing by May 1st. 1. Such leave shall coincide with the school year as defined in Article XIII, Section A.2. 2. Upon return from such leave the teacher will be reasonableplaced on the appropriate step of the salary schedule. By May 1st of his/her leave year, the teacher must notify the Burrillville School Department in writing whether or not he/she will return. If such return notice is not submitted on time, the Committee has the right to refuse employment to the teacher taking leave under this Article. B. A one (1) or two (2) year leave of absence, without pay, may be granted to teachers who join the Peace Corps or VISTA to serve as exchange teachers and who are full- time participants in either of such programs and who have completed at least three (3) years of teaching service in the Burrillville School Department. By February 15 of the leave year, the teacher must submit written notification to the Superintendent concerning his/her intentions to return to the Burrillville School Department. Upon such return from such leave, a teacher will may be considered as if they he/she were actively employed by the Committee during the leave leave, and will be placed on the a salary schedule at the level they he/she would have achieved if they he/she had not been absenton leave. An employee must give the Superintendent at least 30 calendar days in advance written notice before the maternity/paternity/adoptive-parent leave is to begin, unless it is not practicable under the particular circumstances to do so, in which case notice must be given as soon as practicable. 2. An employee who initially notifies the Superintendent of an intent to take maternity/paternity/adoptive-parent leave of absence without pay less than two years may apply to the Superintendent for such time an extension. The granting of an extension is discretionary and not subject to the grievance and arbitration, except as provided under Section 8 below. 3. An employee on maternity/paternity/adoptive-parent leave accrues no paid sick leave or other benefits during the period of the leave. 4. An employee on maternity/paternity/adoptive-parent must give the Superintendent written notice of the employee's intention to return to school the following September by March 15 or within four weeks following the birth or adoption of the employee's child, whichever is necessary later. 5. On return from maternity/paternity/adoptive-parent leave, an employee returns to the step of the salary schedule on which the employee had been placed before the leave began except that an employee who works in a satisfactory manner for complete recovery from such illness up 100 school days or more during the school year is entitled to receive a step increase for that year. 6. At the end of maternity/paternity/adoptive-parent leave, an employee is entitled to be returned as soon as possible to the employee's former position or, if the former position is not available, to a maximum of two (2) calendar years from the last day position for which pay was receivedthe employee is qualified. Should If no position for which the teacher employee is qualified is available at the end of the leave period, the employee is entitled to the first available position for which the employee is qualified regardless of the two-year limitation. In no event must an employee be re-employed at returned in the midst of a future dateschool year. 7. An employee who is pregnant may use paid sick leave for a period not to exceed the period or periods of the employee's incapacity or eight weeks, all benefits related whichever is longer. No teacher shall be barred from returning to work after the birth of her child solely on the grounds that there has not been a time lapse between that birth and her desired date of return, provided she supplies a physician's certificate attesting to her ability to perform her teaching duties as requested by the Board. 5. No teacher shall be removed from her teaching duties during pregnancy, except based upon one of the following: a. That her teaching performance has noticeably declined; b. Any teacher whose personal illness extends beyond the period compensated will be granted a leave of absence without pay for such time as is necessary for complete recovery from such illness up to a maximum of two (2) calendar years from the last day for which pay was received. Should the teacher be re-employed at a future date, all benefits related to seniority and service will be restored after a year of satisfactory service. It is understood by the parties that re-employment will be as a teacher without professional status. H. Other leaves of absence without pay may be granted by the Superintendent of Schools or their designee. I. Seniority will be maintained but will not accrue during any leave granted by the Superintendent of Schools or their designee for the purpose of permitting a teacher to explore or pursue an alternate career. Requests for leaves for this purpose must be made by the March 1, preceding the school year for which the request is made. J. Seniority will be maintained and accrued during any leave granted in accordance with paragraphs X, X, X, X, X, X, X and H. K. All benefits or leave to which a teacher staff member was entitled at the time their of his or her leave of absence commenced, including unused accumulated sick leave, commenced will be restored to them him or her upon their his or her return, and they will be assigned to the same position, or one substantially equivalent to the one held at the time the said leave commenced. L. F. All requests for extensions or renewals of extended leaves must be applied for in writing on or before March 1 of the year in which the leave expires. Decisions on these requests will be confirmed in writing, and if granted, permission will be given in writing. G_This-ugreement-shall-not-be-construed-so-as-to-diminish-any-r-ightshhatthe----------- employees would be entitled to under the minimum standards set by the Family and Medical Leave Act (“FMLA”); nor shall the FMLA diminish any rights under this collective bargaining agreement.
