EXTENDED LEAVES OF ABSENCE. ‌ A. EXTENDED LEAVES OF ABSENCE. A. Except for extended leaves with salary and leaves involving creditable teaching or teaching-related experiences, the period of leave will not be counted as credit for salary advancement purposes. 6. An employee on extended leave shall notify the Superintendent of Schools in writing at least six (6) months in advance of the termination date of the approved leave regarding his/her intentions to resume his/her duties with the Xxxxxxxx School System. Failure to fulfill this obligation may be interpreted as an indication of the employee's intention not to resume his/her position at the end of the approved leave. Such notification may be made a part of the application for the leave if the leave is to be for less than a year. 7. Should the Superintendent of Schools become informed that the purposes and requirements of a leave are not being adequately fulfilled, he/she shall so advise the Board. The Board may terminate the leave as of the date of its violation and its decision shall be subject to the grievance procedure. 8. The Board reserves the right to require evidence of good health at the termination of such leavea leave as a condition of reinstatement to active duty. B. Acceptance of this type of leave obligates the employee to resume and to continue his/her service with the school system for a period at least equal to the period of leave, and in any event not less than for one (1) year at a timeschool year. All Administrators covered by this Agreement anticipating such a state of disability shall notify the Superintendent of the condition expected to result in disability as soon as the condition is known and shall submit to the Superintendent a certificate from his/her physician verifying the condition expected to result in disability and the physician’s prognosis as to the anticipated duration of such disability. If requesting a leave under this Article, the provisions administrator should submit a written request specifying the date on which the Administrator wishes to commence said leave and the date of this Article shall not be eligible for any payments with the exceptions of approved sabbatical payments under the Career Ladder, or of payments approved by return. B. A pregnant administrator may apply to the Board of Education for military leavea disability leave using accumulated sick days for a period of no more than thirty (30) calendar days before the anticipated date of birth and thirty (30) calendar days after the anticipated date of birth. Leaves Such leave must be documented by a physician’s letter. The approved disability leave may be extended because of unanticipated disability related to childbirth upon provision of a physician’s letter. C. The Board shall have the right to require any Administrator who has been on disability leave and who desires to return to his/her duties by a fixed date following recovery from disability to produce a certificate from his/her physician stating that he/she is capable of resuming duties. These provisions shall not be granted for deemed to impose upon the following reasons:Board any obligation to grant or extend a leave of absence of any non-tenured Administrator beyond the end of the contract school year in which the leave is originally granted.

Failure to fulfill this obligation may be interpreted as an indication of the employee's intention not to resume his/her position at the end of the approved leave. Such notification may be made a part of the application for the leave if the leave is to be for less than a year. 7. Should the Superintendent of Schools become informed that the purposes and requirements of a leave are not being adequately fulfilled, he/she shall so advise the Board. The Board may terminate the leave as of the date of its violation and its decision shall be subject to the grievance procedure. 8. The Board reserves the right to require evidence of good health at the termination of such leavea leave as a condition of reinstatement to active duty. B. EXTENDED LEAVES OF ABSENCE. ‌ A. Unit 8 members who have completed one year in the District Leave of absence without pay for a period of a full School Year may be granted leaves of absenceby the School to a permanent Teacher upon written request by a Teacher, upon the recommendation of the Superintendent and with the approval of the Board of Education, which shall be without loss of job statusSchool. All requests for leaves A Teacher who wishes to take a leave of absence without pay shall carry affirmation of intention of apply in writing to the applicant to return to an assignment in the District upon the termination of such leave. B. Unit 8 members shall submit a written application School for leave of absence giving reasons and details regarding the purpose of the proposed leave. The Teacher shall apply not later than April 15th for a leave beginning September After six (6) years of service, a Teacher may ask for a one (I) year leave of absence without pay for educational reasons upon written request to the Superintendent or DesigneePersonnel Committee of the School. If requested by the Association, the School shall continue to pay Health and Welfare and Pension benefits on behalf of the Teacher during this leave of absence provided that the Association reimburses the School for such payments. The Teacher may request a further additional leave of absence by April I,and, if the School is not prepared to extend the leave of absence, the School shall advise the Association and Teacher no later than April Each Teacher covered by the Collective Agreement will have a Sick Leave Credit Account which shall indicate the number of credits he or she has accumulated while employed by the School and the value of such credits. At the commencement of each School Year, there' shall be filed at least credited to each staff member's Sick Leave Credit Account, one and one-half (301 credits per month accumulative for the School Year, or fifteen (15) days prior credits. In the case of a staff member commencing work after commencement of the School Year, the number of credits granted to that persons' Sick Leave Account shall be in proportion to the effective date remaining full working months for the balance of the year. The School shall be responsible for keeping a record of accumulated Sick Leave Credits and, the value of such credits, and the years during which such credits were accumulated. The School shall also be responsible for keeping records of deductions from each Teachers' Sick Leave Account. At the start of each School Year, the School shall notify each Teacher of the number of accumulated Sick Leave Credits in his account, and the value of such credits. The value of each Sick Leave Credit shall be determined by dividing the number of periods or hours such Teacher is regularly paid per week during the year such credit was granted by the periods or hours of a full- time Teacher as defined in this Agreement. The resulting fraction shall be the value of each Sick Leave Credit accumulated in such year. For purpose of utilization of Sick Leave Credits to provide salary for a Teacher when sick, resort shall be had first to the Sick Leave Credits granted in that School Year. If more than the number of Sick Leave Credits as determined by Article are required in any School Year, resort shall be had to the most aged Sick Leave Credits contained in the Teachers' Sick Leave credit account. Such credits shall be used according to their respective values to the extent necessary fully to compensate for the absence in the current year. If a staff member uses the credits in his Sick Leave Account in full before the end of a given School Year, and leaves the employ of the School before the end of the School Year, a salary deduction shall be made for those days taken in excess of the one and one-half (1 days per School month of employment to which the Teacher was entitled. A staff member who has been on sick leave whenever possible. Members shall furnish whatever evidence which for more than five (5) consecutive working days may be required by the Superintendent School to submit to an examination by a mutually agreeable medical practitioner or Designee in support a dental practitioner at the expense of their request. C. Leaves the Ontario Hospital Insurance Plan In the case of recurrent illness, even if each absence by the Teacher is of less than three (3) days duration, the Teacher may be required to submit to an examination by a medical practitioner appointed by the School at the expense of the Ontario Hospital Insurance Plan and a waiver shall be granted signed by the staff member directing the medical practitioner to send a note to the School explaining the reason for a period of one (1) year at a timethe Teacher's absence. Where leaves are permitted for over one (1) yearIn each case, the member excess cost of the examination over and above the amount paid by or dental insurance shall inform be paid by the Superintendent School. A Teacher who is absent from to illness shall be paid, for each day of such absence, the basic salary to which he would have been entitled to receive for that day, to the extent of the credits in his account. Absence on the day before, or Designee the day after a holiday without a medical certificate, unless by mutual consent of the School, because of extenuating circumstances, shall be considered unauthorized, and shall apply to extended vacation at the beginning or at the end of any School break. Such unauthorized absences may be the subject of disciplinary action, in writing addition to loss of their intention pay. Upon retirement or death or the Teacher ceasing to return work at the School, having actually taught for the next school School for fifteen (15) or more years, and the Teacher having attained the age of fifty (50) (except in the case of death), a gratuity shall be paid to the Teacher or the Teacher's estate as set out in this Article. The gratuity shall be based upon two (2) days per year or their request for additional leave. D.
