Extended Warranty – Prior Poor Performance. In the event the District determines that the Developer or its contractor(s) have a record of prior poor performance, and that a one-year warranty is inadequate to protect the public health, safety and welfare, the District may require an extended warranty from the Developer, including additional Warranty Security in an amount acceptable to the District. The requirements of such an extended warranty and additional security will be memorialized in a signed addendum to this Agreement.
