Facsimile Documents. At the request of the Borrower, the Letter of Credit provides that Drawings thereunder may be presented to the Bank by, among other methods, facsimile. The Borrower acknowledges and assumes all risks relating to the use of such facsimile demands for payment and agrees that its obligations under this Agreement and the Related Documents shall remain absolute, unconditional and irrevocable as provided in Section 8.01 above if the Bank honors such conforming facsimile demands for payment.
Facsimile Documents. The parties hereto agree that documents transmitted by facsimile transmission shall be deemed to be written instruments, and shall be binding on the parties executing and delivering such documents.
Facsimile Documents. Facsimile documents that are transmitted by telecommunications and reproduced by electronic means, with electronically reproduced signatures, shall be legally effective and binding until such time as replaced by documents containing the original signatures, which shall be provided within a reasonable time.
Facsimile Documents. The parties agree to accept copies and facsimile documents of this Agreement and related exhibits and other documents as if such documents were the originals.
Facsimile Documents a. Facsimile document," as used in this solicitation, means any complete and properly executed document listed below in subparagraph b that is transmitted to and received at the City office specified in this solicitation via electronic equipment that communicates and reproduces both printed and handwritten material. Time of receipt as stamped by the receiving equipment shall be conclusive as to time of submission.
b. The following documents are authorized for transmittal via facsimile.
(1) Acknowledgment of any addendum to solicitation.
(2) Notification of Withdrawal of Bid.
c. Telephone number of receiving facsimile equipment: (000) 000-0000 or 000-0000
d. As a minimum, the facsimile document must be identified with the following information --
(1) Name, address, and telephone number of sender;
(2) Solicitation number;
(3) Date and time for receipt of bids; and
e. If the bidder chooses to transmit a facsimile document listed above in subparagraph b, the City will not be responsible for any failure attributable to the transmission or receipt of the facsimile document including, but not limited to, the following:
(1) Failure to transmit the document to the specified facsimile equipment;
(2) Receipt of garbled or incomplete document.
(3) Availability or condition of the receiving facsimile equipment.
(4) Incompatibility between the sending and receiving equipment.
(5) Delay in transmission or receipt of document.
(6) Failure of the bidder to properly identify the document.
(7) Security of document data.
f. The City reserves the right to reject any facsimile document based on the conditions of subparagraph e above. The apparent successful bidder shall promptly submit any complete original document, if requested to do so by the Procurement Services Office.
