FAMILY LAW ACT. If the Borrower is an individual and has a spouse as defined under the Family Law Act, R.S.N.L. 1990, c.F-2, as amended or replaced from time to time, the Borrower represents and warrants that at the time of granting this Mortgage: (a) none of the events, which under the Family Law Act entitles the Borrower’s spouse to an interest in the matrimonial home or in matrimonial assets, has occurred; and (b) the Borrower has disclosed to the Lender all beneficial interests of the Borrower’s spouse in the Lands. In the event that any of the representations and warranties in this section 20 are false, all monies secured by this Mortgage shall, at the option of the Lender, become immediately due and payable. The Borrower shall advise the Lender of any change or event affecting the spousal status of the Borrower or the right to occupy the Lands.
