Fee and Expense Award and Service Award a. Payment of Fee and Expense Award. Provided that no appeals have been filed, by no later than forty-five (45) calendar days after the entry by the Court of the Final Order and Judgment awarding the Fee and Expense Award and the Service Award and entering final judgment dismissing the Action with prejudice and on the merits as to Defendant, Defendant will pay by wire transfer to Plaintiff’s Counsel an amount equal to the Fee and Expense Award and the Service Award, as ordered by the Court pursuant to paragraph 3.1 below. If any appeals are filed, then Defendant will pay by wire transfer to Plaintiff’s Counsel an amount equal to the Fee and Expense Award and the Service Award, as ordered by the Court pursuant to paragraph 3.1 below, within thirty (30) calendar days following the Final Settlement Approval Date.
