FIREWORKS/LASER SHOWS AND FIELD LIGHTING. (a) Subject to the provisions of this section and Applicable Law, Keys Club may have fireworks and laser shows at the Stadium Complex. (b) No fireworks or laser show may commence after 10 p.m., Sunday through Thursday, or after 11 p.m. on Friday or Saturday. Regardless of the time of commencement, no fireworks or laser show may exceed thirty (30) minutes in duration. In addition, the field lights must be adjusted/turned down so that only half of the lights are on by 11:30 p.m. or one (1) hour after end of the Game or fireworks/laser show, whichever is later. Keys Club shall turn off all field lights by 1:00 a. m. or three (3) hours after end of Game or fireworks/laser show, whichever is later. (c) Keys Club shall provide a list of all fireworks or laser show days for the season to the City prior to the first home Game of the season. (d) The first time Keys Club leaves field lights on or commences a fireworks or laser show after the times specified in article 6(a)(7)(ii) above, the City shall provide Keys Club with a written warning. If, after receipt of the written warning, Keys Club again leaves lights on or commences fireworks or laser shows after the designated times, the City shall promptly notify Keys Club in writing of the offense. Within ten (10) days of Keys Club’s receipt of such notice, Keys Club shall pay to the City a fine of five hundred dollars ($500.00). For each subsequent offense, within ten (10) days of Keys Club’s receipt of notice by the City, Keys Club shall pay the City a fine equal to the sum of the amount of the preceding fine plus five hundred dollars ($500.00). The remedies provided for in this paragraph will be the City’s exclusive remedy in the event that Keys Club does not comply with the time restrictions for turning off field lights or commencing a fireworks or laser show. (e) Keys Club shall post a sign in a conspicuous location at the entrance to the Playing Field stating the hours at which fireworks and laser shows may be presented.
