Frivolous Complaints. Frivolous complaints have a detrimental effect on the spirit and intent of this policy and should be discouraged. Likewise, intentionally accusing someone of harassment knowing the accusation to be false is a serious matter and will be dealt with accordingly.

Frivolous Complaints. If the Sec- retary of Labor finds that a complaint under paragraph (1) is frivolous or has been brought in bad faith, the Secretary of Labor may award to the prevailing employer a rea- sonable attorney’s fee not exceeding $1,000.
Frivolous Complaints. The pursuit of frivolous allegations through this complaint procedure has a detrimental effect on the spirit and intent for which this policy was rightfully developed and is to be discouraged. Therefore, an employee has the right to claim and enforce their rights under this article without reprisal except in circumstances where the complaint is frivolous, vexatious or made in bad faith.

Any other matters of compensation are to be resolved in the meeting and conferring process, if not detailed in the MOU which results from such meeting and conferring process shall be deemed withdrawn until the meeting and conferring process is next opened for such discussion. No adjustment shall be retroactive for more than two (2) years from the date upon which the complaint was filed.
