Common use of Frozen Sick Leave Bank Clause in Contracts

Frozen Sick Leave Bank. Effective May 29th, 2004 all existing sick leave plans for Part-Time Employees will be terminated and the Part-Time Employees will no longer be entitled to accrue sick leave credits. As of May 29th, 2004, any existing sick leave credits for Part-Time Employees will be converted to a frozen, “sick leave bank” to the credit of the Part- Time Employees. The amount of a Part-Time Employee’s frozen sick leave bank will be calculated at the maximum payout provided under the collective agreement [i.e. five years’ service – 50%], regardless of the Part-Time Employee’s number of years of service. Where a Part-Time Employee has unused sick leave credits accumulated prior to September 1st, 1974, the amount of her/his frozen sick leave bank will be calculated in accordance with the collective agreement. Part-Time Employees will be entitled to a payout of their frozen sick leave bank on termination of their employment or in the case of death, to the Part-Time Employees’ estate. However, if at the time of termination of employment or death of the Part- Time Employee, the Part-Time Employee does not have the required number of years of service to be eligible for the maximum payout, the Part-Time Employee’s frozen sick leave bank will be recalculated in accordance with the collective agreement based on the Part-Time Employee’s actual years of service. Notwithstanding paragraph (a) and (b) above, Part-Time Employees may choose to use their frozen sick leave bank (as described in paragraph (a) above) until it is depleted, as paid sick time to be drawn on, in accordance with the terms and conditions of the collective agreement, during their period of employment with the Hospital. A list identifying the Part-Time Employees with a frozen sick leave bank along with the amount of the frozen sick leave bank will be signed off by both parties and appended to this letter of understanding.
