Sick Leave Plan. The benefits of the Company’s Sick Leave Plan shall be considered as part of this Agreement. However, it is recognized that its provisions are not an automatic right of an employee and the administration of this plan and all decisions regarding the appropriateness or degree of its application shall be vested solely in the Company. The Company’s Sick Leave Plan will provide that probationary and regular employees will commence with a credit of eight days at 100 percent (100%) and 15 days at 75 percent (75%) pay, payable from the first day of sickness. This credit will continue to be available until the employee attains his/her first annual accumulation date as a regular employee. At the time of this accumulation date and each subsequent accumulation date he/she will acquire additional credits of eight days at 100 percent (100%) pay and 15 days at 75 percent (75%) pay. The accumulation of credits will be subject to the provisions of the Company’s Sick Leave Plan. Regular part-time employees shall receive a pro-rated number of sick days. When a regular part-time employee is absent due to illness on a scheduled day of work, they shall be paid for the hours of work scheduled for that day provided sick leave credits are available. Normally employees will be expected to arrange routine medical or dental appointments during non-working hours. Where such appointments cannot be arranged during non-working hours and the employee can be released from his/her duties, then the time shall be charged against an employee's sick leave time except in the case of medical appointments of less than half a day where normal earnings will be maintained. Employees who are on sick leave for 30 days or more may be eligible to participate in a vocational rehabilitation program in accordance with the Company’s policy. All major medical absence forms will be completed for any absence of four (4) continuous days/shifts or more or when requested by management. The Company will compensate the employee for the cost associated with completing these forms up to a maximum of $30.00. Additionally, the company will compensate the employee for the full cost of all medical notes, medical forms or medical information required to support LTD or other Wellness programs. This provision applies to Doctor’s notes requested by Line Management as part of the administration of the sick leave plan. Sick Leave Plan. (a) A sick leave plan applying to Employees appointed prior to August 1, 1998, who were covered by the previous Collective Agreement between the College and the Nova Scotia Teachers Union shall continue to be provided in accordance with the provisions outlined clauses 33.2, 33.3, 33.4 (a), clauses 33.5 through 33.14 inclusive, and 33.27.
Sick Leave Plan. Sick Leave Benefits - as specified in the Corporation’s By-law Number 73-20-P. Permanent employees of the Corporation from the date of employment are entitled to one and one-half (1 1/2) day’s sick leave credits for each completed continuous month of service. An employee whose employment is terminated by death or retirement shall be entitled, on termination, to receive payment for his/her unused accumulated sick leave credits accumulated after April 1st, 1953 on the basis of his/her regular salary or wages at termination, to a maximum of one-half (1/2) year’s earnings at the rate in effect immediately prior to termination, subject to Article 24. An employee having not less than five (5) years’ service whose employment is terminated by resignation or dismissal shall be entitled, on termination, to receive payment for one-half (1/2) of his/her unused accumulated sick leave credits accumulated after April 1st, 1953, on the basis of his/her regular salary or other remuneration at termination, to a maximum of one-half (1/2) year’s earnings at the rate in effect prior to termination, subject to Article 24. Subject to the approval of City Council, an employee may elect to have the sick leave credits payable on termination, paid in installments, rather than in a lump sum. An employee on approved Leave of Absence in excess of thirty (30) calendar days shall not receive sick leave credits during the period of such leave.
Sick Leave Plan. ‌ (a) All regular full-time and regular part-time employees who work 20 hours per week or more, shall have the following sick leave plan for the duration of their employment at LifeLabs: Regular employees who have completed their probationary period shall receive 80% of lost wages (prorated for part-time employees) for all absences five days or less due to sickness or injury. Approved absences following five consecutive days off from work will be paid at 90% of lost wages (prorated for part-time employees) until an employee returns to work or transitions to long-term disability. The proration for part-time employees will be based on the average regular hours worked in a previous three month period. No employee shall receive sick leave pay for any period in excess of six months per incident. (b) If an employee has received sick leave with pay and has a legally enforceable claim to compensation or damages for earnings lost during the said period from any third party other than the employee's own insurer under a contract of insurance, the employee shall take all steps reasonably necessary to enforce the said claim. If the employee receives any payment on account of earnings as a result of such claim, the employee shall pay to the Employer so much of the said payment as relates to the sick leave pay received for the said period. The liability of the Employer to pay sick leave shall rank after ICBC or other third party. Employees shall make application to the Company sick plan first. However, it is understood that if a claim is denied by the insurance carrier, employees may make application to EI for sickness benefits. In order to facilitate the administration of this article, employees shall complete a wage recovery authorization form. If the form is not received in a reasonable time given all the circumstances, sick leave payments shall be stopped. (c) Employees in receipt of third party wage loss payments shall be entitled to all benefits and entitlements of the collective agreement as if they were on sick leave in accordance with current practice, i.e. health and welfare plans, pension contributions. (d) A sick leave period identified in Clause(a) shall run concurrent with any period the employee is in receipt of WCB wage replacement, ICBC weekly indemnity payments or other insurance wage replacement benefits.
Sick Leave Plan. A Sick Leave Plan based on the following shall apply to all employees: (1) No sick leave with pay shall be granted except after 6 months' continuous service with the Employer. (2) Sick leave of 10 working days shall be credited semi-annually on June 30th and December 31st commencing with the completion of the first 6 months of service at which date 10 working days' credit shall be given. (3) Sick leave entitlement at a given date shall be the accumulated credit at the last semi-annual date less any sick leave with pay taken subsequent to that date. Note: When sick credits are exhausted, no further credits are posted to the employee's record unless the employee returns to duty for at least 5 consecutive working days. (4) Sick leave for Regular Part-Time Employees after 6 months' service shall be in the same proportion as time worked. (5) When sick leave is earned for a period of less than 6 months, a month shall be equivalent to a credit of 1½ (one and one-half) days and no credit shall be given for a part of a month. (6) Earned Sick Leave may be accumulated to a maximum of 2088 hours. (7) A deduction shall be made from accumulated sick leave credit for all working days absent with pay due to illness except those resulting from an accident on the job for which the employee is covered by Workers' Compensation payments. However, deductions shall be made if the injury is not covered by the Workers' Compensation Board solely because time absent is less than the qualifying period. Note: See paragraph (b) of Gratuity Plan set forth in this Schedule for non-effect on gratuity benefits. (8) The initial accumulative net credit at the time of installation of the Sick Leave Plan shall be determined by a summarization of the attendance records for the 6 years immediately prior to the said date of installation. (9) Any employee requesting sick leave with pay may be required to produce a certificate from a duly qualified medical practitioner licensed to practice in the Province of British Columbia, certifying that such employee is unable to carry out the employee's duties due to illness. (10) Full sick leave credits will be given for absence in the following circumstances: (i) accident on job (Workers' Compensation case) except where a person is receiving a disability benefit pursuant to Schedule "E"; (i) leave with or without pay for reasons other than illness; (ii) suspension without pay.

(b) In addition, the Employer will provide employees with a sick leave plan that will pay employees 662/3% of their regular wages up to the Employment Insurance maximum, starting on the first day of injury or the fifth day of illness up to a maximum of 26 weeks. (c) Employees may deduct time from their sick bank for medical and dental appointments that cannot be scheduled outside of normal working hours.
