Sick Leave Donation a. A principal may assign unused accumulated sick leave days to the account of another principal for use by the other principal as and for sick leave for personal illness. b. The assignment shall take place upon 14 days notice to the district and shall be effective for use by the other principal only at such time as the principal’s sick leave is exhausted, disability insurance has not started, up to a maximum of 60 donated days per leave. c. Such assignment shall be subject to the applicable federal withholding and deductions.

Sick Leave Donation. 10.3.1 A worker may donate days of sick leave to individual District workers who, due to a serious health condition, have exhausted all accumulated sick leave. Donating workers must retain a sixty (60) day balance of sick leave after their donation. No worker may receive more than 40 days of donated leave per year. 10.3.1.1 A “serious health condition” is defined as an illness, injury, impairment or physical or mental condition which involves inpatient care in a hospital, hospice, or residential health care facility, or continuing treatment or continuing supervision by a health care provider as defined in 29 USC 825.114(a) and as certified by a worker’s physician or other qualified medical practitioner. 10.3.1.2 The Vice Chancellor of Human Resources and the Chief Stewards by mutual agreement will verify the certification for eligibility. If the certification from the worker’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District expense. The District may require additional medical opinions. 10.3.2 Donated leave must be in one-day increments (no less than 8 hours). Recipients of donated sick leave shall be solely responsible for any state and federal taxes on the donated time. Such taxes shall be withheld at the normal rate for the recipient worker. In the event that the state or federal governments rule that tax liability is due other than as taxed, the recipient shall be solely liable for such liabilities. 10.3.2.1 The donated sick leave may be used only when the worker has exhausted accumulated sick leave and either is not eligible for long- term disability or is eligible but has not begun to receive the long-term coverage. 10.3.2.2 The Vice Chancellor of Human Resources shall be notified of solicitation of donations. Solicitations of donations may be made by the individual or their representative(s). 10.3.2.3 Donation of sick leave shall be authorized by a signed pledge form prepared by and filed with the District Office of Human Resources. In the event several workers donate sick leave, the sick leave shall be used in the order in which the signed pledge forms are filed with Human Resources. 10.3.2.4 If the worker does not use all donated sick leave, the sick leave shall be returned to the donating worker(s).

Serious or long-term illness is not intended to include normal maternity leave and/or absence due to child birth. Bargaining unit members seeking donation of sick leave for complications due to pregnancy and/or childbirth must provide, if requested, detailed medical information in support of any sick leave donation request. c. Recuperation from elective surgeries or other elective procedures which could have otherwise reasonably been scheduled during school vacation periods will not qualify for sick leave donation. This section shall not apply to twelve (12) month employees. d. The initial determination of whether or not an illness or injury meets the requirements of this section will be made by the Superintendent/designee, which determination shall not be arbitrary or capricious. 2. No bargaining unit member may receive more than an aggregate of thirty (30) donated Sick Leave days in any one (1) school year. 3. The request for donation of sick leave days shall be initiated by a bargaining unit member on a form (Appendix D) furnished to the Treasurer and Local 1 President or designee. It is the responsibility of the Union to notify the bargaining unit of the request. 4. The donor shall submit the Sick Leave Donation Authorization Form (Appendix D) to the Treasurer and the Local 1 office in order to donate days. 5. Donated sick leave shall be added to the accumulated sick leave of the absent bargaining unit member and deducted from the donating bargaining unit member.
Sick Leave Donation. Any district employee may donate up to two (2) days of his/ her personal accumulated sick leave days or personal leave days per year to any other employee who has exhausted his/her accumulated days. Sick Leave Donation. 45.10.1 If an employee suffers a prolonged illness and uses up all of his or her sick leave credits, other employees may voluntarily donate a specific number of days from their accumulated sick leave credits for use by the ill employee. 45.10.2 Continuing employees or full-time term employees may each voluntarily donate up to a maximum of ten days sick leave for use by an ill continuing or full-time employee provided a minimum of twelve (12) days is retained each year for personal sick leave only. The total of all such donations shall not exceed ninety (90) days or the number of days required to cover the ill employee until he or she qualifies for coverage under the long term disability plan, whichever is the lesser of the two. 45.10.3 Part-time term employees may each voluntarily donate up to a maximum of five days sick leave for use by an ill part-time term employee. The total of all such donations shall not exceed forty-five (45) days. 45.10.4 All donations of sick leave credit shall be given in writing to OC prior to the expiration of the ill employee’s sick leave credit.
Sick Leave Donation. Any employee whose sick leave accumulation is forty-one (41) days or more may relinquish no more than one (1) sick day to a single employee annually whose sick leave has been exhausted. Sick Leave Donation. 1. The Board and the Union will activate a sick leave donation on an “as needed” basis. When the Sick Leave Donation Committee has awarded sick leave to a member, the Local President will present the District Treasurer with a list of names for the donation of sick leave days approved by the Sick Leave Donation Committee. The District Treasurer will be notified at least two (2) pay dates prior to being requested to pay additional sick leave to a member utilizing the sick leave donation. No more than twenty (20) days of sick leave may be awarded a member at any one (1) time, provided that a member may request a hearing for additional days.
