Sick Leave Donation. 10.3.1 A worker may donate days of sick leave to individual District workers who, due to a serious health condition, have exhausted all accumulated sick leave. Donating workers must retain a sixty (60) day balance of sick leave after their donation. No worker may receive more than 40 days of donated leave per year.
10.3.1.1 A “serious health condition” is defined as an illness, injury, impairment or physical or mental condition which involves inpatient care in a hospital, hospice, or residential health care facility, or continuing treatment or continuing supervision by a health care provider as defined in 29 USC 825.114(a) and as certified by a worker’s physician or other qualified medical practitioner.
10.3.1.2 The Vice Chancellor of Human Resources and the Chief Stewards by mutual agreement will verify the certification for eligibility. If the certification from the worker’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District expense. The District may require additional medical opinions.
10.3.2 Donated leave must be in one-day increments (no less than 8 hours). Recipients of donated sick leave shall be solely responsible for any state and federal taxes on the donated time. Such taxes shall be withheld at the normal rate for the recipient worker. In the event that the state or federal governments rule that tax liability is due other than as taxed, the recipient shall be solely liable for such liabilities.
10.3.2.1 The donated sick leave may be used only when the worker has exhausted accumulated sick leave and either is not eligible for long- term disability or is eligible but has not begun to receive the long-term coverage.
10.3.2.2 The Vice Chancellor of Human Resources shall be notified of solicitation of donations. Solicitations of donations may be made by the individual or his/her representative(s).
10.3.2.3 Donation of sick leave shall be authorized by a signed pledge form prepared by and filed with the District Office of Human Resources. In the event several workers donate sick leave, the sick leave shall be used in the order in which the signed pledge forms are filed with Human Resources.
10.3.2.4 If the worker does not use all donated sick leave, the sick leave shall be returned to the donating worker(s).
Sick Leave Donation. In accord with state law and Medical Center policy, RN’s may donate sick leave to any employee entitled to receive such donations.
Sick Leave Donation. Members of the bargaining unit are authorized to donate accrued sick leave to a person who is a school board employee. The recipient may not use the donated sick leave until all of his/her sick and annual leave has been depleted. The donated sick leave has no terminal pay value for any recipient. The provision shall not apply to paid or unpaid leave available in accordance with any sick leave pool, nor to any other form of leave. (Ratified 9/2013)
Sick Leave Donation. A. If a bargaining unit member or member of his/her immediate family (spouse, child or parent) has experienced a catastrophic illness or injury, the bargaining unit member may apply for a donation of sick leave from other bargaining unit members after he/she has exhausted all other paid leave for which he/she is eligible. For the purpose of this section “catastrophic illness or injury” shall include only those illnesses or injuries which are calamitous in nature, constituting a great misfortune.
B. A bargaining unit member may request donations more than once in any school year, but is limited to receiving a maximum of twenty (20) days per school year regardless of the number of requests.
C. Request for donated sick leave shall be made on the approved sick leave donation request form. (Appendix C-1)
D. An ad hoc sick leave donation review committee comprised of the Superintendent, Treasurer, and two (2) bargaining unit members selected by the Association President will review all requests for donations of sick leave and determine on a case-by-case basis whether the requesting bargaining unit member’s illness or injury meets the definition of catastrophic as defined in this section. If so, the committee will send out a notice to all bargaining unit members notifying them of the need for donated days. (Appendix C-2)
E. Bargaining unit members who have a minimum of thirty (30) accrued but unused sick leave days at the time the donation request is made, may donate up to two (2) days of sick leave per each request for donation, up to a maximum of four (4) donated days per school year. Bargaining unit members donating sick leave shall notify the ad hoc committee of their donation by submitting a donation form (Appendix C-3) to the committee.
F. The donation of sick leave days by bargaining unit members is strictly voluntary. The committee is not responsible to provide sick leave days if none are donated.
G. Neither the name of the bargaining unit member requesting the donation of sick leave days nor the names of the bargaining unit members donating sick leave days shall be disclosed to anyone other than the committee representatives or those member(s) of the Treasurer’s staff who administer the crediting and debiting of sick leave days pursuant to the donation procedure.
H. Donated sick leave days cannot be used beyond the school year in which the request is made or beyond the term of the contract under which the requesting employee is employed.

Sick Leave Donation. Any district employee may donate up to two (2) days of his/ her personal accumulated sick leave days or personal leave days per year to any other employee who has exhausted his/her accumulated days. This leave will be for serious personal illness or accident. An employee may donate to as many individual(s) as he /she wishes, as long as the recipient meets the qualifications of this provision.
Sick Leave Donation. 45.10.1 If an employee suffers a prolonged illness and uses up all of his or her sick leave credits, other employees may voluntarily donate a specific number of days from their accumulated sick leave credits for use by the ill employee.
45.10.2 Continuing employees or full-time term employees may each voluntarily donate up to a maximum of ten days sick leave for use by an ill continuing or full-time employee provided a minimum of twelve (12) days is retained each year for personal sick leave only. The total of all such donations shall not exceed ninety (90) days or the number of days required to cover the ill employee until he or she qualifies for coverage under the long term disability plan, whichever is the lesser of the two.
45.10.3 Part-time term employees may each voluntarily donate up to a maximum of five days sick leave for use by an ill part-time term employee. The total of all such donations shall not exceed forty-five (45) days.
45.10.4 All donations of sick leave credit shall be given in writing to OC prior to the expiration of the ill employee’s sick leave credit.
Sick Leave Donation. Any employee whose sick leave accumulation is forty-one (41) days or more may relinquish no more than one (1) sick day to a single employee annually whose sick leave has been exhausted. Any employee may donate a maximum of two (2) days per year. This donation may only occur if the employee with depleted sick leave is seriously ill or seriously injured and only after the seriously ill or seriously injured employee has been subject to a wage deduction for a minimum of seven (7) workdays. Should employees desire to donate, a written letter shall be submitted to the Superintendent of Schools or his/her designee by the union president requesting a meeting to review all aspects of the request. A committee consisting of the Superintendent of Schools or his/her designee and the union president shall meet to review the merits of the request.
Sick Leave Donation. 1. The Board and the Union will activate a sick leave donation on an “as needed” basis. When the Sick Leave Donation Committee has awarded sick leave to a member, the Local President will present the District Treasurer with a list of names for the donation of sick leave days approved by the Sick Leave Donation Committee. The District Treasurer will be notified at least two (2) pay dates prior to being requested to pay additional sick leave to a member utilizing the sick leave donation. No more than twenty (20) days of sick leave may be awarded a member at any one (1) time, provided that a member may request a hearing for additional days.
Sick Leave Donation. Emergency, sick and/or bereavement leave will be 10 days per year cumulative to 83 days (this includes 3 personal days).
1. Teachers in USD 210 shall be allowed to transfer leave days to any employee who, due to illness or accident, has used all of his/her leave sick and personal leave days. No teacher will be able to use more than 83 days of his/her sick and discretionary leave days. The maximum an employee can donate per school year is ½ their accumulated sick leave available the first day of the contract year. The building administrator of the employee receiving the leave has the discretion to decline leave transfer if a pattern of abuse has been established by the recipient employee.
2. Donated days may be banked during the school year. Banked days that are unused will revert back to the donating employee at the end of the school year.
Sick Leave Donation a) If an employee is in danger of having used all accrued time (vacation, sick, etc.) due to a serious illness or injury, as defined by the FMLA, Officers may voluntarily donate up to forty (40) hours of vacation or sick leave to the ill or injured employee to avoid loss of pay. No Officer shall be permitted to bank more than four hundred (400) hours of such donated leave within any twelve (12) month period of time. Donated leave may only be used for the employee to whom donated. In the event that all of the donated leave time is not used, the City shall not be obligated to make any redistribution of banked hours to the donors. The remaining unused donated amount shall not be paid on separation.
b) For purposes of Section 2 of this Article, “employee” shall mean any City of Austin employee except a Chapter 143 civil service employee of the Fire Department or the EMS Department.
