Gender Selection Clause Samples
The Gender Selection clause establishes the terms under which parties may choose or specify the gender of a child in the context of reproductive or fertility agreements. Typically, this clause outlines the methods permitted for gender selection, such as pre-implantation genetic diagnosis, and may set forth any legal, ethical, or medical limitations that apply. Its core practical function is to provide clear guidelines and boundaries for gender selection, ensuring that all parties understand their rights and obligations while addressing potential ethical or legal concerns.
Gender Selection. ▇▇▇▇▇▇ encourages applicants wherever possible to remain open to the referral of a boy or a girl. The Agency believes that families who remain open as to the gender of their child are best able to accept the varied uncertainties that come with adoption and parenting, including any individual needs of their child. In some instances, ▇▇▇▇▇▇ permits applicants to express gender preferences, as for example when such expression is allowed by the Sending Country and/or when such requests do not pose unreasonable delays to other applicants or to children waiting to be adopted.

The Agency believes that families who remain open as to the gender of their child are best able to accept the varied uncertainties that come with adoption and parenting, including any individual needs of their child. In some instances, ▇▇▇▇▇▇ permits applicants to express gender preferences e.g. in intercountry adoption when such preferences are allowed by the Sending Country or in domestic adoption cases where it is allowed by an identified placing agency. Generally, gender selection is allowed in our older child ▇▇▇▇▇▇ adoption program (Project Wait No Longer), although prospective parents in this program are also encouraged to remain open whenever possible. It is the responsibility of any prospective adoptive parent who wishes to select the gender of their child to verify available program options prior to application.
