Grace Periods; Notice and Cure. Upon the occurrence of an Event of Default by any Party, such Party shall, upon written notice from a non-defaulting Party, proceed immediately to cure or remedy such Default and, in any event, such Default shall be cured within thirty (30) days (or twenty (20) days in the event of a monetary default) after receipt of such notice, or, if such Default is of a nature that is not capable of being cured within thirty (30) days shall be commenced within such period and diligently pursued to completion, such total cure period not to exceed ninety (90) days after transmission of such written notice of default.

Grace Periods; Notice and Cure. Upon the occurrence of an Event of Non-Performance by any Party, such Party shall, upon written notice from the other Party, proceed immediately to cure or remedy such Non-Performance and, in any event, such Non- Performance shall be cured within thirty (30) days (or ninety (90) days if the Non-Performance relates to the date for Completion of Construction) after receipt of such notice, or, if such Non- Performance is of a nature that is not capable of being cured within thirty (30) days (or ninety (90) days if the Non-Performance relates to the date for Completion of Construction) shall be commenced within such period and diligently pursued to completion. The foregoing cure periods are subject to the specific provisions of Section 12.4(a)(ii) which grant a cure period of one hundred eighty (180) days for the consequences specified in Section 12.4(a)(i).

  • Notice and Cure Period In the event of a breach, the aggrieved Party shall give written notice of breach to the other Party. If the notified Party does not cure the breach, at its sole expense, within 30 days after the delivery of written notice, the Party may exercise any of the remedies as described in §14 for that Party.
