Grant of Exclusive Agreement. City hereby grants to Contractor, on the terms and 475 conditions set forth herein, the exclusive right and privilege to collect, remove and dispose of, in a lawful 476 manner, Garbage and Organic Waste accumulating in the City’s Service Area that are required to be 477 accumulated and offered for collection to the Contractor in accordance with the City’s Municipal Code, for 478 the Term of and within the scope set forth in this Agreement.
Grant of Exclusive Agreement. Subject only to the express exceptions in Section 24 3.02 of this Agreement, and for the Term of this Agreement as it currently exists and may be 25 extended, the CONTRACTOR is hereby granted an exclusive franchise and contract pursuant 26 to section 8.24.040 of the City of Benicia Municipal Code for the collection, transportation, 27 processing, recycling and disposal of all Garbage generated in the City of Benicia, subject only 28 to the exceptions contained in Benicia Municipal Code section 8.24.050. Without limitation of 29 the foregoing, CONTRACTOR’S exclusive franchise and contract covers and includes all 30 Garbage as defined in section 8.24.010 (9) of the Municipal Code, and includes without 31 limitation all Recyclables, Green Waste/Organic Waste, Industrial Waste, Refinery Waste, 32 Mixed Waste and Construction and Demolition Debris as defined in Municipal Code section 33 8.24.010 (3) and (7).
Grant of Exclusive Agreement. 3 CONTRACTOR is hereby granted an exclusive agreement to provide SFD 4 Recycling Collection Services at all Service Units within the Service Districts. No other 5 services, including Roll-Off Collection Service, shall be exclusive to CONTRACTOR.

Except as otherwise provided in this 8 Agreement, CONTRACTOR is hereby granted an exclusive agreement to provide SFD 9 Recycling Services at all Service Units within the Service Districts. No other services, 10 including Roll-Off Collection Services, shall be exclusive to CONTRACTOR.

No other services, including Roll-Off Collection 6 Services, shall be exclusive to CONTRACTOR.
Grant of Exclusive Agreement. Except as otherwise provided in this Agreement, 309 the CONTRACTOR is herein granted an exclusive Agreement to provide Collection Services to 310 each Residential Service Unit within the Service Area. No other services shall be exclusive to 311 the CONTRACTOR.

CONTRACTOR is hereby granted an exclusive agreement to provide SFD Collection Service at all Service Units within the SFD Service District, MFD Collection Service in MFD Service Districts, and City Facility Collection Service. No other services, including Roll-Off Collection Services, shall be exclusive to CONTRACTOR.
