Common use of Health and Safety Grievance Clause in Contracts

Health and Safety Grievance. Step 3 a. If the grievant is not satisfied with the decision rendered pursuant to Step 2, the grievant may appeal the decision in writing, within five (5) calendar days, after receipt of the decision to the CalHR as the third level of appeal. The Union shall concurrently send a copy of the appeal to the affected department(s). b. The Director of the CalHR or designee shall respond to the grievance in writing within fourteen (14) calendar days. c. If the grievance is not resolved at Step 3 within twenty-four (24) hours after receipt of the third step response, the Union shall have the right to submit the grievance to arbitration. d. The arbitration shall take place no later than fourteen (14) days following the Union’s request unless the parties mutually agree otherwise. e. Arbitration shall be in accordance with section 6.11(B) of this article unless otherwise provided.
