Health and Safety Regulations. Section 1. The Employer agrees to abide by and maintain in its facilities and work operations standards of safety and health in accordance with the Oregon Safe Employment Act (ORS 654.001 to 654.295 and 654.991). Section 2. Employees may refuse to operate any equipment or ride in or on any vehicle they believe is unsafe until the equipment has been mutually inspected and/or corrected by the employee and his/her immediate supervisor and/or qualified person. If after such inspection the equipment is determined by the supervisor and/or other qualified person to be safe, the employee may not refuse to operate the equipment. Employees shall report to their supervisor all other unsafe conditions when the employee knows of such conditions. Section 3. Employees shall not be disciplined for refusal to operate believed unsafe equipment nor shall refusal to operate such equipment be construed as insubordination until Section 2 has been complied with unless an emergency situation exists. Section 4. The Employer shall provide or shall pay the cost of CPR training and first aid training for all bargaining unit employees.
