Common use of Humanitarian Clause Clause in Contracts

Humanitarian Clause. Section 1. Should an employee covered by this Agreement become physically or mentally handicapped to the extent the employee cannot perform their regular job, Management will make every effort to place the employee in a position that the employee is physically and mentally able to perform; in so doing, Management will attempt to place the employee in a position as close as possible to their previous wage level. The promotional provisions of Article 12 shall not be construed as a bar to appointing an individual under this provision to a classification with a higher maximum range.
