Illicit employment. 24.5.1. The Supplier shall comply with all relevant labour legislation and shall pay all its staff-related social charges. Supplier’s obligations set forth in this Article 24.5 are essential obligations to the Contract. 24.5.2. In particular, as soon as the Contract becomes effective within the meaning of Article 3 above and every six (6) months thereafter until full performance of its obligations under the Contract, the Supplier shall provide to the Purchaser the following documents: (i) A certificate of incorporation ( or any other equivalent evidence of registration); (ii) A vigilance clearance certificate delivered by the competent welfare institution certifying that Supplier haspaid all social charges aswell as proof of its authenticity; (iii) A certificate of tax payment; (iv) A list containing the names of its non-European Union staff members, who are required to hold the work permit. Said list shall be established on the basis of the Supplier’s staff register and shall specify (i) the date on which the employee was hired; (ii) theemployee’snationality; and(iii) thetypeandordernumberofthework permit. 24.5.3. The Supplier shall be responsible for matters of scheduling and staff and agrees to comply with labour legislation especially that concerning working hours, rest periods and annual or other leave and shall be responsible for paying all the social security or analogous contributions relating to its staff.
