Improvement Plans for Subdivision No. 5064, The Villas at El Macero, 16 Sheets, prepared by Xxxxxxxxxx Engineering Collectively, the plans referenced in subsections 1.a above shall be hereinafter referred to as the “Improvement Plans.” The Improvement Plans include offsite improvements to Xxxx Boulevard and onsite storm drainage improvements. The Improvement Plans have not been finalized to date. The Improvement Plans shall be modified by Subdivider as required to obtain the approval of the County Engineer prior to issuance of a building permit. Subdivider shall not undertake any work to construct the foregoing improvements until it has received plan approval and it has provided at least five (5) business days advance written notice to the Director or designee. A City of Xxxxx (“City”) encroachment permit for work in the City right-of-way is required. The Subdivider agrees to modify the improvement plans, subject to the approval of the County Engineer, as may be required to obtain the City permit, and further agrees to complete work in the City right-of-way in accordance with the approved Improvement Plans and the City permit.
