Individual Agreements Prohibited. (a) Except for complaints of employment discrimination filed with fair employment practices agencies and disciplinary actions where the employee declines Union representation, the County will not negotiate directly with bargaining unit members about, or enter into agreements with unit members to settle employee grievances or complaints concerning bargain able terms and conditions of employment, without the consent or concurrence of the Union. (b) When the County negotiates with a bargaining unit member to settle an employment discrimination complaint that a unit member has filed as a private individual with a fair employment practices agency, the County will not, without the consent or concurrence of the Union, negotiate directly with the employee about, or enter into a settlement agreement that includes, provisions that change the bargainable terms and conditions of employment of bargaining unit members other than the individual complainant.
