Installation Terms and Conditions. (1) The Supplier is obliged notify the Purchaser in writing and prior to the submission of the order, of certain installation requirements (in particular location, electricity supply, air conditioning and cable installation) as well as any other necessary cooperation on the part the Purchaser. The Supplier is responsible for the accuracy and completeness of such instructions and is obliged to provide the necessary assistance and notify the Purchaser regarding the preparation of a specific site. In particular, it shall provide network schematics in the case of complex systems.

Installation Terms and Conditions. The terms of this Schedule 1 shall apply to all Installation products licensed by Flexera Software to Licensee. Any terms not defined in this Schedule 1 shall have the meanings ascribed to them in the Agreement. The provisions of this Schedule 1 shall be in addition to the terms included in the main body of the Agreement, provided that in the event of a conflict between the terms included in this Schedule 1 and the terms of the main body of the Agreement, the terms included in this Schedule 1 shall control. For and in consideration of the payments, agreements and conditions hereinafter mentioned, and under the conditions expressed in the bonds herein, ENGINEER xxxxxx agrees to complete the construction of improvements described as follows: Xxxxxx-Xxxxx Water Treatment Plant Temporary Master Ozone Control Panel Replacement City of Arlington Project No. WUTR14019 in the City of Arlington, Texas, and all extra work in connection therewith, under the terms as stated in the latest revision of the STANDARD SPECIFICATIONS FOR WATERWORKS & SEWERAGE IMPROVEMENTS IN THE CITY OF ARLINGTON, TEXAS, AS ADOPTED BY ORDINANCE 97-124 OF THE ARLINGTON CITY COUNCIL, ON SEPTEMBER 2, 1997, as it may be amended from time to time, hereinafter referred to as “Standard Specifications”; and under the terms of ALL Special Provisions and Special Specifications of this contract; and at his, her or their own proper cost and expense to furnish all superintendence, labor, insurance, equipment, tools and other accessories and services necessary to complete the said construction in accordance with all the Contract documents, incorporated herein as if written word for word, and in accordance with the plans, which include all maps, plats, blueprints, and other drawings and printed or written explanatory manner therefore, and the specifications as prepared by City of Arlington Water Utilities Department herein entitled the ENGINEER each of which has been identified by the endorsement of the Contractor’s written proposal, these Special Provisions of the Standard Specifications, Special Specifications, and the payment, performance, and maintenance bonds hereto attached; all of which are made a part hereof and collectively evidence and constitute the contract.

  • CLOUD SPECIFIC TERMS AND CONDITIONS To the extent that Contractor has received an award for Lot 3, Cloud, the following terms and conditions apply to Lot 3, Cloud. For the duration of an Authorized User Agreement, the Cloud Solution shall conform to the Cloud Solution Manufacturer’s specifications, Documentation, performance standards (including applicable license duration, warranties, guarantees, Service Level Agreements, service commitments, and credits). PROTECTION OF DATA, INFRASTRUCTURE AND SOFTWARE Contractor is responsible for providing physical and logical security for all Data, infrastructure (e.g. hardware, networking components, physical devices), and software related to the services the Contractor is providing under the Authorized User Agreement. All Data security provisions agreed to by the Authorized User and Contractor within the Authorized User Agreement may not be diminished for the duration of the Authorized User Agreement without prior written agreement by the parties amending the Authorized User Agreement.
