Intentional violations. Notwithstanding any other provision contained in this Section 4.13 and in addition to any other rights and remedies set forth herein or otherwise available, if Accounts Owner in its sole discretion reasonably determines that CCRT or CAC has intentionally violated a Non-Program Prohibition or that such violation has occurred due to the gross negligence or willful misconduct of CCRT or CAC, Accounts Owner shall be entitled, effective upon written notice to CCRT and CAC, to refuse to permit any offers or solicitations for new Accounts to be made.
