Interim Award Clause Samples
An Interim Award clause allows an arbitral tribunal to issue a decision on certain issues or claims before the final resolution of the entire dispute. In practice, this means the tribunal can address urgent matters, such as payment of undisputed amounts or preservation of assets, while the main proceedings continue. The core function of this clause is to provide timely relief or clarity on specific points, helping to resolve pressing issues without waiting for the conclusion of the full arbitration process.
Interim Award. (I) Where the arbitral tribunal considers it necessary, or where a party so requests and the arbitral tribunal agrees, the arbitral tribunal may, before rendering the final award, render an interim award on any procedural issues or substantive issues.
(II) The rendering of an interim award and whether or not an interim award is complied with does not affect the continuation of the arbitral proceedings or the rendering of a final award by the arbitral tribunal.
