THE PARTICIPANT SHALL a.) Comply with all applicable portions of the Procedural Guide, attached hereto as “Appendix A” and made a part hereof, as may be revised from time to time by, and at the sole discretion of, XXXXX; b.) Perform or authorize tests, allow plant inspection and allow review of Participant records, as requested by the Validator, of representative samples of every playground surfacing product offered for validation as provided in the Procedural Guide; c.) Provide the Validator with the information described in the Procedural Guide to initially validate the representative samples of the playground surfacing product, and to use in determining whether subsequent production products conform to the representative samples of the product originally tested; d.) Annually provide the Validator with: i) a copy of the current, fully executed License Agreement;

THE PARTICIPANT SHALL a) Comply with all applicable portions of the Procedural Guide, attached hereto as "Appendix A" and made a part hereof, as may be revised from time to time by, and at the sole discretion of, XXXXX; b) Perform or authorize tests, allow plant inspection, and allow review of Participant records as requested by the Validator for every certified public playground equipment model offered for validation, as provided in the Procedural Guide; c) Provide the Validator with the information described in the Procedural Guide to initially validate the public playground equipment model(s), and to use in determining whether subsequent production models conform to the model originally tested; d) Annually provide the Validator with i) a copy of the current, fully executed, License Agreement; ii) a copy of the current Certificate(s) of Insurance required by section 9 of this Agreement; iii) copies of all uses of the Certification Logo(s) and references to the XXXXX Certification Program in any media within the previous 12 months together, with copies of XXXXX’x written authorization to use the Logo(s) and reference the XXXXX Certification Program, if required by Appendix B, OR a certification on nonuse signed by the Participant’s President or CEO that the Participant has not used the Logo(s) or referenced the Certification Program in any media within the previous 12 months; e) During any plant inspections and review of Participant’s records, grant all authorized representatives of the Validator access during normal business hours to manufacturer's place(s) of manufacture, assembly, shipment or storage of public playground equipment models offered for certification, to enable the laboratory or its authorized agent(s) to examine such public playground equipment, or parts thereof, in order to provide assurance that the production models of certified public playground equipment are in conformance with the model originally certified, tested and validated; (initial here) f) Notify the Validator of all manufacturing, assembly, shipping or storage locations; and, within thirty

Check out eligible library materials to Eligible Patrons. C. Accept returned items borrowed from any other library in Iowa. a. Return items to the owning library and indicate the return date. b. Log an accurate record of actual postage spent to return items. Libraries will be reimbursed for full postage amount spent to return Open Access items. Libraries will not be reimbursed for any other method of return. c. If an item is overdue, the library that owns the item collects any fines according to local policy. d. Interlibrary Loan items are not eligible for postage reimbursement.

THE PARTICIPANT SHALL. 1.2.1 participate in the RTGS PS in accordance with this PA and maintain its compliance with the requirements for participation in the RTGS PS; 1.2.2 faithfully comply with the RTGS Rules and any supplementary rules that the Bangko Sentral may issue to properly implement certain provisions of the RTGS Rules, including reporting requirements, fees and other charges, and business day schedule; 1.2.3 abide by relevant laws and Bangko Sentral rules, regulations, and guidelines on payments; 1.2.4 establish an appropriate risk management system that minimizes the risk it assumes and those it poses to the payment system; 1.2.5 comply with the Intraday Liquidity Facility (ILF) rules and regulations, if qualified to avail of this facility; and 1.2.6 observe the guidelines on sponsored participation stated in the RTGS Rules and supplementary rules, if any, in case it acts as a sponsoring participant and consequently assumes the responsibility for any loss, liability, or damage caused by its sponsored participant(s) insofar as settlement is concerned.

Public Libraries must use IAShares to return items to other public libraries. Public Libraries should use the USPS to return items to any other type of library that is not on IAShares. c. Academic libraries should use USPS when returning items to any other library. d. Log an accurate record and keep receipts of actual postage spent to return items. When using USPS, libraries will be reimbursed for the full postage amount spent to return Open Access items. Libraries will not be reimbursed for any other method of return. e. If an item is overdue, the library that owns the item may collect any fines according to local policy. f. Interlibrary Loan items are not eligible for postage reimbursement. g. Items returned through the IAShares service are not eligible for postage reimbursement.

  • GRANTEE Grantee will be in default under this Grant upon the occurrence of any of the following events: 15.1.1 Grantee fails to use the Grant Funds for the intended purpose described in Exhibit A or otherwise fails to perform, observe or discharge any of its covenants, agreements or obligations under this Grant; 15.1.2 Any representation, warranty or statement made by Grantee in this Grant or in any documents or reports relied upon by Agency to measure the Project, the expenditure of Grant Funds or the performance by Grantee is untrue in any material respect when made; or 15.1.3 A petition, proceeding or case is filed by or against Grantee under any federal or state bankruptcy, insolvency, receivership or other law relating to reorganization, liquidation, dissolution, winding- up or adjustment of debts; in the case of a petition filed against Grantee, Grantee acquiesces to such petition or such petition is not dismissed within 20 calendar days after such filing, or such dismissal is not final or is subject to appeal; or Grantee becomes insolvent or admits its inability to pay its debts as they become due, or Grantee makes an assignment for the benefit of its creditors.

  • Participant Bound by Plan Participant hereby acknowledges receipt of a copy of the Plan and agrees to be bound by all the terms and provisions thereof.

  • Participating Employers As of the Effective Date, the following Participating Employer(s) are parties to the Plan:

  • Named Fiduciary and Plan Administrator The “Named Fiduciary and Plan Administrator” of this Director Plan shall be Heritage Bank of Commerce until its resignation or removal by the Board. As Named Fiduciary and Plan Administrator, the Bank shall be responsible for the management, control and administration of the Director Plan. The Named Fiduciary may delegate to others certain aspects of the management and operation responsibilities of the Director Plan including the employment of advisors and the delegation of ministerial duties to qualified individuals.
