INTERPRETATION OF DRAWINGS, DOCUMENTS AND EXHIBITS. 4.1.3.1 If any Proposer, prior to submitting proposals, should find discrepancies in, or omission from the solicitation and corresponding documents, or if it should be in doubt as to the true meaning of any part of the proposed solicitation and all corresponding documents, it SHALL at once submit concerns or inquiries through eBid system for correction, clarification or interpretation of the point or points in question. The person submitting such request shall be responsible for its prompt delivery. A Contractor waives its right, if any, for additional compensation if it fails to seek correction, clarification, or interpretation prior to submittal of a Proposal. 4.1.3.2 In the event that the District receives such a request, and it should be found that certain essential information is not clearly and fully set forth, or if the District Engineer discovers or is informed of errors, omission or points requiring clarification in the drawings or documents, a written addendum will be issued to all Proposers who downloaded the solicitation and all corresponding documents via the eBid system. The District will not be responsible for any instructions, explanations or interpretations of the documents presented to Proposers in any manner other than by written addendum. 4.1.3.3 To the extent there is a lack of detail or information or conflict in the plans and materials provided with this RFP, the best or most for the District shall be required to be installed, and the District Engineer shall be guided accordingly.

  • Captions and Interpretation The captions used in this Agreement are for convenience only. They do not affect the meaning of the paragraphs in this Agreement.

  • Captions and Interpretations Paragraph headings in this Agreement are used solely for convenience, and shall be wholly disregarded in the construction of this Agreement. No provision of this Agreement shall be interpreted for or against a party because that party or its legal representative drafted such provision, and this Agreement shall be construed as if jointly prepared by the Parties.

  • ADDENDA AND EXHIBITS Attached hereto is an Addendum or Addenda consisting of Paragraph 49 through 52, and Exhibits A through A, all of which constitute a part of this Lease.

  • Headings and Interpretation Headings and sub-headings in this Agreement are inserted for reference and convenience only and shall not be deemed part of this Agreement. Wherever the fulfillment of the intent and purpose of this Agreement requires and the context will permit, the use of the masculine gender includes the feminine and use of the singular includes the plural.

  • Incorporation of Schedules and Exhibits The schedules, attachments and exhibits referenced in and attached to this Agreement shall be deemed an integral part hereof to the same extent as if written in whole herein. In the event that any inconsistency or conflict exists between the provisions of this Agreement and any schedules, attachments or exhibits attached hereto, the provisions of this Agreement shall supersede the provisions of any such schedules, attachments or exhibits.

  • Headings and Exhibits The headings herein are for purposes of references only and shall not otherwise affect the meaning or interpretation of any provision hereof. The schedules and exhibits attached hereto and referred to herein shall constitute a part of this Agreement and are incorporated into this Agreement for all purposes.

  • Schedules and Exhibits All of the schedules and exhibits attached to this Agreement shall be deemed incorporated herein by reference.
