Investigation of Incidents Involving PHI. In the event that further investigation is necessary, Business Associate will investigate the incident; it is Business Associate’s burden to conduct a risk assessment to sow whether there is a low probability that the PHI has been compromised. The risk assessment must review (i) the nature and extent of the PHI involved, types of identifiers and likelihood of re- identification; (ii) unauthorized person who used the PHI or to whom disclosure was made; (iii) whether the PHI was actually acquired or viewed and (iv) the extent to which the risk to PHI has been mitigated. Business Associate will provide DBHDD with sufficient information to allow DBHDD to make any notifications required under 45 CFR § 164.404. Business Associate shall provide such information in writing in such form as DBHDD may require without unreasonable delay but in no case later than thirty (30) days following Business Associate’s discovery of the incident. Business Associate shall report additional information promptly thereafter as information becomes available.

  • Notification of Incidents If Contractor becomes aware of or has reasonable suspicion of a privacy incident or security incident regarding any State data, Contractor must report such incident to the State and the State Chief Information Security Officer as soon as possible, but no later than twenty-four (24) hours after such incident. The decision to notify the affected data subjects and the form of such notice following report of a privacy incident or security incident are the responsibility of the State. Notwithstanding anything to the contrary in this Contract, Contractor will indemnify, hold harmless and defend the State and its officers, and employees for and against any claims, damages, costs and expenses related to any privacy incident or security incident involving any State data. For purposes of clarification, the foregoing sentence shall in no way limit or diminish Contractor’s obligation(s) to indemnify, save, hold harmless, or defend the State under any other term of this Contract. Contractor will reasonably mitigate any harmful effects resulting from any privacy incident or security incident involving any State data.

  • Facilitation of Investigation In case of any allegation of violation of any provisions of this Pact or payment of commission, the BUYER or its agencies shall be entitled to examine all the documents including the Books of Accounts of the BIDDER and the BIDDER shall provide necessary information and documents in English and shall extend all possible help for the purpose of such examination.

  • Suspension Pending Investigation When, in the judgment of the President, the presence of a Faculty Member on University property presents a threat to the health or safety of the Faculty Member or anyone in the University community or represents a threat of substantial disruption or substantial interference with the normal and lawful activities of the University community, the President may suspend with pay the Faculty Member pending the disposition of the disciplinary process provided in this Agreement. The President may also direct that the Faculty Member be removed and barred from University property. Such suspensions shall not be invoked in an arbitrary or capricious manner, and shall end upon the conclusion of the Article 9 investigation or, if discipline is proposed, at the end of any subsequent grievance proceeding.

  • Accident and Incident Investigations An accident, injury, critical injury, or hazardous situation will be investigated in accordance with the CJHSC’s investigation protocol.
