Job Security/Layoffs and Recalls. With respect to the development of any operating or re-structuring plan, proposal for funding in an “RFP” process, or downsizing or closure plans which may affect the bargaining unit, the Union shall be involved in the planning process as soon as practicable and, in any event, in advance of such plans or proposals being finalized and notices of layoff being issued or other actions being taken that would adversely affect the bargaining unit and through to the final phases of the process. This involvement shall take place at the Labour-Management Relations Committee level in accordance with Article 29. It shall be the function of the Labour – Management Committee to consider possible ways and means of avoiding or minimizing potential adverse effects upon employees in the bargaining unit including: i. identifying and proposing possible alternatives to any action that the Corporation may propose taking; ii. identifying and seeking ways to address the retraining needs of employees; iii. identifying vacant positions within the Corporation for which surplus members of the bargaining unit might qualify, or such positions which are currently filled but which are expected to become vacant within the twelve (12) month period. Meetings of the Committee shall be held during normal working hours. Representatives attending such meetings during their regularly-scheduled hours of work shall not lose regular earnings as a result of such attendance. The Corporation shall make typing and other such clerical assistance available as required. Each party shall appoint a co-chair for the Committee. Co-chairs shall chair alternate meetings of the Committee and will be jointly responsible for establishing the agenda of the Committee meetings, preparing minutes and writing such correspondence as the Committee may direct. Any agreement between the Corporation and the Union resulting from the above review concerning the method of implementation will take precedence over the other provisions of this agreement.
