JURISDICTION AND COSTS. 25.1 The parties hereby consent to the jurisdiction of the Magistrate’s Court otherwise having jurisdiction under section 28 of Magistrate Court Act of 1944, as amended. Notwithstanding that such proceedings are otherwise beyond the said court’s jurisdiction; this clause shall constitute the required written consent conferring jurisdiction upon the said court pursuant to Section 45 of the Magistrate’s Court Act of 1944, as amended. 25.2 Notwithstanding anything to the contrary herein contained either party hereto shall have the right at its sole option and discretion to institute proceedings in any other court which might otherwise have jurisdiction. 25.3 All legal costs incurred either party in consequence of any default of the provisions of the Contract by the other, shall be payable by the defaulting party on demand to the maximum amount permitted by law and shall include collection charges, the cost incurred by the aggrieved party in endeavouring to enforce such rights prior to the institution of legal proceedings and the costs incurred in connection with the satisfaction or enforcement of any judgment awarded in favour of the aggrieved party in relation to, in terms of or arising out of the Contract in respect of any legal proceedings arising out of the Contract.

JURISDICTION AND COSTS. 36.1 In the event of any action or application arising out of this agreement, the parties hereby consent to the jurisdiction of the Magistrate's Court otherwise having jurisdiction under section 28 of the Magistrate's Court Act of 1944, as amended. Notwithstanding that such proceedings are otherwise beyond the said court's jurisdiction, this clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said court pursuant to Section 45 of the Magistrate's Court Act of 1944, as amended; 36.2 Notwithstanding anything to the contrary herein contained, the Lessor shall have the right at the Lessor's sole option and discretion to institute proceedings in any other court which might otherwise have jurisdiction; 36.3 In the event of it becoming necessary for the Lessor to take any action against the Lessee as contemplated herein the Lessee agrees to pay to the Lessor all the attendant costs and expenses incurred by the Lessor, on a scale as between attorney and own client.

JURISDICTION AND COSTS. The Parties acknowledge and agree that the breach of this Agreement (and specifically of Section 4 hereof) by a Party may cause irreparable injury to another Party. In the event of such a breach, the Party so injured shall be entitled to seek equitable relief (including, without limitation, the granting of injunctive relief). The Parties agree that equitable relief shall not be exclusive of other remedies to which the injured Party may be entitled under Section 7.
JURISDICTION AND COSTS. The parties hereby consent in terms of Section 45 of the Magistrates Court Act No. 32 of 1944, as amended to the jurisdiction of the Magistrates Court having jurisdiction in terms of Section 28 of the said Act in respect of any legal proceedings arising out of this Agreement. The SELLER and the PURCHASER shall, however, have the right to institute proceedings in any other competent court.

When applicable, we may also take legal action in the High Court or any other court with jurisdiction. ▪ You agree that we may levy these fees, costs and charges to your solution and that it will form part of the outstanding balance. ▪ We will levy reasonable fees, costs and charges (which include, but are not limited to, legal costs to issue and serve summons, obtain judgment, issue warrants/ writs, effect attachment and arrange a sale in execution, disbursements and sheriff’s fees); if we have demanded such cost from you and you agreed to the cost, the cost is taxed or the cost is determined by the court. ▪ Notwithstanding the aforesaid, these fees, costs and charges remain due, owing and payable by you until settled in full.
