JURISDICTION AND COSTS. 25.1 The parties hereby consent to the jurisdiction of the Magistrate’s Court otherwise having jurisdiction under section 28 of Magistrate Court Act of 1944, as amended. Notwithstanding that such proceedings are otherwise beyond the said court’s jurisdiction; this clause shall constitute the required written consent conferring jurisdiction upon the said court pursuant to Section 45 of the Magistrate’s Court Act of 1944, as amended.
JURISDICTION AND COSTS. 26.1 The Purchaser consents to the jurisdiction of the Magistrates Court having jurisdiction over its person in respect of all proceedings connected with this agreement, notwithstanding that the value of the matter in dispute might exceed the Court’s jurisdiction. Notwithstanding the foregoing, the parties shall be entitled to institute all or any proceeding against any party connected with this Agreement in any Division of the High Court of South Africa having jurisdiction.
JURISDICTION AND COSTS. ▪ We can bring any action against you under this or any other agreement we have with you in the Magistrate’s Court, even if the amount claimed exceeds the jurisdiction of that Court. ▪ You agree to pay all the expenses we spent in recovering any money you owe us, including, our legal costs on the attorney and client scale; collection charges; tracing fees, plus VAT. Attorney and own client scale means the rates actually charged by our attorneys. These rates may be higher than the rates the courts allow.
JURISDICTION AND COSTS. 28.1 The parties hereby consent to the jurisdiction of the Western Cape High Court for any action or application arising from this agreement.
JURISDICTION AND COSTS. ▪ We can take legal action in a Magistrates’ Court that has jurisdiction. When applicable, we may also take legal action in the High Court or any other court with jurisdiction. ▪ You agree that we may levy these fees, costs and charges to your solution and that it will form part of the outstanding balance. ▪ We will levy reasonable fees, costs and charges (which include, but are not limited to, legal costs to issue and serve summons, obtain judgment, issue warrants/ writs, effect attachment and arrange a sale in execution, disbursements and sheriff’s fees); if we have demanded such cost from you and you agreed to the cost, the cost is taxed or the cost is determined by the court. ▪ Notwithstanding the aforesaid, these fees, costs and charges remain due, owing and payable by you until settled in full.
JURISDICTION AND COSTS. The Parties acknowledge and agree that the breach of this Agreement (and specifically of Section 4 hereof) by a Party may cause irreparable injury to another Party. In the event of such a breach, the Party so injured shall be entitled to seek equitable relief (including, without limitation, the granting of injunctive relief). The Parties agree that equitable relief shall not be exclusive of other remedies to which the injured Party may be entitled under Section 7.
JURISDICTION AND COSTS. 21.1 The parties hereby consent in terms of Section 45 of the Magistrates Court Act No. 32 of 1944, as amended to the jurisdiction of the Magistrates Court having jurisdiction in terms of Section 28 of the said Act in respect of any legal proceedings arising out of this Agreement. The SELLER and the PURCHASER shall, however, have the right to institute proceedings in any other competent court.

However, should STARTRACK VEHICLE TRACKING determine, it shall be entitled to institute proceedings in the High Court in which event it shall be limited to recovering costs on the Magistrate's Court scale.
JURISDICTION AND COSTS. 12.1. The CUSTOMER consents to the jurisdiction of the Magistrate's Court having jurisdiction over its person, irrespective of the amount in dispute. However, should SELFTRACK determine, it shall be entitled to institute proceedings in the High Court in which event it shall be limited to recovering costs on the Magistrate's Court scale.
JURISDICTION AND COSTS. Subject to the mandatory arbitration provisions herein, with respect to any proceeding in connection with any claim, counterclaim, demand, cause of action, dispute and controversy arising out of or relating to this Agreement, the Parties hereby consent to the exclusive jurisdiction of the federal courts sitting in Phoenix, Arizona. Both Parties waive any right to trial by jury in such action. In the event such judicial proceedings are instituted by either Party, the prevailing Party shall be entitled to award of its costs and reasonable attorneys’ fees incurred in connection with such proceedings.
