Common use of JURISDICTION OF WORK Clause in Contracts

JURISDICTION OF WORK. The Association hereby recognizes the jurisdiction of the Union over work to be that work which has historically and traditionally been performed heretofore by members of the Operating Engineers in the geographical area of this Agreement. It is also agreed that if a jurisdictional dispute should occur, involving the Union and another construction union, that there shall be no stoppage of work because of such dispute. If the Unions involved and the Association are unable to settle the dispute, the disputed work shall proceed as assigned by the contractor, and the problem shall be referred to the International Presidents of the Unions involved to seek a settlement by them or their assigned representatives.

The Association hereby recognizes Contractors recognize the jurisdiction of the Union over work to be that work which has historically and traditionally been performed heretofore by members of the Operating Engineers Laborers Union Local No. 663 in the geographical area of this Agreement. It is also agreed that if a jurisdictional dispute should occur, involving the Union and another construction unionUnion affiliated with the Contractors, that there shall be no stoppage of work because of such dispute. If the Unions involved and the Association Contractors are unable to settle the dispute, the disputed work shall proceed as assigned by the contractorEmployer, and the problem shall be referred to the International Presidents of the Unions involved unions involved, to seek a settlement by them or their assigned representatives.

It is also agreed that agreed, if a jurisdictional dispute should occur, occur involving the Union and another other construction unionunions, that there shall be no stoppage of work because of such dispute. If the Unions unions involved and the Association are unable to settle the disputedispute within five (5) working days, the disputed work shall proceed as assigned by the contractoremployer, and the problem shall be referred to the International Presidents international presidents of the Unions unions involved to seek a settlement by them or their assigned representatives. Their decision will be binding on all parties.
