Common use of - Jury Duty and Court Witness Leave Clause in Contracts

- Jury Duty and Court Witness Leave. After due notice to the Employer, employees subpoenaed to serve as a witness in a criminal proceeding or called for jury duty, shall be paid their regular compensation at their current base rate of pay for the period the court duty requires their absence from work duty, plus any expenses paid by the court. Such employees, so compensated, shall not be eligible to retain jury duty pay or witness fees and shall turn any such pay or fees received over to the Employer. The City of Minneapolis may charge a fee to the party issuing the subpoena for lost work time due to interview(s) or preparation(s) associated with being a witness. If an employee is excused from jury duty prior to the end of the normal workday, he/she shall return to work if reasonably practicable or make arrangements for a leave of absence without pay or use vacation or compensatory time. For purposes of this section, such employees shall be considered to be working normal day shift hours for the duration of their jury duty leave. Any absence, whether voluntary or by legal order to appear or testify in civil litigation, not in the status of an employee, shall not qualify for leave under this section. Such absences shall be charged against accumulated vacation, compensatory time or be without pay.
