Jury and Witness Duty Leave. 23.01 Employees who have been summoned to be a juror or witness by any body in Canada with the power to subpoena shall supply their supervisor with a copy of the summons as soon as possible after receipt of same. 23.02 Employees who have complied with Article 23.01 shall be given leave of absence without loss of normal salary during such service, provided that upon return to work they shall supply their supervisor with written confirmation of the dates on which they served, signed by an official of the Court or by the counsel for the party who required their attendance.

Jury and Witness Duty Leave. An employee who is called upon to serve on a jury or, attend as a witness by subpoena or summons or by providing proof satisfactory to the Employer of being required to attend as a witness in any proceeding held in or under the authority of any court in Canada, or before any legislative committee authorized to compel the attendance of witnesses before it or any person or body of persons authorized by law to compel the attendance of witnesses before it shall be allowed leave of absence with full pay, where full pay is defined as the number of hours scheduled to be worked.
Jury and Witness Duty Leave. Employees subpoenaed to act as jurors or witnesses in Criminal or Civil Court or a Coroner's Inquest shall be granted Leave of Absence for such purpose. The Employee shall be entitled to the Jury or Witness Duty Fee or his/her full salary for the period required, whichever is the greater. To qualify for the full salary, the Employee must remit to the Employer the amount of his/her Jury or Witness Duty Fee. The Employee shall retain any travel expenses which have been paid to him/her. This leave shall not be payable to Employees acting as a party filing a claim in a civil proceeding.
Jury and Witness Duty Leave applies with the following amendments: In the event an Employee is subpoenaed to act as a witness in a Criminal or Civil Court or at a Coroner’s Inquest as a result of an action arising out of the Employee’s duties, and the day(s) falls on a regularly scheduled day off, the Employer will endeavour to adjust the work schedule so there is no loss of regular earnings or days off. Employees will be required to advise the Employer immediately upon receipt of any notification of such appearance or as soon as it is practicable. In the event the Employer is not able to adjust the work schedule the overtime provisions shall apply. If the Employee does not notify the Employer immediately the overtime provisions will not apply.

(3) In the event an Employee is subpoenaed to act as Witness in Criminal or Civil Court or at a Coroner’s Inquest as a result of an action arising out of the Employee’s duties, and the day(s) fall on a regularly scheduled day off, the Employer will endeavour to adjust the work schedule so there is no loss of regular earnings or day(s) off. Employees will be required to advise the Employer immediately upon receipt of any notification of such appearance or as soon as practicable. In the event the Employer is not able to adjust the work schedule the overtime provisions shall apply. Jury and Witness Duty Leave. An employee scheduled to work, who is absent by reason of service as a juror, or of a subpoena as a Crown witness, or as a witness on a matter arising from the performance of duties, will be granted leave of absence with pay but shall surrender to the Corporation any fee received excluding payment for meals and travel.
Jury and Witness Duty Leave. Nurses subpoenaed to act as Jurors or Crown Witnesses in criminal or civil courts or for Health Unit related business shall be granted leave of absence for such purpose. A nurse shall be entitled to the Jury or Witness Duty fee or her/his full salary for the period, whichever is greater. If the full salary for the period is greater than the Jury or Witness Duty fee, then to receive her/his full salary, the nurse must remit to the Employer the full amount of her/his Jury or Witness Duty fee for the same period. The nurse shall retain any travel expenses received in connection with Jury or Witness Duty Leave. An employee who receives jury duty notice or a subpoena shall provide a copy of same to the Employer as soon as possible.

Jury and Witness Duty Leave. If an employee is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner's inquest in connection with a case arising from the employee's duties at the Manor, the employee shall not lose regular pay because of such attendance and shall not be required to work on the day of such duty provided that the employee: i) notifies the Manor immediately on the employee's notification that she/he will be required to attend court; ii) presents proof of service requiring the employee's attendance; iii) deposits with the Manor the full amount of compensation received, excluding mileage, travelling and meal allowance and a receipt where available.
Jury and Witness Duty Leave. (a) In the event that an employee is called for jury duty, the Employer shall pay the employee her regular pay for each day the employee is required to be absent from work provided that she: i) notifies the Employer immediately upon notification that she will be required to attend on jury duty; ii) presents proof of service to the Employer requiring such attendance; iii) promptly repays the amount (other than expenses paid to her) which she receives for such attendance; iv) reports to work when not required at court. (b) If an employee is required by subpoena to attend a court of law as a witness in connection with any litigation arising from her professional duties for the Employer or as a witness for the Crown, the Employer shall pay the employee her regular pay for each day the employee is required to be in attendance at court provided that she: i) notifies the Employer immediately upon receipt of the subpoena that she will be required to attend court and gives reasonable notice to the Employer of the time and dates at which she will be required to attend; ii) presents proof of service requiring such attendance and keeps the Employer promptly informed as to any subsequent times which she would be required to attend at the court of law arising from the subpoena; iii) promptly repays the amount (other than expenses paid to her) which she receives for such attendance; iv) reports to work when not required at court. (c) The employee shall accrue all benefits including seniority as if she were performing her regular duties for the Employer provided she fulfils her commitments under paragraphs 14.04 (a) and 14.04 (b).
Jury and Witness Duty Leave. In the event that an employee is called for jury duty or witness in any court, except as a witness on their own behalf, the Corporation shall pay the employee their regular pay for each day the employee is required to be absent from work provided that they: i) notifies the Corporation immediately upon notification that they will be required to attend on jury or witness duty; ii) presents proof of service to the Corporation requiring such attendance; iii) promptly repays the amount (other than expenses paid to them) which they receive for such attendance; iv) reports to work when not required at court. Time spent by an employee required to serve as a court witness in any matter arising out of their employment shall be considered as time worked at the appropriate rate of pay. Where an employee is charged with a criminal or statutory offence directly related to their duties, while on duty, and is subsequently acquitted of such charges or the charges are withdrawn, the employee will be reimbursed for any loss of regular wages incurred as a result of such charges. Where an employee is acquitted of such charges, the employee will be reimbursed for any reasonable legal expenses provided the Corporation is given an itemized account of all time and expenses.
