Jury Duty/Witness Leave. Unit members shall be granted leave, without loss of pay, to appear in court as a subpoenaed witness or to serve as a juror. Any compensation, less any mileage expenses, received for appearance as a witness or from serving as a juror under this section shall be endorsed over to the District so that the unit member’s compensation for any days of absence for the above purposes shall not be in excess of nor less than his/her regular pay.
Jury Duty/Witness Leave. An employee who is required to serve as a juror or subpoenaed to appear as a witness during regular working hours shall be granted paid leave upon proper documentation and application. Parties to a civil act or charged with a criminal violation will not be covered under this provision.
Jury Duty/Witness Leave. When an employee is required to serve on a Jury or as a Witness in a court proceeding in which the Crown is a party, he shall be granted time off and compensated for the difference between his normal earnings and payment received for jury duty or in being so subpoenaed. The employee will provide evidence that he reported for jury duty or attended as a subpoenaed witness. It is the employee's responsibility to come to work at anytime during the week that he is not actually required for Jury Duty or to be present in Court.
Jury Duty/Witness Leave. The Employer shall grant leave of absence without loss of regular pay to an employee who serves as a juror, or is required by subpoena to attend a court of law or coroner’s inquest related to their employment at their employment at the Home, providing the employee:
a. Notifies the Employer as soon as he/she becomes aware that he will be subpoenaed or receives the subpoena whichever comes first;
b. Presents to the Employer proof of service requiring the employee’s attendance;
c. Deposits with the Employer the full amount of compensation, excluding mileage or travel and meal allowance and an official receipt. If not selected to sit on a jury or released as a witness, the employee shall forthwith contact his/her supervisor and inform him/her of same and the supervisor will endeavour to reschedule the employee’s return to work as soon as possible.
Jury Duty/Witness Leave. When an employee is required to serve on a Jury or as a Witness or who is required in any court of law or coroner’s inquest, the employee shall be relieved of their duties for such time as it may require, and shall be paid the difference between the fee as a Juror or Witness, and their earnings for the time lost. It is the employee’s responsibility to come to work at anytime during the week that the employee is not actually required for Jury Duty or to be present in Court except where less than three (3) hours remain in the shift.
Jury Duty/Witness Leave. 16.4.1 Unit members may be granted leave, without loss of pay, to appear in court as a witness, other than as a litigant, or to respond to an official order from duly authorized government agencies, for reasons not brought about by connivance or misconduct of the employee, or to serve as a juror.
16.4.2 Any compensation, less any mileage expenses at current IRS rate, received for appearance as a witness or from serving as a juror under this section shall be endorsed over to the District so that the unit member's compensation for any days of absence for the above purposes shall not be in excess of nor less than, her/his regular pay.
Jury Duty/Witness Leave. (with compensation)
Jury Duty/Witness Leave a. When regularly called for jury duty in the matter provided by law, members of the bargaining unit shall be granted a leave of absence without loss of pay or benefits for the time the employee is required to perform jury duty during the employee’s regularly assigned working hours.
b. Request for jury service leave shall be made by presenting, as soon as possible, the official court summons to jury service to the member’s immediate supervisor and to the District payroll office through regular administrative channels.
c. Reimbursement to the District of any monies earned as a juror, except mileage and parking, shall be made by the member of the bargaining member to the District immediately upon receipt of such monies and fees by the unit member.
d. The District may require verification of jury duty time prior to, or subsequent to, providing jury duty compensation.
e. Upon return to duty, an absence report shall be filed with the appropriate office.
Jury Duty/Witness Leave. 12.14.1 Employees called for jury duty and receiving remuneration for that service, or employees receiving witness fees, shall continue to receive their full pay from the District. The employee shall remit to the District the money received for that portion of his/her services performed during his/her normal work hours, excluding any travel allowances. This may be done either by endorsing his/her jury duty/witness fee check to the District or by remitting any equal amount in cash or personal check to the District.
12.14.2 Any employee whose regularly assigned shift begins or continues after 5:00 P.M. and who is required to serve the day’s full court obligation on jury duty shall be relieved from work that day with pay.
12.14.3 Employees may choose to keep their jury duty checks and receive no District pay.
Jury Duty/Witness Leave. 10.7.1 Unit members shall be provided leave with full pay for regularly called jury duty.
10.7.2 The unit member, while serving on jury duty, shall receive pay in the amount of the difference between the unit member's regular earnings and any amount received for jury service, exclusive of reimbursement by the court for jury duty expenses.
10.7.3 A unit member who voluntarily defers his/her jury duty service from working to non-working days, shall receive the daily substitute teaching pay for the actual time spent on jury service during a recess (non-working) period. It is understood that summer school is considered a working period for those assigned. In order to receive the substitute pay, the employee must submit a copy of the original summons, the notification of postponement of service, and the dated proof of jury service.
10.7.4 Unit members shall be provided leave with full pay in order to appear as a witness in court, other than as a litigant, in response to an official order from another governmental jurisdiction for reasons not brought about through the connivance or misconduct of the unit member.
10.7.4.1 The unit member shall notify the District as soon as possible after being officially called. The unit member shall receive their regular salary and shall sign over to the District any fees received, except for travel, meals, or parking allowance.
