Laboratory's Responsibility. Laboratory shall assume the risk of, be responsible for, have the obligation to insure against, and to the fullest extent allowed under applicable law, indemnify the City and hold it harmless from any and all liability for any loss of or damage or injury to any person (including death resulting therefrom) or property occurring in, or about the Facility, regardless of causeas a result of the gross negligence or intentional acts of Laboratory, except for any loss or damage from fire or other casualty and except for that caused by the sole gross negligence or intentional acts of the City and its employees, agents, customers and invitees; and Laboratory hereby releases the City from any and all liability for the same. Laboratory's obligation to indemnify the City hereunder shall include the duty to defend against any claims asserted by reason of such loss, damage or injury and to pay any judgment, settlements, costs, fees and expenses, including attorneys’ fees, incurred in connection therewith. Notwithstanding anything herein to the contrary, Laboratory shall bear the risk of any loss or damage to its property. Laboratory shall give the City prompt written notice of any accident, fire, or damage occurring on or to the Facility or the Property. The City shall indemnify and hold Laboratory harmless from and all liability for any loss of or damage or injury to any person (including death resulting therefrom) or property occurring in or about the Facility arising out of the sole gross negligence or intentional acts of the City, except for any loss or damage from fire or other casualty and except for that caused by the sole gross negligence or intentional acts of Laboratory and its employees, agents, and invitees; and the City hereby releases Laboratory from any and all liability for the same.
