Landlord's Negligence. Subject to the provisions of Section 16(a) and Section 16(c) to the extent permitted by law, no agreement of Tenant in this Lease shall be deemed to exempt Landlord from liability or damages for injury to persons or damage to property caused by or resulting from the negligence of Landlord, its agents, servants or employees, in the operation or maintenance of the Premises or the Development.
Landlord's Negligence. Any expense incurred as a result of the adjudicated negligence of Landlord, its agents, servants or employees.
Landlord's Negligence. Nothing contained herein shall operate to relieve Landlord from any loss, damage, injury, liability, claim, cost or expense which it is determined by a court of competent jurisdiction was proximately caused by its willful misconduct or its own sole negligence or the sole negligence of its agents or employees.
Landlord's Negligence. Subject to the provisions of Section 13.B. and Section 13.C., to the extent permitted by law, no agreement of Tenant in this Lease shall be deemed to exempt Landlord from liability or damages for injury to persons or damage to property caused by or resulting from the negligence of Landlord, its agents, servants or employees, in the operation or maintenance of the Premises or Building.
Landlord's Negligence. Landlord will be responsible for reimbursing Tenant for damage to the tenant’s tangible personal property caused by the negligence of Landlord or Landlord’s agents.
Landlord's Negligence. Unless otherwise provided in this Lease, Landlord will indemnify Tenant from all liability and claims for property damage or bodily injury occurring while this Lease is in effect, but only to the extent such injury or property damage was caused by Landlord's negligence, and provided that Tenant gives Landlord prompt written notice of any such claims.
Landlord's Negligence. (a) Nothing contained in section 8.2 shall be construed to require Tenant to indemnify and hold harmless Landlord, its agents or employees, from Landlord's liability to third parties for its negligent or willful acts or omissions or the expenses of defending against claims arising therefrom.
(b) Notwithstanding anything to the contrary in section 8, Landlord shall be liable for its negligent or willful acts or omissions and that of its agents or employees.
Landlord's Negligence. Notwithstanding anything to the contrary set forth in the foregoing provisions of this Article X, Landlord agrees to indemnify and hold harmless Tenant from and against all loss, cost and expense resulting from Xxxxxxxx's negligence, or from any other tortious act of Landlord.
Landlord's Negligence. Anything to the contrary notwithstanding, subsection 6.2(a) hereof shall not apply with respect to any damage or injury occasioned by the negligence or intentional torts of Landlord and its designated agents, servants or employees or resulting from a failure of Landlord to perform its obligations under this Lease within a reasonable time after notice of default is received from Tenant.
Landlord's Negligence. Nothing contained in this Lease shall operate to relieve Landlord of the consequences of its own negligence or the negligence of its agents or employees. WAIVER OF SUBROGATION
