Late Publication of Rosters. 4.9.1 The parties acknowledge the importance of ensuring rosters are provided with the agreed minimum notice to ensure RMOs can manage the impact of rostered out-of-hours duties on their personal/family life and commitments. 4.9.2 During the term of this agreement, DHBs and STONZ will monitor and record all instances where an RMO roster was provided with less than the 28 days’ notice required in clause 4.3. 4.9.3 The following escalation pathway will apply: Service or RMO Unit advises: • Designated Executive Lead (based on RMO Unit Reporting line) and • STONZ that the roster has been published with less than the required notice Advice includes any issues the service/RMO Unit considers are the reason(s) for the late notice AND / OR Members advise STONZ that they have received their roster with less than the required notice XXXXX raises instance with Designated Executive Lead and seeks explanation Service asked to confirm occurrence and identify any issues the service/RMO Unit considers are the reason(s) for the late notice If this is not the first occasion of recent late publication of this roster, then the Service/RMO Unit will report to the Executive Lead and STONZ and • identify any systemic issues (e.g., resourcing) behind late publication of rosters • identify the steps being taken to address these issues • identify the timeframe for these actions to be completed This report will be provided to SNEF for national recording Report progress in implementing these steps to the Executive Lead and STONZ Should the service again fail to publish roster on time, Executive Lead, STONZ and the Service/RMO Unit will meet to discuss and agree remediation action(s) required SNEF will be advised of this meeting and the agreed outcomes STONZ reserves right to seek compliance

Late Publication of Rosters. 4.9.1 The parties acknowledge the importance of ensuring rosters are provided with the agreed minimum notice to ensure RMOs can manage the impact of rostered out-of-hours duties on their personal/family life and commitments. 4.9.2 During the term of this agreement, Districts and STONZ will monitor and record all instances where an RMO roster was provided with less than the 28 days’ notice required in clause 4.3. 4.9.3 From the date of ratification, where an RMO Roster is published with less than the 28 days’ notice required under 4.3, all RMOs working that roster will receive a penalty payment of $75 for every full or part day that the roster is late. 4.9.4 This payment will not be made: (a) where the exception in 4.3 applies; or (b) to relievers who are covered by 4.4 or Appendix 2; or (c) where the production and publication of the roster is substantially undertaken by an RMO in the service (whether or not this is remunerated under clause 4.7). 4.9.5 The National Manual will include advice on the operation of this penalty. 4.9.6 This continuation of this clause will be reviewed as part of the renegotiation of this Agreement.

  • Non-Publication The parties mutually agree not to disclose publicly the terms of this Agreement except to the extent that disclosure is mandated by applicable law or regulation or to their respective advisors (e.g., attorneys, accountants).

  • Directory Publication Nothing in this Agreement shall require Verizon to publish a directory where it would not otherwise do so.

  • POST ONLINE PUBLIC AUCTION PROCEDURES 4.1. Successful E-bidders shall and undertake to sign the Memorandum of Sale at the office of the Auctioneer within 3 working days from the date of auction, failing which the deposit paid will be forfeited to the Assignee bank and the sale will be deemed cancelled/terminated and the property may be put up again for subsequent auction without further notice to the said E-Bidders. The Auctioneer shall send the Memorandum of Sale for stamping and thereafter forward the same together with the required deposit paid under Clause 2.4 above and the differential sum paid under this clause (if any) to the Assignee bank. 4.2. Any successful E-bidder who is unable to attend to sign the Memorandum of Sale at the Auctioneer's office may do so by authorising another person to sign the same of his/her behalf by inserting the particulars of the authorised person and furnishing a copy of his/her identity card and also a Letter of Authorisation for this purpose. 4.3. In the event that there is inconsistency between the personal details and the documents uploaded in the PAH Website and the actual documents produced by the successful bidder, the Auctioneer shall have the right to refuse the successful bidder from signing the Memorandum of Sale and may at its discretion cancel the sale and proceed to put up property up for a new auction and the deposit paid shall be forfeited. 4.4. The Memorandum of Sale upon being signed by the Auctioneer, Solicitor for the Assignee bank and the successful Bidder/Authorised agent shall be conclusive evidence of the sale of the property to the successful bidder.

  • ONLINE PUBLIC AUCTION PROCESS Bidders may browse through the PAH Website and select the properties they wish to bid online.

  • Scientific Publications During the Research Program Term, neither Party shall first publish or first present in a public forum the scientific or technical results of any activity performed pursuant to this Agreement without the opportunity for prior review and comment by the other Party. Each Party agrees to provide the other Party with the opportunity to review any proposed abstract, manuscript or scientific presentation (including any verbal presentation) that relates to its activities performed pursuant to this Agreement during the Research Program Term, at least [**] days prior to its intended submission for publication and agrees, upon request, not to submit any such abstract or manuscript for publication until the other Party is given a reasonable period of time up to [**] to secure patent protection for any material in such publication that it believes to be patentable. Both Parties understand that a reasonable commercial strategy may require delay of publication of information or filing of patent applications first with respect to activities performed or results obtained pursuant to this Agreement during the Research Program Term, or not to publish at all if necessary to preserve trade secrets. The Parties agree to review and decide whether to delay publication of such information to permit filing of patent applications. Neither Party shall have the right to publish or present any Confidential Information of the other Party, except as provided in Section 9.2. After the Research Program Term, each Party and its Affiliates may publish or present results, data or scientific findings of any of their activities without the prior review of the other Party, provided that such publication or presentation does not disclose any of the other Party’s Confidential Information. Nothing contained in this Section 9.3 shall prohibit the inclusion of information necessary for a patent application; provided that the non-filing Party is given a reasonable opportunity to review the information to be included prior to submission of such patent application in accordance with Section 8.2. Nothing contained in this Section 9.3 shall prohibit either Party from disclosing the results, data or scientific findings of any activity performed by the other Party or its Affiliates pursuant to this Agreement without prior review and prior written consent of the other Party, where required, as reasonably determined by the disclosing Party’s legal counsel, by applicable law; provided that if a Party is required by law to make any such disclosure, to the extent it may legally do so, it will give reasonable advance notice to the other Party of such disclosure and will use its reasonable efforts to secure confidential treatment of such information prior to its disclosure (whether through protective orders or otherwise).

  • RESEARCH AND PUBLICATION 29 CONTRACTOR shall not utilize information and/or data received from COUNTY, or arising out 30 of, or developed, as a result of this Agreement for the purpose of personal or professional research, or 31 for publication. 32

  • PUBLICATION AND PUBLICITY The CONSULTANT agrees that it shall not for any reason whatsoever communicate to any third party in any manner whatsoever concerning any of its CONTRACT work product, its conduct under the CONTRACT, the results or data gathered or processed under this CONTRACT, which includes, but is not limited to, reports, computer information and access, drawings, studies, notes, maps and other data prepared by and for the CONSULTANT under the terms of this CONTRACT, without prior written approval from the COMMISSION, unless such release or disclosure is required by judicial proceeding. The CONSULTANT agrees that it shall immediately refer any third party who requests such information to the COMMISSION and shall also report to the COMMISSION any such third party inquiry. This Article shall not apply to information in whatever form that comes into the public domain, nor shall it restrict the CONSULTANT from giving notices required by law or complying with an order to provide information or data when such order is issued by a court, administrative agency or other authority with proper jurisdiction, or if it is reasonably necessary for the CONSULTANT to defend itself from any suit or claim. All approved releases of information, findings, and recommendations shall include a disclaimer provision and all published reports shall include that disclaimer on the cover and title page in the following form: The opinions, findings, and conclusions in this publication are those of the author(s) and not necessarily those of the Mississippi Department of Transportation, Mississippi Transportation Commission, the State of Mississippi or the Federal Highway Administration.

  • RECEIPT AND PUBLICATION OF NOTICES 10.1 Immediately after it receives a demand or notice from any Noteholder in accordance with the Conditions, the Agent shall forward a copy to the Issuer. 10.2 On behalf of and at the request and expense of the Issuer, the Agent shall cause to be published all notices required to be given by the Issuer to the Noteholders in accordance with the Conditions.

  • Publication of Results The National Aeronautics and Space Act (51 U.S.C. § 20112) requires NASA to provide for the widest practicable and appropriate dissemination of information concerning its activities and the results thereof. As such, NASA may publish unclassified and non-Proprietary Data resulting from work performed under this Agreement. The Parties will coordinate publication of results allowing a reasonable time to review and comment.
