LESSOR MAY PERFORM. If Lessee at any time shall fail to pay to any person any sum which Lessee is required by the Lease to pay or shall fail to do or perform any other thing Lessee is required by the Lease to do or perform, Lessor at its option may pay such sum or do or perform such thing, and Lessee shall reimburse Lessor on demand for the amount of such payment and for the cost and expense which may be incurred by Lessor for such acts or performance, together with interest thereon at the Default Rate from the date of demand until paid.
LESSOR MAY PERFORM. If Lessee, at any time, shall fail to pay any sum which Lessee is required by this Agreement to pay or shall fail to do or perform any other act Lessee is required by this Agreement to do or perform, Lessor at its option may pay such sum or do or perform such act, and Lessee shall reimburse Lessor on demand for the amount of such payment and for the cost and expense which may be incurred by Lessor for such acts or performance, together with interest thereon at the Default Rate (as defined in Section 18 of this Agreement) from the date of demand until paid.
LESSOR MAY PERFORM. If the Lessee shall fail to observe, perform or keep any of the provisions of this Lease to be observed, performed and kept by the Lessee, the Lessor may, but shall not be obliged to, at its discretion and without prejudice to any other right, claim or action it may have, rectify the default of the Lessee, whether or not performance by the Lessor on behalf of the Lessee is otherwise expressly referred to in the applicable Section of this Lease. For such purpose the Lessor may make any payment or do or cause to be done such things as may be required including, without limiting the generality of the foregoing, entry upon the Leased Premises. Any such performance by or at the behest of the Lessor shall be at the expense of the Lessee and the Lessee shall pay to the Lessor as Additional Rent the cost thereof.
LESSOR MAY PERFORM. Should the Lessee fail to make any payment or do any act as provided by this Lease, then the Lessor shall have the right (but not the obligation), without notice to the Lessee and without releasing the Lessee from any obligations hereunder, to make or do the same or to make advances to preserve the Equipment or the Lessor's title thereto and to pay, purchase, contest or compromise any insurance premium, encumbrance, charge, tax, lien or other sum which in the judgment of the Lessor appears to affect the Equipment, and in exercising such rights, the Lessor may incur any reasonable liability and expend reasonable amounts necessary therefor. All sums so incurred or expended by the Lessor shall be due and payable by the Lessee within ten (10) days of notice thereof.
LESSOR MAY PERFORM. If the Lessee fails to perform any agreement contained herein, the Lessor may itself perform, or cause performance of, such agreement, and the expenses of the Lessor incurred in connection therewith shall be payable by the Lessee under Section 14(b).
LESSOR MAY PERFORM. If Guarantor fails to perform any agreement contained herein, Lessor may itself perform, or cause performance of, such agreement, and the expenses of Lessor incurred in connection therewith shall be payable by Guarantor under Section 7.
LESSOR MAY PERFORM. If the Lessee shall fail to perform any agreement contained in this Ground Lease, the Lessor may itself perform, or cause performance of, such agreement, and the reasonable expenses of the Lessor incurred in connection therewith shall be payable by the Lessee to the Lessor as additional rent hereunder.
LESSOR MAY PERFORM. If Lessee at any time shall fail to pay any person any sum which Lessee is required by this Lease to pay, or shall fail to take any action Lessee is required by this Lease to take, Lessor at its option may pay such sum or take such action, and Lessee shall reimburse Lessor on demand for the amount of such payment and for the cost and expense which may be incurred by Lessor for taking such action, together with interest thereon from the date of demand until paid at the rate imposed for late payments under Section 5 hereof; provided, however, that no such payment, performance or compliance by Lessor shall be deemed to cure any Event of Default hereunder; and provided further, however, that Lessor shall not make any such payment or take any such action inconsistent with any contest rights Lessee may have under this Lease.
LESSOR MAY PERFORM. If Pledgor fails to perform any ------------------ agreement contained herein or under any of the Obligations Documents the Stock Purchase Agreement, the Participation Agreement or the BPC Note, Lessor may itself perform, or cause performance of, such agreement, and the expenses of Lessor or such other performing party incurred in connection therewith shall be payable by Pledgor; provided, however, that Lessor shall have no obligation to --------- ------- perform or cause performance of any of Pledgor's obligations hereunder.
