Liability for Injury to Persons or Property. A. Licensee agrees to supervise and to assume full control and responsibility for any persons, entities or things other than UCCR personnel or property who/which are, for any reason, on the Facility by reason of Licensee’s program or use of the Facility. B. Licensee agrees to defend, indemnify and hold harmless UCCR and the Facility Owner and their past, present and future members, directors, officers, employees, agents and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim made by any third party arising out of or in any way connected with Licensee’s actions and/or failure(s) to act with respect to its performance of this Agreement. C. During the term of this Agreement, Licensee shall at its own expense maintain a policy of comprehensive public liability limits of not less than one million dollars, naming UCCR and the Facility Owner as additional insured; or Licensee shall be self-insured against loss and/or claims in an amount of not less than one million dollars, naming UCCR and the Facility Owner as additional insured and shall, upon signing this Agreement, present adequate proof at least 30 days prior to arrival that it will be so insured during the entire period of its use of the Facility. D. Neither UCCR nor the Facility Owner shall be liable to Licensee or to any company insuring Licensee for any loss or damage to Licensee if the casualty causing such loss or damage was or could have been covered by any other property insurance. E. For the purpose of this section, “any person” includes, but is not limited to, Licensee’s agents and employees, participants in Licensee’s program, and Licensee’s visitors. F. Licensee shall require that transportation providers, transporting persons to and from UCCR sites, shall hold valid licenses appropriate to the vehicle(s) being used, and that they be currently insured for such operations. Licensee shall also require that the transportation provider send proof of insurance to UCCR at least 10 days in advance of Licensee’s arrival at the UCCR site.

User Group agrees to supervise and to assume full control and responsibility for any persons, entities or things other than Xxxxxx Crest personnel or property who/which are, for any reason, on the Facility by reason of User group's program or use of the Facility. B. User Group agrees to defend, indemnify, and hold harmless Luther Crest and its past, present and future members, directors, officers, employees, agents and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim made by any third party arising out of or in any way connected with User group's actions and/or failure(s) to act in respect of its use of the Facility. C. For the purposes of this section, "any persons" includes, but is not limited to, User Group's agents and employees, participants in User Group's program, and User Group's visitors.

Licensee agrees to defend, indemnify and hold harmless Camp Xxxxxxx on Seneca Lake (Presbytery of Geneva) and its past, present and future members, directors, officers, employees, agents, and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim made by any third party arising out of in any way connected with Licensee’s actions and/or failure(s) to act in respect of its use of the Facility. c. For the purpose of this section, “any person” includes, but is not limited to, Licensee’s agents and employees, participants in Licensee’s program, and Licensee’s visitors. d. Licensees, who contract for usage of the Facility, shall submit proof of insurance coverage, and shall name Camp Xxxxxxx on Seneca Lake as an insured party under said policy.

(b) Sponsor agrees to defend, indemnify and hold harmless FWC, the Florida Fish and Wildlife Foundation and its past, present and future members, directors, officers, employees, agents and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim made by any third party arising out of or in any way connected with the Sponsor’s actions and/or failure(s) to act in respect of its use of the Facility. (c) For the purpose of this section, “any person” includes, but is not limited to, Sponsor’s agents and employees, participants in Sponsor’s program and Sponsor’s visitors. (d) Sponsor will have all group participants sign a Waiver of Liability which must be delivered when group checks in.

Licensee agrees to defend, indemnify and hold harmless Catholic Charities Tri County Services and Roman Catholic Diocese of Albany and its past present and future members, directors, officers, employees, agents, and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim made by any third party arising out of in any way connected with Licensee’s actions and/or failure(s) to act in respect of its use of the Facility. c. For the purpose of this section, “any person” includes, but is not limited to, Licensee’s agents and employees, participants in Licensee’s program, and Licensee’s visitors. d. Catholic Charities Tri County Services reserves the right to require that the Licensee remove from the Facility any persons in, or in any way connected with, Licensee’s group who, in the sole opinion of Catholic Charities Tri County Services, are creating a disturbance or who are otherwise disrupting activities on said Facility. Licensee agrees to permit only authorized persons to enter the Facility and shall take all necessary steps to remove unauthorized persons from said Facility. e. It is recommended that the licensee obtain the names, addresses, emergency contact information and known health conditions of all participants. For minors without a parent on site, it is recommended that a signed permission to seek medical treatment is obtained.

Xxxxxxxx agrees to supervise and to assume full control and responsibility for any person, other than CAMP GREENWOOD personnel, who are for any reason present at the Licensed Facilities at the invitation or with the approval of the Licensee and for any event or program conducted or authorized by the Licensee. 2. Licensee agrees to defend, indemnify and hold harmless CAMP GREENWOOD and it’s past, present and future members, directors, officers, employees, agents and independent contractors and its and their successors, assigns and heirs from and against any harm and/or claim of damages made by any third party arising out of or in any way connected with Licensee’s actions and/or failures to act in respect of its use of the Licensed Facilities or any other portion of Camp Greenwood. 3. For the purpose of this section “any person” includes, but is not limited to, Licensee’s agents and employees, participants in Licensee’s program and Licensee’s visitors.

Licensee agrees to appropriately and adequately supervise and to assume full control and responsibility for any persons, entities or things other than Camp Tanako personnel or property who/which are, for any reason, on the Facility by reason of Licensee’s program or use of the Facility. “Supervision” is defined as the knowledge of and account for the activity and whereabouts of each minor at the Facility and proximity of adults to minors at all times assuring timely intervention of adult/staff to safeguard a minor from harm, hazardous situation or distress.

During the term of this agreement, Licensee shall at its own expense maintain a policy of comprehensive public limits of liability insurance not less than one million dollars, naming Heartland Conference of the United Church of Xxxxxx as additional insured. Written proof of said insurance policy that is satisfactory to Conference in its sole discretion shall be presented at least 30 days prior to arrival.
